SC admits petition on removal of Savarkar`s plaque at jail Â
New Delhi, Dec 01: The Supreme Court today decided to examine a petition seeking information about the facts and circumstances leading to the removal of a plaque containing verses of freedom fighter Veer Savarkar from Cellular Jail in Port Blair by a trust set up by the state-owned oil major India Oil Corporation.
The petitioner sought the information under the Right To Information Act.
The plaque with Savarkar's quotes was removed in December 2004 by the Indian Oil Foundation (IOF), a trust which was headed by the then Petroleum Minister Mani Shankar Aiyer.
A bench comprising Chief Justice Y K Sabharwal and Justice C K Thakker admitted the petition and issued notices to the Centre, IOC and IOF directing them to respond within four weeks.
"If this act (RTI) is not held applicable then nothing survives but if it is held applicable then it would be whether the information sought is suppliable or not in the public interest," the bench observed.
The petition filed by a Mumbai-based advocate Sanjiv Gajanan Punalekar submitted that the Centre refused to offer any explanation or to own up responsibility for the controversy on the sole ground that the decision to remove a plaque of Savarkar's quotes in Cellular Jail at Port Blair was taken by the Petroleum Minister in his capacity as chairman of IOF.
He said that the oil PSU had taken a stand that it was not liable to comply with obligations to supply informations to the citizens as even though the fundas were provided by and controlled by the minister in his ex-officio capacity. \Â
