It has been for a long time that AIADMK supremo J Jayalalithaa has been protesting against the use of electronic voting machines (EVMs) and finally to drive home the argument that EVMs are not tamper-proof, her party has decided to boycott the August 18 by-election in five Assembly segments in Tamil Nadu.
Giving this clarification in a statement, attached with an article on how students of Rice University in Houston were learning hands-on just how easy it was to wreak havoc on software programmes used in the EVMs, Jayalalithaa on Wednesday said: âThis should come as an eye-opener not only to the Election Commission of India and the judiciary but also to the voting public. In a democracy, every voter should know whether the vote cast has gone to the candidate or the party it was meant for. In the absence of such a certainty, the entire democratic process will be rendered a mockery. It is to ensure that democracy, in its true sense, is brought back that the AIADMK decided to boycott by-election to five Assembly constituencies in Tamil Nadu.â

Were the results of some Lok Sabha constituencies decided even before polling?
While tracking the lok Sabha elections of 2009 we stumbled upon startling versions of a file on polling information on the Election Commission of Indiaâs [ECI] website.
We were tracking candidate information from an Excel spreadsheet titled âCandidateACâ, which was downloadable from the ECIâs website. The âCandidateACâ spreadsheet has a column for âvotes polledâ. As one would expect, this file when downloaded on 16 April [the first day of polling] and 24 April did not contain any information on votes polled. The file, when downloaded on 6 May, 7 May and 11 May, had coded the candidate name, party name and the number of votes polled [check footnotes 1-5]. The last phase of polling took place on 13 May and, officially, the votes were counted and results declared on 16 May.
This information could have changed in three possible ways:
1. Someone had hacked the file.
2. The data from various EVMs had been uploaded to the private database, and this was used to create the public file.
3. Someone who had access to the private database had actually added the data.
The first possibility is serious, as it implies that the databases hosted by the ECI are not secure and can be compromised. The second is a violation of the ECIâs rule that no counting was to begin till 16 May. It also constitutes a breach of security, as the EVMs were supposed to be in safe custody in a strong room of the DEO [district election officer]. The third would imply that the election results were being decided by whoever had access to the private database. If the results were to be read only from the EVMs, why was a coded spreadsheet prepared? How could this spreadsheet have the data on âvotes polledâ? Check the file downloaded on 15 May. Surprisingly, it does not have any information on âvotes polledâ. More surprisingly, after the media raised the issue on 15 July, the link to the file disappeared from the ECI website.
Sceptics might say that the coded data containing information on the votes polled was test or dummy data. If so, why was this test or dummy data prepared? What was being tested? How was this test data generated? What were the results of the tests? Why was the data generated after the first three phases of polling, but before the fourth and fifth phases? Why was the data removed when there was no intention of loading real data into the file? Why was the dummy data coded? How do 108 winning candidates in the dummy data match the eventual winners?
When the implications are so serious, why has the ECI not clarified the issue despite repeated requests, or constituted a panel to initiate reforms to make the process less vulnerable to such serious implications?
EVMs, like all technology, can be hacked. Hacked EVMs can have Trojan Horses or programs with instructions to receive a coded spreadsheet and translate them into results. It is possible for such spreadsheets to actually prepare a predetermined result. If your bank publishes your account details and claims it is dummy data, will you let them manage your money? To ensure that such manipulations do not ruin our democracy what must the EVMs have? They must be built to leave a transaction trail auditable by anyone in case there is a dispute. To create such transaction trails, every vote cast on every EVM must be distinguishable from votes that might be cast by a Trojan. In the Indian system, the electronic votes are not recorded to indicate that they belong to a particular voter. Imagine a situation where you cannot track the money in a bank account as money deposited through a source: Someone, by gaining access to your account on the bankâs computer deposits an unlimited amount of money or withdraws whatever you have deposited, but you do not have the resources to trace that money or have a third party audit the bankâs books. That is why leaving a transaction trail is important in any audit process.
Now imagine a candidate having an âaccountâ in an EVM. Unless there is a mechanism to track every transaction as an inflow or outflow of votes from a legitimate source, there is no transaction trail and no ability to audit the actual vote balance in the candidateâs account. The votes cast by the voters are indistinguishable from those cast by a Trojan software or hardware. This is a very serious design lapse, and renders the EVMs completely useless for carrying out a costly democratic process. Will you trust your money with a bank that cannot track your accountâs transactions?
The current EVM system banks on faith, not on the accounting of votes â the faith of the voter in the honesty, integrity and fidelity of the EVMs, the people involved and in the process. Will you switch to a faith-based banking system when it comes to your money?
If the system is not faith-based, why not simply give the EVMs â like telephones â to electronic voting booths [EVBs] â like the STD-ISD booths â for anyone to run? Give everyone a week to vote and then collect the votes as you would collect the coins?
The manuals prepared for the chief election officer, district election officer, observers, polling agents, presiding officers, returning officers, candidates and counting agents show that the ECI gives little focus on building trustworthy databases, or on building good accounting practices and clean auditable systems that anyone other than they themselves can audit. Will the RBI permit financial institutions that cannot maintain basic records, or cannot be audited by third parties, to function?
Imagine a situation where you deposit your money in your account without getting any acknowledgement of your transaction specifying your account. In case there is a dispute, will you be able to claim that you had deposited the money into that account? When you deposit a vote for your candidate, do you get any acknowledgement about your deposit that you can use in a dispute? Is there any way that you can check later that your vote has been counted? Will you trust your money with a bank that does not give you a passbook or a statement of your deposits and withdrawals? What makes you trust the EVM with your liberty, and with your money that funds these elections? Finally, imagine a situation where your bank issues statements in which the number of depositors varies from statement to statement, as well as the deposits made. Managing the democratic process of voting requires a database of voters, of candidates, constituencies and of votes deposited in a candidateâs account by legitimate voters. The votersâ banker, the ECI, has failed not just to track its depositors â the voters â but also how many votes they have deposited. Public databases maintained by the ECI indicate that the elections of 2009 had 716,676,063 or 714,103,070 or 713,776,525 voters [check footnotes 6-8]. As for the number of votes polled in these elections, the figure was either 417,158,644 or 417,156,922 [check footnotes 9-10]. Most of our population will never ever be comfortable with technology. So no matter what security experts may say about the security of EVMs, the vast majority of our citizens will have a lingering doubt. Hence, we believe that each time we cast our vote, a small printer connected to the EVM also prints out the vote, not the name of the candidate but the number of the candidate in different languages. This would make the design of the system much simpler as the EVM per se does not know the name of the candidate. The person who is voting can obtain a physical confirmation that the machine printed the number of the button he or she pressed and then this ballot paper can be placed in the ballot box and sealed. A physical counting of votes can only be ordered by a court of law. This process may increase the cost of the election process, waste more paper, be environment unfriendly but we believe it will set all nay sayers to rest. We will get the best of both worlds. This is why no country in the world relies on just an electronic system simply because people do not believe that the EVM got their vote right.

Repoll was ordered in two polling stations in otherwise peaceful Ziro. Reason - tampering of electronic voting machine which was started in India with much fanfare some years back.
The demonstrated tampering on a 1min. 18 sec video, is simple and dramatic. The sequence in which the four candidates were listed on EC documents were modified on the EVM polling unit. BJP-TMC candidates sequence was switched; INC-NCP candidates sequence was switched. IntenT? Simply to register BJP votes to TMC and vice-versa and INC Votes to NCP and vice-versa.
Did a similar switch take place during the Lok Sabha Elections in, say, select 100+ constituencies? If so, the EC should be made accountable in HC/SC to stop using the EVMs in future polls, until a proper audit trail is put in place and controls as in the case of ATMs of Banks.

The debate on the integrity of the electoral process when electronic voting machines are used to cast votes got a fillip recently when a group of concerned citizens organised workshops in New Delhi and Chennai and invited some international experts who have played a part in the abolition of electronic voting in some countries of Europe and in a majority of the States in the US.
Among these experts was Mr Rop Gonggrijp, a computer hacker from the Netherlands who hacked a machine on a live television show and became instrumental in the banning of EVMs in his country; Mr Alex Halderman, professor of computer science at the University of Michigan and an authority on electronic voting security; and, Mr Till Jaeger, the attorney who argued against the use of EVMs before the German Federal Constitutional Court leading to the order banning of these machines in Germany. The Indian viewpoint on the vulnerability of EVMs was offered by Mr Hari Prasad, a noted ââ¬Ëhactivistââ¬â¢ from Hyderabad, who first raised the red flag about the integrity of the EVM-based election process.
According to Mr Gonggrijp and Mr Halderman, EVMs can be tampered with either at the manufacturing stage or when they are stored in State capitals for deployment in elections or at the polling booths. They are convinced that Indian EVMs are no different from those that were deployed in the Netherlands, Germany or Ireland, before they were discarded in those countries. One of the ways to rig an election is to introduce a Trojan in the display section of the control unit. This chip would give ââ¬Ëfixedââ¬â¢ results on the EVM screen. In other words, whatever the votersââ¬â¢ preference, the control unit would display numbers as per the hackerââ¬â¢s plan.
Mr Gonggrijp is a prominent campaigner for election transparency and verifiability, and his technical opinion appears to have clinched the issue against electronic voting in Germany as well. ââ¬ÅWhen the vote count happens inside a machine and there is no way in which the result can be cross-checked, the election ceases to be transparent,ââ¬Â he says. The lack of transparency appears to be the Achilles heel of electronic voting. Nobody knows what goes on inside these machines. This is the point on which the German Constitutional Court has held the deployment of EVMs as un-constitutional. It says the Constitution emphasises the public nature of elections and requires all essential steps to be open to public scrutiny.
While all these experts are categorical in their rejection of electronic voting devices, EVMs enjoy a great deal of credibility and public trust in India. This is so because the campaign about the unreliability of these machines is yet to get off the ground. However, politicians of various hues appear to be wary of these machines and have even accused rivals of ââ¬Ëmanipulatingââ¬â¢ them, albeit without a shred of evidence to establish mischief.
However, there are those like Mr Hari Prasad who have been demanding that the Election Commission offer opportunities for them to demonstrate the vulnerability of EVMs. The EC initially went along with the idea but developed cold feet and abruptly stopped one such exercise by Mr Prasad and his colleagues last September. Why did the EC back out?
Two other Indians who have plunged into this campaign are Mr Subramanian Swamy, whose petition against EVMs is currently before the Delhi High Court, and Mr GVL Narasimha Rao, election analyst and author of Democracy at Risk ââ¬â Can We Trust Our Electronic Voting Machines?. This book outlines the story of EVMs in India, Europe and the US, and describes how the non-response of the EC to questions raised by Mr Gonggrijp and Mr Hari Prasad has contributed in no small measure to the growing concern in political parties about the reliability of voting machines.
According to Mr Rao, among those who have raised doubts about EVMs are Mr LK Advani, leader of the BJP, Mr Ghulam Nabi Azad, Union Minister and Congress leader who attributed his partyââ¬â¢s defeat in Odisha last year to ââ¬Åmanipulationââ¬Â of EVMs, Mr Prakash Karat, general secretary of the CPI(M), Mr Sharad Yadav, president of the JD(U), Mr Mulayam Singh Yadav, president of the SP, Ms Mamata Bannerjee, president of Trinamool Congress, Mr Chandrababu Naidu, leader of the Telugu Desam, Ms Jayalalithaa, leader of the AIADMK, and leaders of the Pattali Makkal Katchi. One look at this list and you realise that there is a doubting Thomas everywhere ââ¬â in every one of the three known national coalitions and in different regions.
Mr Karat has formally written to the EC. He has said there are several questions in regard to the reliability of EVMs. Among them are: Possibility of incorporating a Trojan in the chip; possibility of manipulation of the chip at the manufacturing stage; lack of EC control over the technical process; and lack of third party inspection. He has said the EC must control the manufacture of EVMs, allow third party inspection and randomly shift EVMs from State to State.
After talking to experts, Mr Rao lists eight situations in which EVMs can be rigged. The EC has sought to counter these arguments by saying that the Indian EVMs are standalone machines which are not part of any network. Therefore, any surmise based on operating system based EVMs would be completely erroneous.
These arguments have been countered by Mr Ulrich Wiesner, a physicist and software engineer, who was the petitioner before the Constitutional Court in Germany. In a statement that is part of the rejoinder affidavit filed by Mr Swamy in the Delhi High Court, Mr Wiesner has said that EVMs in the Netherlands, Germany and Ireland were also standalone machines with no connection to the Internet. He says, ââ¬ÅIt is common sense that someone who has sufficient access to open the machines and replace the software or hardware can implement virtually any functionality ââ¬Â¦ that would not be spotted by tests.ââ¬Â
The EC is a public body with a fat budget. If it is to command the confidence of all stake-holders in the democratic process, it must function in a transparent manner and answer the questions raised by these citizens and experts. The inflexible and non-transparent attitude of the commission is lending credence to the argument that possibly it has no answers or, worse, it has something to hide.
To me the most intriguing part is all the parties complain of EVM fraud. If so who accomplishes the fraud- the chip maker?

CHANDIGARH: The electronic voting machines (EVMs) are being used in violation of the Information Technology Act 2000, a research paper has revealed.
Author of the research paper, advocate Ajay Jagga, told The Times of India, on Sunday that as per IT Act, 2000, a verifiable audit trail has to be provided in case of any electronic record, which is now admissible as evidence as per Evidence Act but in case of electronic voting, the voter does not get any receipt with regard to his voting.
The research paper recently attracted the attention of experts when a conference on ââ¬ÅEVMs: How trustworthy?ââ¬Â in Chennai passed a unanimous resolution on February 13 asking Jagga to approach the Election Commission of India (ECI) for bringing the electronic voting procedure in tune with IT Act, 2000.
Jagga said he would soon approach ECI seeking formation of legal committee to remove the illegality or will knock the doors of court.
The lawyer said, ââ¬ÅUnless the voter gets a receipt like the one we get in ATM or after the use of debit or credit cards, all electronic transactions including a vote, are illegal.ââ¬Â What is the evidence that the vote cast has really been recorded and that it has been recorded in the manner the voter intended, he asked.
For the purpose and to protect the secrecy of ballot, all such receipts, after the voter has checked his transaction, should be put in a box which should remain with ECI to be produced as evidence in case of a dispute, he said. The government amended the relevant laws in 1989 to equate EVM with ballot and ballot box to facilitate transition from ballot paper to EVM but the IT Act 2000 created a new complication that has to be immediately resolved in the interest of fairness of things, Jagga pointed out.
The lawyer also proved that the machine can be tampered with which has been accepted by the government itself in its letter to withdraw patent applications filed by Electronics Corporation of India and Bharat Electronics Ltd, makers of the machine. The PSUs withdrew their patent applications on the ground that the machine may not be tamper-proof, he said, adding that America and Germany had to return to ballot paper after their machines were found wanting.

Yes. It is a machine and any machine can be tampered with. No machine is foolproof. India is land with a great deal of corruption. Politicians can lay their hands on some experts and get a machine tampered with. We have conducted a lot of study into this and realised that is very easy to manipulate the election process in India.
But the general argument is that the EVM has done away with booth capturing.
I agree. But then if there is booth capturing, one is aware that something of this sort has happened and action can initiated. Electronic tampering can be done on a large scale and no one ever comes to know about it. This is what we are trying to demonstrate.
