"It is very unfortunate that there is no control over corruption in the country. There is rampant corruption particularly in the department of Income Tax, Sales Tax and Excise Department. Nothing moves without money," a Bench of Justices Markandeya Katju and T S Thakur said.



The apex court made the remarks while admitting an appeal filed by the CBI challenging the acquittal of an Income Tax Inspector Mohanlal Sharma by the Punjab & Haryana High Court.



Additional Solicitor General P P Malhotra, appearing for the CBI, submitted that Sharma was acquitted by the High Court despite the trial court holding him guilty of demanding and accepting a bribe of Rs 10,000 from an IT assessee. He was earlier sentenced to one year RI by the trial court.



In a sarcastic vein, the Bench said "why not government legalise corruption so that a specific amount is fixed for every case. Let us say if a man wants his case to be settled, he can be asked to pay Rs 2,500. That way every individual will know how much bribe he has to pay. There is no need for any bargaining by the official and the people will also know beforehand how much they have to pay without any worry."



"Poor Government officials, we can't blame them also because of the growing inflation,"
the Bench said.



Sharma, who appeared in person, denied the allegation and said he was innocent and had been falsely implicated.



The Bench was not impressed with the argument and reiterated that corruption, particularly, was more rampant in the Income Tax, Sales Tax and Excise Departments.



The Bench then sought the views of senior counsel K K Venugopal on its suggestion to legalise corruption in the country.



However, the senior counsel said that it would be better if good moral values are imparted in every school of the country as part of their curriculum so that at least the future generation is free from the menace of corruption.

The beleaguered Government is looking for cover as the Opposition has mounted a united attack against it on the issue of corruption, demanding a Joint Parliamentary Committee (JPC) probe into scams involving the 2G spectrum, Commonwealth Games and Adarsh Housing Society. The Opposition has particularly focused its attack on Telecom minister A Raja and demanded his resignation as the CAG report has indicted him for serious irregularities in the allotment of 2G spectrum.



Not only sack, but put him behind bars.

The documents have surfaced a day after Prithviraj was sworn in chief minister and created a flutter, although such allotments to MLAs and MPs under the discretionary quota are quite common in Maharashtra.



The 64-year-old Prithviraj has taken over from Ashok Chavan, who has got embroiled in a row over allotting flats to his in-laws at Adarsh housing society, built without the environment ministry’s clearance and in violation of coastal zone regulations.



The documents have been obtained by city-based RTI activist Anil Galgali, a freelance journalist who runs an NGO and apparently has no political affiliation.



They include: a) a letter dated May 20, 2003, by then additional collector Subhash Hazare informing Prithviraj a flat had been allotted to him by Shinde under his discretionary quota for MPs; <img src='http://www.india-forum.com/forums/public/style_emoticons/<#EMO_DIR#>/cool.gif' class='bbc_emoticon' alt='B)' /> an application by Prithviraj to Maharashtra Housing and Area Development Authority for a flat; c) an affidavit by Prithviraj saying he did not own a flat or a plot in Mumbai.



In the first of the letters written by the urban development department and dated April 23, 2003, additional secretary A.B. Hazare informed Prithviraj that Shinde had okayed the allotment of a second floor flat B-1 (measuring 105.45sqm) to him at Bhakti Park housing complex at Wadala under the quota reserved for MLAs and MPs.



The letter stated the allotment had been made strictly according to eligibility criteria and asked Prithviraj to submit an application form along with necessary documents.



On May 17, 2003, Prithviraj submitted an application for a flat under the high income group scheme, mentioning his average monthly income in the past 12 months as Rs 76,000.



In an affidavit signed on May 2, 2003, he affirmed he and his family members did not own a flat or house or a plot in Mumbai, Thane, Navi Mumbai, Pune, Pimpri-Chinchwad, Khadki, Nagpur, Solapur and other cities, according to the documents.

It’s laughable that the Congress should stake claim to probity in public life. Raja's 2G Spectrum scam exposes the true face of the party and the Prime Minister



Now that the Comptroller and Auditor-General’s opinion on the underselling of 2G Spectrum licences by former Telecom Minister A Raja is in the public domain, we have a better idea of the price Prime Minister Manmohan Singh has made us pay just so that he may remain in office. Initially it was assumed that the fraudulent allotments had cheated the public exchequer of Rs 70,000 crore. The revised estimate is that the total loss caused by this Minister could be an unbelievable Rs 1.76 lakh crore.



This figure is truly mind-boggling because, as Ms J Jayalalithaa, the AIADMK leader, said the other day in a television interview, most citizens would find it difficult to imagine the number of zeroes that go to make this number. However, since this could well be the biggest scam indulged in by a Minister or Government official in the ‘history of humankind’, one must give it a shot. The number in question is Rs 1,7,60,00,00,00,000. That is why the continuance of Mr Raja in the Union Cabinet till last Sunday posed the most brazen challenge to the idea of accountability in our public life.

Strangely, the Prime Minister allowed Mr Raja to remain in office even as Central investigators snooped around the Minister’s offices for clues and evidence to nail him. Yet, Mr Singh and the Congress would like us to believe that they are concerned about standards in public life.



The biggest joke of course is the belated attempt by the Congress to play the probity card by taking ‘action’ against the Maharastra Chief Minister, Mr Ashok Chavan, and the Commonwealth Games Organising Committee chairman, Mr Suresh Kalmadi. The latter was forced to quit as secretary of the Congress Parliamentary Party, an inconsequential office that burdens the incumbent with the ‘onerous’ task of posting invitations to party MPs to attend a few meetings of the CPP annually.

It is said that the Prime Minister is a ‘clean’ politician whose personal conduct in financial matters is above reproach. However, this means nothing so long as he allows members of his Cabinet to merrily swindle the exchequer. Apologists for the Congress say that the compulsions of coalition politics prevented the Prime Minister from proceeding against Mr Raja.



If that be so, we are left with no option but to conclude that[size="6"] Mr Singh’s desire to survive in office far outweighs his concern for probity in public life. He seems to have just three priorities: Survival in office, protecting the Congress’s interests and ensuring that the United Progressive Alliance remains intact.[/size]



[size="6"]Mr Singh has already given us sufficient indication that national interest is not a priority for him [/size]when he took that untenable decision to appoint Mr Thomas as the Chief Vigilance Commissioner. That is why one must turn to the most credible of our institutions — the Supreme Court — to set matters rights. ...
