In an unprecedented order, the Election Commission (EC) tonight recommended to the BJP that it should not nominate Varun Gandhi as a candidate for the Lok Sabha elections after holding him guilty of violating the Model Code of Conduct for his hate speeches against Muslims.

NEW DELHI: BJP on Sunday night virtually questioned the EC advice to the party not to nominate Varun Gandhi as its candidate after the poll body
declared Gandhi guilty of the hate speeches.

"It is an advice and we think it is not an order and we will certainly like to know from the EC that under what law has it advised us this," party spokesperson Prakash Javadekar said.

"We would like to examine the EC ruling and would come out with a structured response in a day or two," he said.

As per sources, the party is not convinced and may question the authority of the EC "to decide which candidate to be fielded in the fray".

This is the considered stand of the BJP and I am speaking as the authorised spokesman of the party," Punj added.

A short while ago, BJP's Prakash Javdekar also slammed the EC, saying it was not the EC's job to decide who should contest the polls and any action with regard to someone's candidature could be taken only by the courts.

"This is matter of code of conduct. Varun Gandhi has raised doubts on the authenticity of the CD. EC has chosen to give a judgement without any examination. It seems EC has turned into an investigating agency and a forensic laboratory...After receiving formal letter from EC, we will give a view on it at a proper time," Javdekar said.

"This is not the advisory function of the Election Commission...if somebody makes such remarks, this is not the BJP's policy or viewpoint," he added.

While asking the BJP not to field Varun, EC on Sunday said, "Any such move would be perceived as endorsing his unpardonable acts of inciting violence and creating feelings of enmity and hatred between different classes of citizens of India, destroying the social, democratic and plural fabric of the country, as enshrined in the Constitution of India."

Saying it was unconvinced by Varun's explanation, the EC termed his reply a recourse to "wriggle out of the situation which he has created by making inflammatory and highly derogatory speeches".

Earlier today, Balbir Punj also suggested that strained relations between Sonia Gandhi and Maneka Gandhi were another reason for the Election Commission's decision. "There are candidates with criminal charges in other parties also. Sanjay Dutt of SP, who was indicted by the TADA court, and Jagdish Tytler and Sajjan Kumar of Congress, who are facing charges in connection with anti-Sikh riots. Why has an exception been made only to Varun Gandhi?"

Punj told reporters that "the world knows about the strained relationship between Sonia Gandhi and Maneka Gandhi (Varun's mother).

"We also know about the proximity of the CEC-designate Navin Chawla with Congress and its leadership. I would not like to comment anything on it."

Meanwhile, the EC has denied being biased in the Varun Gandhi hate speech case. Reacting to the BJP's accusations that the EC has been biased, sources have said that the Election Commission has defended itself saying it will contest any cases brought against it in the Varun Gandhi alleged hate speech case.

Krishnamurthy, who has undertaken a detailed study of election laws for 60 years, explained that the Election Commission is authorized to take action under the model code of conduct only against a candidate and a political party recognized by it.

<b>"As of now Varun is only a probable candidate and an ordinary citizen against whom action can be taken only under the IPC if he makes inflammatory statements. The Election Commission has no role to play till the notification of elections by the president,"</b> said Krishnamurthy, whose tenure as election commissioner (1994-99) was controversial.

The Representation of Peoples Act, according to Krishnamurthy, categorically provides in eight paragraphs guidelines to the commission on the implementation of the model code of conduct.

"Action under the model code of conduct can be taken in the conduct of a political party registered with the Election Commission and candidates, at public meetings by a candidate and political party, processions by candidates and political parties, on polling day, at polling booths and election observers," he said.

Krishnamurthy says the model code of conduct can be implemented only in the case of political parties registered with it and not in the case of probable candidates.

"Probable candidates can be recognized by the commission only after the notification of elections by the president, followed by filing of nominations and its scrutiny. Once this formality is over, only then the Election Commission recognized candidates come into being. And it is only after this that the commission can take action against them for violation of the model code of conduct," he said.

Bodhiji, maybe this will force Priyanka's entry into UP in next elections. She does have Indiraji's charisma. But ofcourse, its a gamble, INC can use Priyanka-card but what if that fails ? Also if she makes entry then what about Rahul baba ?

Re EC and media, now prob the situation is, Varun being barred from contesting will infact make him even more popular. My guess is they will most likely leave it at that.

Another interesting thing about visual media is, that a photo usually gets picked that evokes certain memories.. Somehow thats supposed to trigger a certain kind of feeling, train of thought and what not. In case of Godhra-Kand for eg gujju-media picked burnt S-6 while ELM picked muslim mans photo (one that has his hands folded - forgot his name). In tiananmen-square kand, its the protestor in front of tank. In case of Varun I have seen the foll in many places.

Thank you for your support and good wishes at this difficult time. I
agree that the "recommendation" of the EC is politically motivated. It is true
that a large number of people not just indicted in the riots of 1984 but
also in the bomb blasts of Mumbai and other anti India actions have been
ignored and allowed to contest. In this case no attempt has been made to
check the veracity of the recordings or to see that no communal
reactions took place at all. It is a pity that the EC has become a tool in the
hands of the government.

Dear Varunji,
Pranam,

I would like to congratulate you for speaking out in such frank terms
recently.  You have rightly highlighted, in the subsequent, comments of
yours about the threat to the Hindus in the border states.  As you have
said temples are being attacked, etc.

You have also rightly said that had your speeches a potential for
creating communal disharmony, then surely there would have been a
law-and-order problem in the area.

It is a tragedy of those occupying the intellectual space that they will
always take up issues in a manner that the Hindus are placed in a bad
light.  Please see the enclosed article.  There is no mention of it in
any of the so-called secular press.  Furthermore, the blatant manner of
seeking votes of the Muslims in the name of Islam has been going on for
a long time.  The media actually think that this is a wonderful election
strategy, and there is an implicit authentication of the communal
strategy.

I think that you should be forthright on the issue of protection of the
Hindus, and hope that the intellectual terrorism that you are confronted
with does not in any way reduce your resolve.

(One small thing. Taslima Nasreen is no longer muslim, she is an apostate. So is Salman Rushdie - he left islam, returned and left again. As far as I know he's still in this state.)

The media-driven furore over what is being described as Mr Varun Gandhi’s ‘hate speech’ deserves to be countered with matching crudity: If he is ‘communal’, then his critics are biased against Hindus. Nothing else explains why newspapers and 24x7 news channels should twist the entire issue out of context and plaster it all over their front pages and feature it on prime time news bulletins, while ignoring the basic rule of responsible journalism — facts are sacred, opinion is free.

<b>Since the facts have been swamped by jaundiced opinion, it would be in order to place them on record.</b> Mr Varun Gandhi, son of Ms Maneka Gandhi and the late Sanjay Gandhi, is an articulate young man who will be contesting the coming Lok Sabha election from Pilibhit constituency in Uttar Pradesh as a BJP candidate. As a prelude to his election campaign — he is yet to file his nomination papers — he visited the constituency, till now represented by Ms Maneka Gandhi, for what is known as ‘jan sampark’, or mass contact, meetings to familiarise himself with the voters and vice-versa. This is a legitimate exercise. Over March 6 and 8, he addressed a series of meetings.

On March 16th, a CD mysteriously surfaced in the offices of news channels, which was promptly aired without any effort being made to verify the authenticity of its contents. The CD contained audio-visual snippets of what Mr Gandhi is alleged to have said during a community meeting (as opposed to an ‘election rally’) at Barkheda on March 7. The aired version of the recording showed Mr Gandhi as saying:

“This is not the (Congress’s election symbol) ‘hand’, this is the hand of the ‘lotus’ (the BJP’s symbol). It will cut the throat of (derogatory reference to Muslims) after the elections… Varun Gandhi will cut… Cut that hand, cut it… cut it… Go to your villages and give the call that all Hindus must unite to save this area from becoming Pakistan… Is it not true… that if (a woman) is asked her name and she says Bimla Devi, she is told we’ll see, we’ll think (about giving Government aid), give us Rs 5,000 first… But if her name is Saira Bano or whatever begum Hukum Begum… I don't even know… These people have such scary-sounding names… Karimullah, Mazharullah… If you ever encountered them at night, you’d be scared… I have a sister… there was a pamphlet with pictures of all the candidates… so this child told me, ‘I didn't know that Osama bin Laden is contesting from your area’. I told her, ‘America couldn’t get Osama, but Varun Gandhi is going to get a lot of people after the elections’.”

There were subsequent reports in media that at an earlier public meeting, on March 6 at Dalchand, Mr Gandhi was equally ‘communal’. He was accused of telling his audience, “Agar kisi galat tatv ke aadmi ne kisi Hindu pe haath uthaaya ya Hindu’on ke upar yeh samajh key ki yeh kamzor hain, unke peechey koi nahi hai... Hindu’on ke upar haath uthaaya, main Gita ki kasam khaake kehta hoon ki main us haath ko kaat daaloong (If some wrong elements lift a hand against Hindus, or think Hindus are weak, there is nobody behind them, then I swear on the Bhagavad Gita that I will cut off that hand).” He ended his speeches with “Jai Sri Ram” and to thunderous applause.

But did Mr Gandhi really say all this? Yes, by his own admission, he did say most of it. But not quite the way it has been presented by the media, and definitely not the way the alleged recording purports it to be. <b>A simple analysis of the recording contained in the CD, which was strangely circulated after more than a week, shows that it has 17 ‘cuts’; that the sound level dips to low resolution, and there is heavy echo at the crucial point where he allegedly makes a derogatory reference to Muslims.</b> Each of the quotes have been clearly taken out of context.

As for his call that “all Hindus must unite to save this area from becoming Pakistan”, that a Hindu woman would find it difficult to get Government aid, his reference to Osama bin Laden look-alikes, his pledge to stand by Hindus against ‘galat tatv ke aadmi’, and his swearing by the Bhagavad Gita, there is really little to cavil against. ‘Secular’ State Governments have been prompt in taking their cue from Prime Minister Manmohan Singh’s ‘Muslims first’ policy. Newspapers in the forefront of the bash Varun campaign have reported how Muslim victims of last year’s flood were lavished with aid while others were left to fend for themselves. Mr Ram Vilas Paswan would address election meetings accompanied by an Osama bin Laden look-alike till the man, Maulana Meraj Khalid Noor, dumped him for Mr Lalu Prasad Yadav for reasons that do not merit elaboration. Mr Gandhi was addressing a community gathering, not an election rally; he felt the people of Barkheda and Dalchand needed to be reassured that he would protect their interests; and, he spoke the truth rather bluntly, perhaps too harshly.

Before we go into the reason why he said what he is now being pilloried for, here are two questions for you to ponder over: Are we now living in such dreadful times that we cannot mention the Bhagavad Gita in public discourse lest we be condemned as ‘communal’ by newspapers and news channels which couldn’t stop pointing out, ever so admiringly and approvingly — some would say ecstatically — that Mr Barack Hussein Obama took his oath of office by placing his left hand on Abraham Lincoln’s Bible? Anybody who has any knowledge of Pilibhit knows that Hindus in that district — in fact, all over what is referred to as <b>Rohilkhand</b> — are increasingly feeling under siege. The district stretches along India’s border with Nepal. Mirza Dilshad Beg, the Nepali politician who fronted for Dawood Ibrahim and was on the payroll of Pakistan’s ISI, regularly used the Pilibhit route to funnel fake currency into India and supply arms and explosives to terrorists. Beg may be dead, murdered by his ilk in 1998, but the supply chain remains undisrupted. Thousands of cows are smuggled across the border to be slaughtered; cow slaughter in Pilibhit and adjacent districts is now a common phenomenon with the administration loath to take any action.

In recent months, there have been instances of Hindu women being molested and raped. This point has been disputed by the Indian Express which says there are no police records to prove it. Yet, on umpteen occasions the newspaper has, as have others, pointed out how the police in rural India refuse to register cases of rape, how families are terrorised into not pressing charges, and how the fear of social stigma forces victims of rape and their families to keep silent.

<b>The ‘secular’ media hasn’t heard of Sonu Kashyap who was murdered on October 21 last year. “Five unidentified Muslims” were accused of murdering him. The administration did nothing. On October 23, anger turned into street protests, led by a former BJP legislator and Minister, Mr Ram Saran Verma. He was promptly arrested and since then has been detained under the National Security Act. Beesalpur police station in-charge Pervez Miyan brazenly defends the continued detention of Mr Verma.</b>

The Indian Express, however, is not alone. The Times of India’s online edition had two ads promoting itimes, its social networking group: ‘Snub Varun Gandhi’ and ‘Join Sanjay Dutt fan club’. It would appear that in this wondrous land of ours, where rules are being increasingly set by a dissolute media, it is now politically correct to be a fan of a man who has been held guilty of aiding the terrorists who bombed Mumbai in 1993. NDTV began by referring to Mr Gandhi’s “speech”, and then switched over to “hate speech”. Who’s to tell our ‘secular’ media it is horribly wrong? Sed quis custodiet ipsos custodes?

Kancchan Gupta has rightly placed the actual context of the remarks that Varun Gandhi made. This context needs to be underscored again and again and the concerned media duly punished by the Election Commission for propogandizing and profiting from the unfortunate event. Nevertheless, we in Nepal pray for a BJP victory and,thereafter, the restoration of the secular Hindu Kingdom of Nepal through a national rereferundum.

It is a very thoughtful and timely article. I heard from several domestic workers from different non-Hindu dominated rural areas in W. Bengal that Durga Puja and similar other celebrations are highly restricted in their villages because of fear of reprisal. Some of the incidents in Pilibhit, as mentioned by Mr. Gupta, add credibility to the descriptions I heard from these workers.

On the role of the media, one wonders, quite often, whether words like objectivity and subjectivity are adequate to describe their views vis-à-vis Hindus and Hindu organisations - ‘bigoted’ would be more apt. <b>To quote two recent examples, in separate, nationally televised programmes, media persons Praveen Swami of the Hindu and Harinder Baweja of the Tehelka proclaimed that if they were Muslims they would take to guns making even Kamal Farooqui, the secretary of the MPLB squirm.</b>

The Control of media in India by thugs paid by foreign powers who want eventual destruction of India ,is complete. It is a tragedy that the super rich like the Ambanis,the Mittals & the Murthys & Premjis of India have not launched a public supported TV channel with bulk coming from them to counter the anti-national TV channels controlled by foriegn powers who can not tolerate the rise of India.They will one day realise that doing nothing will eventually destroy them along with thier nation.

The anti-Hindu media, under the mask of secular is trying hard to intimidate hindus not to say they are hindus and refer or quote any of their dharma sastras anywhere. In one of the news website,you can't use the words Hindu or dharma in the feedback. They have blocked words like Hindu, Dharma etc. You need to write Hinnndu, or dhaaarma. This reflect their cowardice and frustation. More they bash hindus, more they abuse hindu sastras, more these sick media will isolate themslves from the hindu society.

Note that such CDs are regularly pumped into the State of Gujarat (or other BJP ruled States) to dethrone Mr. Modi during elections, whether it is from Tehelka, phone CD from Mukul Sinha, or Lalu.s investigation of Godhra riot. Judging from the unchecked spate of terrorist attacks on large metropolis like Mumbai, Delhi, Ahmedabad, Bengaluru, Jaipur, Varanasi, etc., in which the Hindus incurred the maximum financial damage and the huge loss of lives, there is a widespread feeling that the Hindu Nation is in a 'State of Siege' in its own country.

Despite the bitter condemnation from the English language press, Varun Gandhi is being lauded all over India in the vernacular media. We suspect the slanderous crusade against Varun Gandhi is backed by certain anti-national elements for the sole purpose of demoralizing and demonizing this young would-be MP.

It is worth noting that at the moment Hindu Nation is neck deep into an unprecedented crisis because of the double whammy of Islamic jihad on one hand and the pseudo-secular Congress Party politicians protecting even the high profile terrorists like Mohammad Afzal Guru, the convicted mastermind of Parliament attack, on the other.

It is not hard to look around and see that most Hindus have already been religiously cleansed from the neighboring Pakistan; they have been either converted to Islam or simply killed. The same thing is fast happening to the Bangladesh and Kashmir Valley.

In many other parts of India, Hindus are under attack from the Jihadists in collusion with the Maoists, Naxalites or other Marxist terrorists. (The recent murders of Swami Lakshmananda Sarasvati in Orissa and other prominent Hindus in Kerala are the gruesome reminders of this deadly combination) .

We have to understand that Varun Gandhi's Pilibhit Parliamentary constituency is up North near the Nepal border. Thousands of Muslim mosques and madrasas have sprung up in the area. An extreme fear psychosis is created by Jihadi forces in the region. Several young Hindu girls have been molested and raped in recent times. Cow slaughter is going on recklessly on the streets in open.

In the conditions, Hindus find themselves very unsafe.

They feel persecuted.

The local Hindu population is in a state of shock and bewilderment.

All the above things are, obviously, happening under the very nose of young and vigilant Varun Gandhi. Instead of attacking him thoughtlessly, his speech describing the Muslim terrorist activities in the area should, on the contrary, be analyzed from the national security point of view.

We do not see anything wrong with Varun Gandhi's statement. Actually, his assertion that " I am a proud Hindu, I am a Gandhi and I am an Indian " should come as a breath of fresh air for all Indians in the suffocating pseudo-secular politics of India.

We look upon Varun Gandhi as valiantly fighting like Veer Abhimanyu, the brave son of legendary Arjun of Mahabharatha. Our modern Abhimanyu has been encircled in a chakraviyuh (the deadly maze) and is being viciously attacked by Kauravas. The role of modern Kauravas is played by an unholy combination of the pseudo-secular politicians of country led by Congress party and other anti-national elements directly or indirectly shielded by this Grand Old Party of India.

As such, we appeal to the Non-Resident Indians in general, and the Indian public in particular, to solidly stand behind Varun Gandhi, the gutsy young leader of the modern India.

It is essential that patriotic Indians provide this dynamic Gandhi all necessary support by sending him congratulatory emails at gandhim@sansad. nic.in.

RajeshJi, the only woman in UP that has charisma is already the Chief Minister wanting now to become Prime Minister.

Priyanka or no Priyanka, congress can win no more than 4-5 seats in UP on their own.

Likewise, sans-Yogi/Modi-like Hindutva, BJP can win no more than 10-12 seats in UP, plus Ajit singh's 4-5.

Best bet for NDA/BJP, if they seriously want to avoid another Anti-Hindu govt in center, is to go in for an understanding with Mayawati. That would sweep the whole state with all its 80 seats in favour of the alliance. Their voters are very much transferable to each other and in common, unlike the other combinations. The sacrifice BJP will have to of course make is the PM-ship to the daughter of the dalit, or something of that sort. A sweep in UP will ensure a comfortable NDA+BSP at center. Lack of pre-poll alliance will ensure division of votes and some leakage of seats (about 20-25) to Amar Singh. To co-opt mA-yA, "who-is-not", should not be a bad idea for Hindus at all, IMHO etc.

Bodhiji, Embracing Mayawati is like embracing Dhritrashtra. Also you are absolutely right about INC's chances for this round. But the gandhi pariwar's charisma is what binds INC and makes them a national level party. Without that charisma or rather a potential for charisma INC is like third front.

Many things about Indian democracy are not as complicated as they seem. For all the maddening diversities of our country -- regional, social, economic and political -- there is something which can be called the "collective mind of the nation", at work in any Lok Sabha election.
For example, there is a simple rule that governs whether an incumbent government wins or loses its bid for a renewed mandate. If the people are happy with its performance, it wins. If they are not, it loses -- except when there is no other viable alternative. Apply this test to the Congress party's bid to win a second term, and you will see that it does not have the ghost of a chance to return to power.

They ran that clip only once or twice. He said nothing like "against the Sikh community". He was referring to a Sikh candidate who is going to contest from Pilibhit, and said that the fellow was an agent of Muslims only contesting to divide the Hindu votes. Although what maybe offending to BJP ears, he said he didn't want Muslim votes, asked Muslims to never vote for him.
