The BJP is keeping open the option of moving the Supreme Court after President Pratibha Patil assented to the Government's recommendation of not removing Election Commissioner Navin Chawla.
The BJP sources pointed out that the matter should not be considered 'closed' after the President's decision and that they may move the SC against continuation of a biased member in the Election Commission. More so, he would take over as the CEC after Gopalaswami retires on April 20. However, the timing of such a move is still not clear.
<b>The BJP maintained that the President's decision may affect the "impartiality" and "independence" of the Election Commission as she has only acted upon the advice of the Government because Law Minister HR Bharadwaj has already declared that the Chief Election Commissioner had no such power (for recommending Chawla's removal). </b>
