PATNA: Lessons on Bihar CM Nitish Kumar's susha-san (good governance) and denouncing the Rabri-Lalu regime's so-called kushasan (misrule) at a government secondary school in Vaishali district has drawn strong protests from the RJD.
G A High School in Vaishali is in the centre of the controversy because its teachers are giving lessons on "achievements of Nitish Kumar's government in one-year".
The students chant sentences, which would make RJD's former ministers furious. "Previously, ministers of the RJD government did not go to office. But the ministers spend 12 hours in their offices.
Kidnappers used to have direct contact with ministers then...," the school children say in unison, adding that the Lalu-Rabri regime was marked by corruption, lawlessness and inefficiency.
RJD chief Lalu Prasad is not amused. "Some teachers want to keep Nitish government in good humour.
My party will find out those teachers and arrange their 'abhinandan' (felicitation)," he said, adding how could teachers go beyond the topics prescribed in the syllabus. The railway minister said he would throw such teachers out when he returned to power.
However, the school's headmaster, Phul Md Ansari, justified the "new subject", maintaining that it was to create awareness about achievements of the Nitish government.

Out-of-school children highest among Muslims in India: Survey

In urban areas, the figures for boys and girls are similar while in rural areas, it is 6.8 percent for boys and 9.1 percent for girls.
Among the various sections, <b>Muslims top the list with 10 percent followed by 9.5 percent for Schedule Tribes, 8.2 percent for Scheduled Castes and 6.9 percent for Other Backward Castes. </b>
<span style='font-size:14pt;line-height:100%'>Statewise, Bihar has 17 percent (3.2 million) of the children out of school </span>followed by 10.9 percent in Jharkhand, 8.9 percent in Assam, 8.7 percent in West Bengal, 8.6 percent in Madhya Pradesh, 8.2 percent in Uttar Pradesh and 6.9 percent in Rajasthan.

In a rare gesture, <b>senior IPS officer Shankar M Bidari has donated Rs 50 lakh out of the reward money he received for the anti-Veerappan operation to a school in memory of former State Additional Chief Secretary NA Muthanna, one of the toughest IAS officers of the Karnataka cadre.</b>
Of the Rs 1.6 crore cash reward given to Bidri by the State Government, Rs 50 lakh was donated to Karnataka State Police Children's Residential School at Dharwad, renamed by the State Government as NA Muthanna Memorial Police Children's Residential School. Bidri, presently Additional Director General of Police (Law & Order), headed the Special Task Force against forest brigand Veerappan during 1993-1996. It was during Bidri's tenure as the STF chief the backbone of Veerappan's gang was broken and the number of the brigand's associates were reduced from over 100 to a mere half a dozen. Asked what made him donate such a large amount to the school in memory of Muthanna, Bidri told The Pioneer<b>: "As Principal Home Secretary, Muthanna gave support and inspiration for the STF team. When several allegations were made against the STF during the operations, it was Muthanna who backed the team and provided moral courage. Being the son of a police officer himself, Muthanna was an upright and straight-forward officer." </b>
<b>After retaining Rs 25 lakh for himself, Bidri has decided to donate the rest of the amount to various organisations. The former STF chief will also be donating gold swords to Chamundeshwari temple in Mysore, Sri Bannariamman temple in Sathyamangala taluk and one gold trident to Sri Malai Mahadeshwara temple in MM Hills.</b>
<b>Interestingly, many police personnel used to worship in these temples before going on anti-Veerappan operation. A sum of Rs 10 lakh is being donating to Basappa Memorial Hospital at Mysore, where the injured police personnel were being treated.</b>
Bidri's daughter Vijaya-lakshmi stood first in the all-India civil services examination a few years ago and she is presently the Collector of Sindhdurg district in Maharashtra and his son is an IPS officer in Rajasthan.

The Supreme Court on Wednesday closed escape routes for politicians and bureaucrats indulging in corruption and crimes. In a landmark judgment, the Court held that sanction to prosecute any public servant for an offence will not be required if it is established that the alleged act was for his/her personal gain having no bearing whatsoever with discharge of his official duty.
<b>The immediate fallout of the Court's verdict will be on RJD chief and Railway Minister Lalu Prasad and his wife Rabri Devi against whom a CBI trial court in Bihar is set to pronounce a decision on December 18 in a disproportionate asset case</b>. The Central Bureau of Investigation had lodged an assets case against the duo when he was the Bihar Chief Minister. Necessary sanction was then obtained from the Governor. But while framing of charge-sheet he became Member of Parliament and on this ground he demanded that fresh sanction be obtained from the Speaker of the Lok Sabha, of which he is a member. By this judgment, the prosecution has breathed a sigh of relief since this was the last opportunity for Lalu to block a final decision in the case.Â
<b>At the receiving end are also the likes of former Punjab Chief Minister Parkash Singh Badal, Punjab Deputy Chief Minister Rajinder Kaur Bhattal and former Kerala Chief Minister K Karunakaran, all who are facing trial for allegations of criminal misconduct.</b>
The Bench of Justices Arijit Pasayat and SH Kapadia, while dismissing the appeals of the above petitioners (except Karunakaran) held that no sanction required for prosecuting a public servant in cases he is accused of charges framed under IPC. This would mean a public servant including politicians and bureaucrats, who indulge in corruption or crime, covered under the provisions of IPC could now be prosecuted without any permission from any authority.
Only if they had committed the offence in discharge of their official duty a sanction prosecution could be needed. For example, if a police officer exceeded his power in dealing with a situation, he could be prosecuted only with due sanction.
Taking note of the "extended protection" argument put forth by petitioners, the Bench said, "The plea is clearly untenable as Section 19(1) of the PC Act is time and offence related."
Under this section, the police/investigating agency has to obtain sanction prior to registration of case against the public servant.
<span style='font-size:14pt;line-height:100%'>"This protection has certain limits and is available only when the alleged act done by the public servant is reasonably connected with the discharge of his official duty and is not merely a cloak for doing the objectionable act."</span>
For determining whether the act was done as part of official duty, the Bench noted that <b>there is a bar within Section 197 on the courts to take cognisance of such offences at the institution of the complaint. It held that the purpose of sanction under Section 197 was necessary to shield honest public servants from being harassed in discharge of their official duty. But this cannot be afforded as a protective cover to shield public servants who indulge in acts "performed under the colour of authority but which in reality are for the public servant's own pleasure or benefit."
"The offence of cheating under section 420 or for that matter offences relatable to Section 467, 468, 471 (relating to forgery) and 120 B (criminal conspiracy) can by no stretch of imagination by their very nature be regarded as having been committed by any public servant while acting or purporting to act in discharge of official duty. In such case, official status only provides an opportunity for commission of the offence" </b>the Bench observed.
However, the judgment did not clarify whether existing CVC provisions requiring sanction for officer above joint secretary level at the time of registration of case is still mandatory.
<b>Prakash Singh Badal who along with his son Sukhbir and wife who too were accused of amassing crores of rupees of disproportionate assets had relied on the question of sanction which was unacceptable to court</b>. In his case, the court noted that voluminous documents supported the allegations leveled by the complainant against him. In this backdrop, his plea stating that the complaint being filed by his political rival smacked of malafide cannot be accepted since the charge sheet is recorded based on the material placed before court.
Though in the case of Karunakaran, the court made an exception directing the High Court of Kerala to re-consider his plea of malafide within a period of three months. The court pointed a November 24, 2005 affidavit by Chief secretary in the state stating to withdraw the case against the former CM in the Pamolein scam pending trial in Kerala. With the new government in place headed by rival Chief Minister VS Achuthanandan, the government moved a subsequent affidavit stating no such move is afoot. This action aspect was not before the High Court when the matter was heard and hence was directed for reverted back by the Apex Bench.

<b>Bihar, Uttar Pradesh, Jharkhand and Madhya Pradesh comprise 28 per cent of all MPs but account for over 50 per cent of MPs with high penalty criminal cases. </b>
"A larger proportion of the <b>less educated MPs have criminal cases against them (compared to) colleagues with higher education. </b>Whether there is any causal connection between education, assets and criminality is not clear. <b>Criminal cases are also found to be more among MPs in the age group 36-45,"</b> the study says.
In addition, it found that there are no criminal cases registered against 83 per cent of Congress and 80 percent of BJP MPs.
The <b>Rashtriya Janata Dal (RJD)</b> leads in the proportion of criminal cases <b>(43.5 per cent</b>).
In respect of criminal cases with severe penalties (five or more years' imprisonment), <b>RJD tops the list with 34.8 per cent of MPs, BSP with 27.8 per cent and Samajwadi Party with 19.4 per cent</b>.

If there is one thing that Railway Minister <b>Lalu Prasad Yadav</b> is more proud of than his political achievements, it is his nine children, who he likes to point out are all <b>ââfair and goodlooking, by the grace of Godââ</b>. At daughter Chandaâs Haldi Kailash and Mehendi, all seven daughters were turned out in sparkling lehngas each prettier than the next. The two teenaged sons Tej Pratap and Tejashwi are handsome, personable boys. The latter is a talented cricketer and is in the Delhi juniors team. No one in the family seems very fond of studiesâChanda dropped out of Pune Law college and, according to a former classmate, the five younger girls when at a boarding school in Ranchi were known as the ââflunkey quintetââ.
There was a mix of sophisticated Delhi and traditional Bihar at the festivities. The very elegant gold invitation read Lalu Prasad without the Yadav. A jovial Lalu playfully smeared colour on the guests. There was even a nughty dance number with the professional troupe togged out in bikini tops, brief shorts and frilly capes.

Not if CBI refuses to give up
Given the consequences had he and his wife been found guilty in the disproportionate assets case - for starters they would have gone to jail and his berth in the Cabinet would have gone - it is only natural that Union Railway Minister Lalu Prasad Yadav should exult over Monday's acquittal by a special CBI court. Ever since the disproportionate assets case was registered against Mr Yadav and his wife in August 1998, with the CBI accusing them of amassing wealth beyond their known sources of income, the former first couple of Bihar had been understandably worried about the outcome. Had Monday's judgement gone against Mr Yadav, then it would have indicated the possible outcome of the trial in the six fodder scam cases in which he is a prime accused.<b> For, the disproportionate assets case flows from the fodder scam in which Bihar's treasuries were looted of Rs 900 crore by corrupt politicians and bureaucrats. However, it would be incorrect to presume that Monday's judgement is necessarily a precursor to Mr Yadav's acquittal in other cases; the wheels of justice, we should remember, have a tendency to grind slowly, but grind finer</b>. Mr Yadav and his supporters, including those in the Congress, would do well to bear in mind that the last word has not been heard on the fodder scam cases. Moreover, there are umpteen examples of trial court judgements being overturned by higher courts. While the reasons why the judge came to a conclusion that cannot but have left a large number of people aghast are yet to be made public, it is entirely possible that the prosecution, after taking up the issue with great fervour, did not pursue the case with desirable diligence. With Mr Yadav resorting to every possible means to scuttle the case, and thus ensuring that it is dragged out over eight long years, a certain fatigue factor was bound to have set in. In any event, the CBI is not unknown for losing steam midstream, the reasons for which do not merit elaboration. <b>We have seen this happen in the past when high profile cases of corruption being prosecuted by the CBI were allowed to collapse in the most brazen manner.</b>
In its response to Monday's judgement, <b>the CBI has indicated that it may file an appeal in the Patna High Court, but has been cautious to add two riders: First, it will study the full judgement to see if it can be contested; and, second, the authority to decide whether or not to file an appeal is vested in the Government of the day. What this means is that the CBI could on its own decide that it does not have any grounds to appeal against the judgement acquitting Mr Yadav. And, even if it were to feel otherwise, the appeal is dependent on political clearance. </b>Such being the system, it makes little sense to berate cynics who insist that corruption shall continue to flourish in the absence of corrupt politicians getting their just desserts. Yet, cynicism cannot be allowed to overwhelm faith in the judiciary which stands like a wall between hope and despair. <b>Those who believe the law of the land can be subverted for personal aggrandisement and to escape punishment for criminal offences sooner or later find themselves running out of luck. </b>Meanwhile, the prosecution, namely the CBI, would be well-advised to revisit its conduct during the trial in the disproportionate assets case and, at least for the sake of the institution's image, challenge Monday's judgement with renewed vigour and determination.
