Dear Colleagues:
It will give you pleasure to know that the <b>Complaint filed by Indian National Overseas Congress at the instance of Indian National Congress headed by Mrs. Sonia Gandhi, against Satya Dosapati, Naresh Sharma, Mahatma Gandhi Center and Hindu Temple, International Foundation, Inc., Sunanda Thali, Hindu International Concil Against Defamation, Inc., and John Does 1-100, was dismissed with prejudice by Judge Nicholas J. Stroumtsos, Jr., J.S.C. on Jan. 14th, 2009</b>.
In this connection, I would like to inform you that earlier Indian National Overseas Congress had filed two cases against Narain Kataria (me), Arish Sahani, et al. in New York Court and against Satya Dosapati, Sunanda Thali, et al. in New Jersey Court in the amout of $100 million. Since the allegations were frivolous, flimsy, and had no locus standi, they were rejected. The New Jersey case was flatly dismissed and New York case was withdrawn by the Plaintiff.
The purpose behind filing these three cases against us was to muzzle our voice, make us financially bankrupt, isolate us, make an example of us and terrorize us into submission.
But the unity and solidarity displayed by NRIs have shattered the malicious designs of those who do not believe in freedom of expression and liberty of thought.
This is the third consecutive ignominious defeat suffered by Indian Natiional Overseas Congress.
We have set an unprecedented example for all the NRIs to follow. The lesson is that if we all stand up together courageously with unshakeable determination, no one, howsoever powerful he or she may be, can match our resolve and resources.
Congratulation to all of you for this brilliant victory. The credit for this goes to all of you who stood behind us like a rock.

Defence Minister A K Antony will perform all the customary duties of the Prime Minister during Republic Day on Monday, the government said on Saturday, clearing confusion over the issue.
"The Defence Minister will lay a wreath at India Gate before the Republic Day parade begins and step in for the Prime Minister in all functions related to the Republic Day." Defence Ministry spokesperson Sitanshu Kar said.
In the absence of Prime Minister Manmohan Singh who is indisposed, Antony will also receive President Pratibha Patil and Kazakhstan President Nursultan Nazarbayev, who is the Chief Guest for this year's celebrations, at Rajpath.
He will also preside over the annual NCC rally on January 28. Traditionally, the Prime Minister presides over the parade.

The Home Minster is the stand in for the PM. This has been the case since JL Nehru. Unfortunatelty this is based on tradition and not written protocol.
However after the overt nuclearization its the Raksha Mantri who holds the portfolio in case of the PM's indisposition. Again this is not written down and canges based on whims of PM and his handlers. the big mistake NDA did was not to nail this protocol down. Now its any body.

Former Haryana Deputy Chief minister Chand Mohammad (Congress Party) was on Tuesday abducted from his residence, his wife alleged though no police complaint has been filed.
Fiza alias Anuradha Bali, who along with 43-year-old Mohammad alias Chander Mohan had grabbed headlines when he converted to Islam to marry the second time, alleged that her husband was abducted by associates of his brother Kuldeep Bishnoi.
About 4-5 persons came to their residence in Sector 48 C and took away Chand Mohammad, she claimed. "The associates of my husband's brother Kuldeep Bishnoi kidnapped him," she told reporters.

A blame-game appears to have broken out between the Rashtrapati Bhawan and the Union Home Ministry over the <b>selection of a businessman for this year's Padma Shri title in the category of an artist.</b>
Hashmat Ullah Khan, who hails from Jammu and Kashmir was among the 93 Padma Shri awardees in the category of art but it was <b>later found that he was an exporter and not a craftsman.</b>
The issue came to light when mediapersons tried to trace him to have his comments on the award but were unable to locate any artist by that name.
The awardee himself said he was "surprised" to receive the call informing him about the honour.
Khan told PTI that he had a shop in Chandi Chowk in Delhi and has been working for promotion of work on Pashmina Shawls.

I'm increasingly getting the feeling that Congress has now crossed a psychological threshold, whereby they are committed to not allowing power to slip from their greedy grasp, whether by hook or by crook. They seem to have now put themselves onto a slippery slope, whereby they will use any means available to keep themselves in power at the Centre. They're on the MacBeth road.
I've been a firm supporter of the 123 Indo-US Nuclear Deal, and have posted my support for it many times on here. But I'm increasingly getting the impression that the deal has mainly been signed between the US and the Congress Party, so that control over the Centre by the Congress Party has become a basic requirement to keep the deal in place as is. Therefore it seems like Congress has been given license to turn India into a US-backed Banana Republic, like Pakistan under Musharraf, or Egypt under Hosni Mubarak.
The way things are looking today, I feel like Congress intends to give us uninterrupted One-Party Rule for the next few decades. They'll wind up giving themselves a free hand to do anything they please, as they did during the 1977 Emergency. "I am right", Chief Election Commissioner N Gopalaswami said on Sunday unfazed by the sharp criticism to his recommendation for the removal of Election Commissioner Navin Chawla for "partisan" functioning.
The CEC, whose term ends on April 20, told PTI "in my mind, I am right".
<b>Gopalaswami pointed out that while the move had been criticized by some jurists, for other leading lawyers, he was within his Constitutional right to make such a recommendation.
"It is bound to happen. Each person looks at the information he has. For some people, timing is wrong and for others it is not," the CEC said</b>.
Asked about criticism on the timing of his recommendation, barely a few months before his own retirement and the Lok Sabha polls, Gopalaswami defended it and explained that the petition came to him towards the end of January 2008.

In a decision that could have a far-reaching impact on administrative accountability, the PMO, widely seen as leading the government towards transparency has decided to withhold information related to assets of ministers and their relatives.

Significantly, the PMO had initially agreed to part with the information. But in a curious U-turn on December 17, 2008, the PMO held that details sought by the applicant were exempt from disclosure. The `no' was repeated on January 27, 2009, when Agrawal persisted with his effort.
It was last year that Agrawal had filed the RTI application seeking details of assets of Union ministers and their relatives for the last two years from cabinet secretariat. The letter was forwarded to Prime Minister's Office for necessary action.

I can boldly assert that I am the only living former civil servant who, as a Member-Secretary of the high power Committee to advise follow-up action on the report of the Emergency Excesses Inquiry Commission chaired by the former Supreme Court Chief Justice, J.C.Shah, had dealt with every aspect of the Commission's indictment of Mr. Navin Chawla, who is currently in the news for the wrong reasons.
The Chairman of the Committee, L. P. Singh, a colossus of the civil service, and its two other members, M. M. L. Hooja, one of the most outstanding personalities of the Intelligence community of the world, and D. P. Kohli, the founder and father-figure of the Central Bureau of Investigation (CBI), with all of whom I had the good fortune to work during my nine years (1961-69) in the Union Ministry of Home Affairs, were persons regarded as legends in their own life time.
As part of our mandate, even though Justice Shah himself was an eminent jurist with thoroughness as his forte, in order to make assurance doubly sure, we went into his entire report with great objectivity and an open mind to convince ourselves that his findings were duly substantiated by oral and documentary evidence.
<b>At the time of the Emergency of 1975-77, Mr. Navin Chawla was Private Secretary to the Lieutenant Governor of Delhi, Kishan Chand (who later committed suicide unable to bear the 'humiliation' following the adverse finding about him in the Shah Commission's report). According to Justice Shah, Mr. Chawla, along with his cohorts in the police at the time, "exercised enormous powers during the emergency because they had easy access to the then Prime Minister's house. Their approach to the problems of the period relating to the citizens was authoritarian and callous. They grossly misused their position and abused their powers in cynical disregard of the welfare of the citizens, and in the process rendered themselves unfit to hold any public office which demands an attitude of fair play and consideration for others. In their relish for power, they completely subverted the normal channels of command and administrative procedures.'' Shocking material</b>
<b>Mr. Chawla was also found to have exercised 'extra statutory control in jail matters', including 'the treatment of detenues'. Not confining himself to dictating to his boss as to the persons to be arrested, he also prescribed how they were to be treated in prison. For instance, he was for constructing special cells with asbestos roofs to "bake" certain prisoners. Kishan Chand pathetically admitted to Justice Shah that he was not a free agent and Mr. Chawla used to receive instructions directly from Sanjay Gandhi and he (Kishan Chand) came into the picture only to the extent that he was required to fulfil some technical formalities.</b>
Appointing a person with such a background to the Election Commission which is the fountainhead of all other institutions of democracy was itself a brazen defiance of norms of accountability and decencies of public life.<b> This is quite apart from the allegations of bounties received from the Congress Government in Rajasthan and a number of Congress MPs.by the Jaipur-based Lala Chaman Lal Education Trust established by Mr. Chawla and his wife, and the unsavoury speculation engendered by the Government of Italy conferring on him the Mazzini award in March 2005 'in recognition of his efforts to forge a new relationship with Italy and strengthening existing bonds'</b>.
Omnibus nature
Now to the orchestrated bad mouthing of the Chief Election Commissioner (CEC), Mr. R. Gopalaswamy, for sending a report to the President recommending removal of Mr.Chawla from the office of the Election Commissioner under the second proviso to clause(5) of Article 324 of the Constitution. While the first proviso stipulates that "the Chief Election Commissioner shall not be removed from his office except in like manner and on the like grounds as a Judge of the Supreme Courtâ¦", the second proviso lays down that "any other Election Commissioner or Regional Commissioner shall not be removed from office except on the recommendation of the Chief Election Commissioner".
The distinction between the authority of the CEC and other Election Commissioners is, as the Supreme Court pointed out in one of the judgments, inorder to preserve and safeguard his independence, he has to be treated differently from other members of the Election Commission.
From the omnibus nature of the wording of the proviso, it is apparent that the CEC can make such a recommendation on the basis of either information provided or received from a voter or citizens' group, including a political party, or his own judgment formed from his observation of the behaviour and conduct of Election Commissioners.
In short, he can act both suo motu and in the course of disposing of any reference made to him. In this specific case of Mr. Chawla, the CEC had had the opportunity of observing the manner of functioning of his fellow Commissioner for more than three years and also had before him the Memorandum of the Bharatiya Janata Party (BJP) and 205 MPs originally argued before the Supreme Court.
Political spectacles
While withdrawing it in 2006 in the light of the CEC's assurance in his affidavit that he already had the power under the Constitution to recommend removal of any Election Commissioner for valid reasons, the petitioners had explicitly stated that they were "independently sending a copy ⦠of the Memorandum to the Chief Election Commissioner so that he may begin to act in the matter immediately."
Simply because the CEC's report on Mr. Chawla is apt to please the BJP, some commentators have taken umbrage at Mr. Gopalaswamy's recommendation and imputed motives to him. The timing of the report has galled them as well. In recommending removal of one's own colleague from office, the CEC undertakes a grave responsibility, and it is understandable if he wanted to take as much time as possible just to be absolutely sure that he was fair and just in discharging an unpleasant public duty to uphold the sanctity of elections and bolster democratic institutions.
His approaching retirement must have brought home to him the necessity of passing on to the President a conclusion that has a direct and intimate bearing on the integrity, impartiality and independence of perhaps the most vital and sensitive Constitutional body, and that can pollute the purity of the entire electoral process. It is incumbent on mature and dispassionate analysts not to look at the CEC's report through political or ideological spectacles and import into it hidden purposes and meanings. <!--QuoteEnd--><!--QuoteEEnd-->
MR Raghavan is distinguished public servant wiht full knowlede of the facts. However he is verbose in his essay and doesnt come to the point quickly.
His point is Mr Chawla was guilty of excesses during the Emergency and was recommeded for dismissal but got re-instated by Mrs. Gandhi and is unfit to hold sucha an august post of the Election Commissoner. And this is regardless of the CEC's recommendation.
And despite this recommendation being based on BJP petition should have happened anyway.
