Amarnath Land Deal
In mid of all the celebration, martyrs and their families were not forgotten. Joyous crowds took time to again remember those who laid down their lives. People also visited their families and expressed gratitude and solidarity.

Even on the day of victory, police tried to stop the people from joining Samiti's vijay rallies.

But the enthusiasm of people was too much for them to handle. Policemen running away from crowds. (Policemen seemed happy and releived as well)

Great pictures. Jammu has shown the way to the Hindus. The minority appeasement policy started by Nehru has been decisively challenged and defeated.

Now, Hindu point of view cannot be taken for granted.

In midst of all this, Jammu leaders just gave hints of what may be in store for future. Not answering clearly, they just indicated, 'ye keval angdaai hai, aage bahut ladaai hai' (Just a battle won, much fighting ahead.) Outwardly they hoped the unity gained will be used for other positive causes, and thanked dozens of organizations that stood by the movement.

Jammu Agreement worse than May cabinet order: Noorani

Srinagar, September 1: Legal luminary A. G. Noorani's opinion about the agreement reached between Jammu and Kashmir Government and Amarnath Sangarsh Samiti of Jammu in response to a query.

1. The order is worst than the Cabinet order issued in May. That order was issued by a Cabinet, which at least had a representative character with members both from Kashmir as well as Jammu.

2. The latest order was made by the Governor who is a civil servant. He has only interacted with Jammu parties although the land is in Kashmir and affects people there.

3. There is no reference to Kashmir in this agreement.

4. Moreover, the Cabinet order of May was explicit on return of land after the yatra period. There is no mention of return of land in this agreement.

5. The Cabinet order also didn't give any exclusive rights. Even during the period of yatra one was allowed to trespass or go through the land and use for grazing or other purposes without affecting the pilgrimage.

6. Now the land will be shut for anybody for the period of yatra. It violates Article 19 (d) of Indian Constitution which gives right to move freely throughout the territory of India.

7. 'The phrase used in the Section C of the Agreement that aforesaid land shall be used according to the Board's requirements, from time to time, is most confusing.

8. While not mentioning the period of yatra, the phrase "time to time" makes one believe the land can be used anytime. This only vindicates former chief executive of the Board Arun Kumar, asserting that land will not be returned.

9. The agreement further talks about compensation to agitators in Jammu. Here also it has overlooked Kashmir. It seems they are being rewarded for agitation. No mention of any punishment for those who engaged in blockades.

10. Also in the first Cabinet order ecological concerns had been taken care off and there was an amount of punishment also mentioned in case of tampering with the ecology and environment. It has been deleted all the way. Section C clause (IX) of the agreement asks the Board to undertake "measures relating to soil conservation, land protection and preservation of ecology." But, does not specify the punishment or penalty in case of violation.

11. Section 2 of Jammu and Kashmir Forest Conservation Act 1997 clearly stipulates that for any diversion of forest land a resolution has to be adopted at the council of ministers after recommendation from forest advisory committee. Though powers of the state are vested with Governor in Jammu and Kashmir, but the Act is so clear about the power of Council of Minister in this case that it is necessary to follow the process. National Forest (Conservation) Act of 1980 also calls for advice from a committee to grant an approval under Section 2. It also stipulates punishment for those violating Section 2 of the Act.

12. Council of Ministers also cannot divert the forest land arbitrarily. They have to refer to Supreme Court judgements.

<!--QuoteBegin-->QUOTE<!--QuoteEBegin-->The supreme dominance of the Kashmir Valley and its Muslims over Jammu & Kashmir state had begun. The suppression of Jammu and the state's third region, Ladakh (predominantly Buddhist) had begun.

And the first opposition to this monopoly over the state of J&K was started more than half a century ago. Ironically, it was started by Nehru's ministerial colleague, Dr Shyama Prasad Mookerjee. <b>The Bengal tiger staked his life in his effort to (i) secure the integration of J&K with the rest of India and (ii) save the Dogras of Jammu from Sheikh Abdullah's actions that were reportedly described by a former central intelligence chief as a bid at ethnic cleansing.</b>

In a speech at Kanpur on December 29, 1952, Dr Mookerjee had made the grave charge that, "Mr Nehru and Sheikh Abdullah have jointly decided to carry on a ruthless policy of repression in Jammu." He had referred to "an impression gaining ground that with our blood and money we are carving out a virtually autonomous state for Sheikh Abdullah." Therefore, he proclaimed, "Jammu and Ladakh must be fully integrated with India according to the wishes of their people."

Dr Mookerjee categorically stated that while he did not want the partition of J&K, it had become a matter of Hobson's choice: Kashmir Valley could be made a separate state with all necessary subventions desired by the Sheikh and his advisers, but Jammu and Ladakh must not be sacrificed.

Dr Mookerjee died on June 23, 1953, under suspicious circumstances while under house arrest in an abandoned cottage on a hill outside Srinagar, with no telephone or medical facility within miles, without Nehru meeting him there even once during his 40-day detention. His soul must surely be astir now with talk gaining ground about the revived call for a separate Jammu and a separate Ladakh.
<!--QuoteEnd--><!--QuoteEEnd-->
We are paying for Nehru's blunders. These 60 odd days of struggle by people of Jammu show that
(i) they are the true followers of Gita and will not shy away from a battle for the dharma
(ii) the ideals and flame lit by Dr Mookerjee's still alive
(iii) forces of evil and intolerance have only been emboldened by the failed appeasement policies of past 60 years
(iv) Delhi (i.e., Nehru 50 years ago and his dynasty today) will sacrifice Hindus in Jammu/Kashmir/Ladhak at altar of secularism in a heart beat

There is a think-tank based on Dr Mookerjee's ideals located in Kolkota. It deserves every bit of support from every one of the billion Indians.

Lavakare continues.
<!--QuoteBegin-->QUOTE<!--QuoteEBegin-->Contrary to the allegations of the pseudo-secularists, this separatist drive and the present anger in Jammu over the Amarnath land are not based on the Hindu-Muslim divide. Instead, it is entirely based on the economic deprivation and political despotism exercised by the Abdullah clan and its kith and kin from Srinagar. The charges against the Kashmir Valley clique are many. Writing in the May 2000 issue of Voice of Jammu Kashmir magazine, J N Bhat, retired judge of the J&K high court, alleged that:

Thousands of plots carved out in the suburbs of Jammu have been allotted to Kashmiris, all the beneficiaries belonging to one particular community.
In some localities of Jammu city, water is supplied after a gap of three to four days, and not even enough of it to quench the thirst of the people. Obviously, funds got for development get misused.
In the Jammu region, the Hindu minorities of Doda and Poonch districts have been tortured and many of them have found, according to sources, conversion the only option, though they prefer death to forced conversion.

Another eminent person who has made more serious accusations is Hari Om, professor of history in Jammu University, and a member of the Indian Council of Historical Research (ICHR). In a newspaper article --- eight years ago, mind you --- the professor complains that:
Though Kashmiris constitute roughly 22 per cent of the state's total population, the delimitation mechanism cleverly devised by Sheikh Abdullah's National Conference Party in 1951 enables it to capture nearly half of the total assembly and Lok Sabha seats. The trick lies in 46 assembly segments having been created in the small Valley as against 41 segments combined in Jammu and Ladakh regions that are far bigger and more populated than the Valley. This mechanism is apparently contrary to the rules framed under the Indian Parliament's Representation of People's Act and those under the relevant State Act of 1957.
Kashmiris hold over 2,30,000 positions out of a nearly 2,40,000 positions in government and semi-government organisations in the Valley. In addition, they corner nearly 25 per cent of the jobs in the regional services of Jammu and Ladakh.
All the professional and technical institutions, universities and all the big public sector industrial units like HMT, the television, telephone and cement factories located in the Valley are the sole preserve of the Kashmiris. Besides, they manipulate for themselves more than 50 per cent of the seats in Jammu's ill-equipped and under-staffed medical and engineering college and in the Agricultural University in R S Pura. No such institution exists in Ladakh.
The Kashmiris control trade, commerce, transport and industry, and own big orchards as well as landed estates. None of them is without a house. Likewise, the per capita expenditure on woollen clothes in Kashmir is perhaps the highest in the world. Till date, no one in Kashmir has, unlike in UP, Bihar and Orissa, died either of hunger or cold.
Interestingly, yet not surprisingly, a vast majority of the Kashmiris don't pay even a single penny to the state in the form of revenue due to it. It is Jammu and Ladakh that contribute over 90 per cent to the state exchequer, but a major part of this money is spent not in the extremely backward and underdeveloped Jammu and Ladakh but in the highly prosperous and developed Kashmir Valley.
As a result of the above, professor Hari Om says, "It is Kashmiris and Kashmiris everywhere and all others in the state exist nowhere."

<!--QuoteBegin-->QUOTE<!--QuoteEBegin-->In a television debate, National Conference leader Farooq Abdullah mocked a Jammu Muslim who supported the agitation. Little does he or others realise that the Muslims of Jammu have also suffered from the stupid government policy of appeasing the separatists and kicking the nationalists. Just one example should suffice. School teachers' jobs in even remote Jammu regions go to Kashmiris from the valley. The teachers so appointed (at a good salary) are absent most of the time except on the first every month to collect their salary. The education levels among Jammu's Muslims are abysmal. In a tehsil of Mendhar in Poonch district, for example, there is not a single graduate!

This is the legacy of valley appeasement that the Jammu people revolted against.

<!--QuoteBegin-->QUOTE<!--QuoteEBegin-->Trader attempts self-immolation in Jammu and Kashmir
September 22nd, 2008 - 4:40 pm ICT by IANS -

Jammu, Sep 22 (IANS) A man attempted self-immolation in Jammu and Kashmir’s Kathua district Monday, the second day of a shutdown called by the Shri Amarnath Yatra Sangarsh Samiti over the closure of a theatre where they were to hold a function.Jawant Singh, 28, a vegetable trader in Chagwal town of Kathua, 60 km from here, poured kerosene on himself and then set himself ablaze, a police official said.

“He shouted ‘Bum, Bum Bhole’ (praise to Lord Shiva) as he set himself on fire,” an eyewitness told IANS on phone from Chagwal.

“He has sustained 80 percent burns and on the advice of doctors in the Jammu Medical College Hospital, we are air-lifting him to the Post Graduate Institute (PGI) in Chandigarh for specialised treatment. A chopper has been arranged,” the police official said.

The two-day shutdown called by the Samiti saw a partial response in the state’s winter capital Jammu. Banks, government offices and some educational institutions functioned normally.

“Some public transport also plied on the city roads and private vehicles plied normally,” an official said.

The Samiti had called for a two-day shutdown Sunday and Monday as the administration in Jammu had sealed the Abhinav theatre here. The Samiti was to have held a function at the venue Saturday to compensate the next of kin of those who were killed in the two-month long agitation for the restoration of forest land in Baltal to the Amarnath Shrine board, which manages the annual pilgrimage to the cave shrine.

Reports from neighbouring Samba district said the shutdown call met with marginal response.
