MUMBAI: Thirteen years after serial blasts killed 257 people in Mumbai, a Tada court on <b>Tuesday finally pronounced its first verdict convicting three brothers and sister-in-law of prime accused Tiger Memon, who himself is absconding</b>.
<b>Three other members of the Memon family, including his mother, another brother and another sister-in-law were let off by Judge P D Kode who gave them benefit of doubt.</b>
Arguements on the quantum of sentence will be heard by the court on Wednesday. The convicts could face imprisonment from five years to life and even death penalty, according to legal experts.
The entire area around the designated TADA court, located within Arthur Road jail premises, resembled a fortress as a large posse of security personnel were stationed outside since yesterday ahead of the verdict.
Ibrahim Mushtaq alias Tiger Memon's brothers Yakub, Essa, Yusuf and sister-in-law Rubina were found guilty of conspiracy for 13 serial blasts that rocked Mumbai on March 12 1993 which left 257 people dead and 713 injured.
Tiger Memon's brother Suleiman, mother Hanifa and and sister-in-law Rahin were acquitted by Judge P D Kode, who would be delivering the verdict in batches as a larger number -- 123 -- people, including actor Sanjay Dutt, are accused in the case.
Tiger Memon's father Abdul Razzak was also an accused but the case against him had been abated after his demise during the course of the trial.
Ninetyfour accused on bail, including Sanjay Dutt, were exempted from appearance while Rubina Memon, who was found guilty, was given time to surrender until further orders on compassionate ground as court accepted her plea that she had small children to look after.
The court said that it would summon the accused on bail as and when it was necessary for the purpose of delivering verdict.
Soon after the judge announced the verdict an angry Yakub Memon, a Chartered Accountant by profession, shouted expletives and said his family did not want any lawyer to argue on their behalf for the quantum of sentence.
<b>"We have seen that for the last thirteen years innocent people have been labelled terrorists. We do not need anyone to protect us," an enraged Yakub said. </b>
Later he moved to the dock where the other accused were sitting and his brothers were seen consoling him.
The blasts were masterminded by underworld don Dawood Ibrahim with the help of his lieutenants Tiger Memon and Mohammed Dossa, allegedly at the instance of Pakistan's intelligence agency, ISI, to avenge demolition of disputed Babri Masjid, the CBI had claimed in the chargesheet.
Dawood, Memon and Dossa are absconding accused in the list of 29. While Dawood was already abroad when the blasts occurred, Memon and Dossa fled a day before.
Memons had allowed the use of their garages to load RDX into the vehicles used for bombing thirteen crucial points in Mumbai on March 12, 1993.
Tiger Memon and his brother Yakub also arranged payment to two other members of the Memon family in NRI account in Hongkong Bank, Bandra branch, putting in the names of Ayub Memon, Rubina and Shabana Memon and Reshma Memon.
The Memons had fled to Dubai between March 12 and 13 which indicated that they had previous knowledge of the conspiracy.
The Memon family, except Tiger and brother Ayub, returned to Mumbai in 1994 and were arrested by the CBI.
The judge found Yakub guilty of conspiracy and financing the serial blasts through co-accused Mulchand Shah and the firm M/s Tejarat International owned by his brother Ayub Memon (absconding).
Yakub was also convicted for with providing tickets to the co-accused to travel to Pakistan for training in arms and ammunition. He was found guilty of possessing arms and ammunition and distributing them among co-accused besides purchasing vehicles that were used in the explosion.
Essa was found guilty of conspiracy and allowing use of his flat at Al-Husseni building in Mahim for meetings to plan the blasts and storing arms, ammunition and explosives. Yusuf and Rubina were also convicted on similar charges.
The CBI had named 199 persons as accused in the chargesheet filed in 1993 of which 94 are on bail and 29 in jail. Trial of three accused -- Abu Salem, Riyaz Siddiqui and Mustafa Dossa -- has been separated as they were arrested much later.
<b>Eleven accused died during trial while one, Riyaz Khatri jumped bail and two others -- Samajwadi Party MP Abu Asim Azmi and Amjad Mehr Baksh -- were discharged by the Supreme Court. </b>
Twenty nine accused were discharged by the apex Court earlier.
The trial commenced on June 30, 1995 and 13,000 pages of evidence was recorded during a period of six years with CBI examining 686 witnesses including two approvers who unfolded the conspiracy.
As part of the conspiracy, hand grenades were hurled at a Hindu colony in Mahim, triggering riots in the city in which several motor vehicles, shops and houses were damaged.
Hand grenades were also hurled at the airport but no damage was caused, while RDX-stuffed scooters that had failed to explode were seized from Naigaon and Dhanji Street.
The explosions occurred between 1:30 p.m. and 3:40 p.m. on a black Friday sending, shockwaves among the people across the country.
The CBI has said that a well-planned conspiracy was hatched by Dawood, Memon and Dossa in 1992 that resulted in landing of arms and RDX at Shekadhi in Raigad district on January seven, 1993 and February two, 1993.

Rahil is also understood to be a recruiting agent for LeT in Maharashtra. Investigators are probing the role of Rahil's associates - Junaid Hussain, Abdul Latif and Munna. Evidence suggests that both Munna and Rahil were seen in Malegaon before they escaped to Bangladesh.
Meanwhile, Gujarat Police on Tuesday busted a LeT sleeper cell with the arrest of four men in Ahmedabad. The police said they had recovered video <b>CDs featuring top terrorist leader Maulana Masood Azhar and footage of the 2002 sectarian violence in the State</b>.
Several documents, including literature in Urdu and the letterhead of the banned outfit, and numerous CDs used to recruit persons for LeT were seized during the arrests made on Monday and Tuesday, Deputy Commissioner of Police (Crime) Manoj Shashidhar told reporters here.
Shashidhar said the sleeper cell in Gujarat was part of a network of similar modules busted in West Bengal, Jammu and Kashmir, Hyderabad and Patna, among others.
<span style='font-size:14pt;line-height:100%'>"These arrests are significant as they are part of a pan-national network of the LeT. They were members of a sleeper cell that was prepared for any sort of attack or series of strikes,"</span> he said.
Of the four arrested men, two are from Ahmedabad, one is a senior cleric at a madarsa in Bharuch district and another hails from Kashmir. Shashidhar described Khalid Kashmiri as "a prized catch" because he is the younger brother of Aslam Kashmiri, wanted by Maharashtra Police for setting up a LeT module in Aurangabad.
<b>"This module may not have weapons with them as their main purpose was recruitment. We have information that they recruited numerous youths from Maharashtra and Gujarat and sent them across the border for terrorist training," </b>Shashidhar said.
Gujarat police has been on an alert after the Mumbai train blasts and the Malegaon blasts and intensified surveillance at all public places and also certain other places, officials said.
The State police has also found links between the militants' module in Maharashtra and modules existing in Gujarat and has been keeping an eye on certain madarsas in Bharuch, Surat and nearby places

Delhi's civic authorities said they would not carry out the sealing of illegal commercial units in residential areas on Thursday in view of the "sensitivity" of the issue even as 32 people were arrested for Wednesday's violence in which three people were killed.
"Looking at the sensitivity of the issue we are not carrying out the sealing drive today. Moreover, Delhi Police have also advised us about the same," said Parimal Rai, deputy commissioner (engineering), Municipal Corporation of Delhi (MCD).
<b>"Delhi Police said they cannot provide us with any forces today, and till we get adequate security the sealing of properties cannot continue,"</b> Rai said. He said the zonal deputy commissioners were taking stock of the ground situation.
According to MCD sources, sealing squads fear a threat to their lives and have refused to step out.
Meanwhile, 32 people have been arrested on charges of instigating violence in Seelampur in northeast Delhi during the clash between traders and police on Wednesday that witnessed largescale damage to property.
The civic authorities managed to seal only 29 shops in the 12 zones of Delhi in the wake of the widespread violence and protest by over 500 trade bodies.
Delhi Chief Minister Sheila Dikshit late on Wednesday ordered a magisterial inquiry into the violence and the subsequent police firing in Seelampur.
<b>The team will inquire into the involvement of anti-social elements in the Seelampur violence, said sources in the chief minister's office.</b>
Police are on the lookout for some Bangladeshis, who they suspect were behind the firing on the protesting crowds with country-made weapons.

Muslim League leader MC Mayin Haji, who has been reportedly indicted by the judicial commission of having prior knowledge of the second Marad carnage, denied the allegation while State BJP urged the LDF Government to order "without any delay" a CBI probe into the large scale violence in May 2003 that claimed nine lives.
National Development Front, which has also been reportedly indicted by the commission, said the media reports showed that the report was biased and did not contain any mention about the involvement of CPI(M) activists in the incident.
Muslim League leader and former Minister PK Kunhalikkutty said that his party had taken action against some of its local functionaries right when certain suspicions were aired about them. He said the Muslim League or any of its leaders had any involvement in the incident.
BJP State president PS Sreedharan Pillai said in Kozhikode, "The BJP and other Hindu organisations' repeated demand that the massacre should be probed only by a Central agency has been vindicated by the report and the Government should not waste further time in ordering such a probe."
Noting that his party was of the firm opinion that only an agency like the CBI could effectively probe into the "conspiracy angle" that led to the killings besides tracing the involvement of suspected extremist organisations, Pillai said the Crime Branch failed to probe such primary issues.
Claiming that as many as 28 Communist party activists were named as accused in the violence, he expressed fear that the CPI(M) now heading the ruling LDF, might try to protect them by misusing the official machinery.
"Stern action should be initiated against those officials who earlier tried to protect the CPI(M) volunteers responsible for the incident," he said.
"While the accused list also comprised IUML and the Muslim outfit, National Development Front volunteers "not a single activist of the BJP or RSS was stated to be involved in the attack," he added.
In the meantime, MC Mayin Haji has denied any role in the incident. He said that he would initiate legal action against the recommendations of the commission.
Haji also stated that witnesses who gave evidences before the commission had not lodged any complaints against him. Mayin Haji, the UDF candidate, was defeated by Mathai Chacko of
the CPI(M) in Thiruvambady in the last Assembly elections.
Meanwhile, NDF leader Nasiruddeen Elamaram said that media revelations showed that the report was biased and did not contain any mention about the involvement of CPI(M) activists.
"According to the chargesheet prepared by the police, as many as 40 CPI(M) activists are accused in the case. But, they are not indicted. There seems to be a deliberate attempt to free the CPI(M) from all the guilt it committed, since it is in the ruling front," he said.

THIRUVANANTHAPURAM: The police today arrested NDF terrorist Mohasin, a native of the state capital in connection with the letter bomb case. He was arrested following the seizure of a Belgium made bullet from his house yesterday. He would be produced before the court this evening. The police have come to a conclusion that Mohasin, a fire engineering student has links with the NDF as they have recovered some documents revealing the connection.

KOZHIKODE:Miscreants in Kerala seem to be perfecting the art of bomb making, from crude country bombs to letter bombs which exploded in Thiruvananthapuram the other day.
Experts say the mobile phone bombs could be the next in the series as it is very easy to convert a cell phone into a bomb. âIt already has the circuit. What is needed is only a battery and a detonator,â they say. The following are the kinds of bombs available in plenty now:
<b>COUNTRY BOMBS:</b> The prototype of all explosives experimented in Kerala. Widely used in political clashes and goonda attacks, this variety are very easy to make.
The common variety of country bomb contains substances like potassium nitrate and aluminum powder. The mixture is tightened with twines and explodes when thrown against hard surface.
There is a sub variety which is harmless as it would create only sound. This is used to scare the opponent or to disperse the public from the scene of action. The miscreants often escape under the cover of bomb explosion.
The bombs used in attacks have missiles contained in them like nails, stones, and glass pieces, which act like pellets once explosion takes place.
<b>STEEL BOMBS:</b> An improvement over country bombs. The explosive substances are packed in a steel canister and the lid is firmly sealed.
More dangerous than the ordinary country bombs as the pieces of steel canister also act as missiles. The canister used for this variety are the ones in which prasadam is served in temples.
<b>CIGARETTE BOMBS: </b>This variety was used in Malappuram to burn many cinema halls. A simple device in which a lit cigarette trigger the explosion. The use of this bomb has been limited to Malappuram.
<b>PIPE BOMBS:</b> A more powerful variety in which explosives like gelignite sticks are used. A detonator is fixed with gelignite mixture and the substance is kept in a PVC pipe. It explodes when the detonator is activated.
Hundreds of this variety of bombs were recovered from the Koomankallu bridge near Kadalundi in 1996. Similar types of bombs were unearthed at Narath near Kannur around three months ago.
<b>PEPSI BOMBS:</b> This kind of bombs was spotted from Marad after the killings in 2003. Pepsi tins were filled with gelignite and a detonator were found attached. The impact of the bomb is not known as these were not used in any other attacks.
<b>PEN BOMB:</b> An object shaped like a pen exploded at a hotel near Koyilandi a few years ago.
The object was kept on the table and it exploded when some one tried to open it. The substances went into the making the bomb is not known.
<b>TORCH BOMB:</b> This was a new variety of explosive, which went off in a library at Aroor near Nadapuram early this year. Sources say it contained only detonator and no explosive material. A person was injured, when he tried to switch on the torch he found in the library.
<b>BOMBS WITH TIMER: </b>The two bombs which went off at the KSRTC and the private bus stand in Kozhikode on March 2, 2006 where operated with a timer device. Timers were attached to the explosives to trigger the explosion in time.
<b>LETTER BOMBS:</b> The ones, which exploded in post offices in Thiruvananthapuram the other day.

<b>A TADA court on Tuesday held three fishermen guilty under the Customs Act for providing their trawlers to Tiger Memon and his men to smuggle arms and RDX, which were used in the 1993 serial blasts.</b>
The court acquitted two others accused of mobilising support and funds for the conspiracy due to lack of evidence.
<b>Yeshwant Bhoinkar, Abbas Dawood Shaikhdare and Shahjahan Shaikhdare, fishermen from Raigad district, had given trawlers to Tiger and his men to ferry arms and RDX to Shekhadi coast.</b>
The three were absolved of charges under the TADA Act as they did not have knowledge of the contents of the smuggled consignment. But Judge PD Kode held them guilty under the Customs Act for assisting in the landing of a consignment at a place where there was no customs port. The three aged men face a maximum punishment of imprisonment up to five years.
The confession of co-accused Harba Khopatkar, who died during the trial, was accepted by the judge as evidence against the three. Though not initially charged for an offence under the Customs Act, Judge Kode took recourse to a section under TADA, which empowers the court to convict an accused for an offence revealed during investigation.
<b>The court acquitted two others, Moinuddin Abdul Kader Cheruvattam and Ismail Abbas Patel, for lack of evidence. Cheruvattam was charged with participation in conspiratorial meetings in Dubai, helping absconding accused Tahir Taklya in collecting funds for the conspiracy and distributing video cassettes as propaganda material in Dubai to gain support and garner funds</b>.
Patel was charged of arranging finance for co-accused Shaikh Aziz Ahmed for his travel to Pakistan via Dubai for arms training and being part of the blasts conspiracy. The judge discarded the confession made by Cheruvattam and Patel and found no evidence to corroborate the charges.Â

The arrest of personnel of Army Group Insurance (AGI) Directorate by the <b>Special Cell of Delhi Police last week has revealed that Pakistan may be in possession of vital information regarding the "nature of the troops" deployed in the border areas and also those involved in the CI (counter-insurgency) operations in Jammu and Kashmir.</b>
Anil Kumar Dubey, a havaldar with the Army Group Insurance Directorate was arrested while passing information to an ISI functionary posted at the Pakistan High Commission. The ISI functionary was a driver in the Pakistan High Commission. The duo was arrested on Friday last near Mahipal Pur chowk.
Sources in the intelligence agencies said Dubey as a data entry operator had access to the location of particular officers posted to particular places as he dealt with the salary of the officers. <b>"The information provided by Dubey could be very damaging as there are units deployed in the Valley, which draw from different arms. The background profile of an officer leading say a particular Rashtriya Rifles unit could give insight into the tactical profile of that unit," </b>said the intelligence source, adding that such information could be used to advantage by subversives.
According to the Special Cell, Anil was being paid to pass on information about the Indian Army to Mohammed Farooq. Police added that they had no information so far about any links between Ritesh and Dubey.
The Pakistani driver, Mohammad Farooq, was detained and interrogated before being handed over to the High Commission after completing legal formalities.
