Dilavar Saiyad, a resident of Naroda Patiya, told the SIT about rioting on February 28, 2002. “I saw Maya Kodnani, MLA from Naroda constituency parking her Maruti car. I saw Maya Kodnani opening the door of the car and taking out hockey sticks and other weapons and handing over the same to three persons. I saw Bipin Panchal (one of the arrested accused in the case) carrying a sword given to him by Maya Kodnani. Immediately thereafter a huge mob of more than a thousand persons came near her car and Maya Kodnani took leadership of the mob.”

Saiyad and two others — Nanumiyan Malek and Imtiaz Qureshi — have told the high court (HT has copies of their applications) that they are witnesses in the two cases, in which both the leaders (Kodnani and VHP leader Jaideep Patel) are facing arrest, and that the SIT has recorded their statements. And therefore they “would like to make detailed submissions opposing the release” of the accused leaders on bail.

Labels come easy and crisp in Gujarat. Pro-Modi. Anti-Modi. For the rest
of the world, you are either with him or against him. Which is why when
it comes to the Muslims of Gujarat, and the Muslim victims of the 2002
riots, it is best to stick to the safe story: Muslims live in mortal
fear in Gujarat and non-governmental organisations have given a new life
to riot victims.

Or, I could tell you the truth - how many in the media and many NGOs want to keep Gujarat's Muslims refrigerated as 'victims' for all foreseeable times to come - even if those in the community don't want to be seen as victims, even if it works against them, and even if they want to unshackle themselves and get on with their lives for their future.

How else does one explain the media's complete inability - or
reluctance - to describe Gujarat's Muslims in no way other than whiners?
How can they not see and write about Gujaratis like the maulana I met
who bought an apartment from his stock market earnings, the Muslims
running English-medium schools in the ghettos, the stock broker who lost
everything in the riots and went on to pioneer Islamic finance in India,
the riot survivors now writing TOEFL exams and getting ready to go over
seas to study? Or the sprawling Jamiat Ulema-e-Hind school for riot and
earth- quake orphans - Hindus and Muslims -in remote Kutch that has
changed hundreds of lives?

<b>Or how they ignore simple facts: Muslims in Gujarat have a literacy rate
of 73 per cent, more than Muslims anywhere, and more than the national
average. Gujarat's 45 lakh Muslims - just over 9 per cent of the state's
population - fare better than the national average for all religions on
several counts including sex ratio and work participation. Yes, Muslims
and Hindus don't get homes in each other's neighbourhoods. There is
actually a law in Gujarat that bans such sales in several places. Yes,
Muslims do feel discriminated against in many areas. But they are doing
all this despite all that. Modi or no Modi, Gujarat's Muslims are armed
with the supreme weapon that every Gujarati is armed with: their
centuries-old entrepreneurial spirit. No amount of imposed victimhood
can take that away.
</b>
Yet, there is a deep and astounding disconnect between what we in the
media believe the condition of Gujarat's Muslims to be and what it
actually is. And maybe there is a lesson in that. Still, the image of
Gujarat's Muslims as perceived outside Gujarat and outside India is one
we have created and nurtured: that they are helpless victims, no better
than second-class citizens.

Then there are the NGOs. Many of these organisations took money from the
riot victims before letting them live there. In Godhra, for example, a
two-room set with plastered walls took about Rs 33,000 to build, and the
families paid Rs 20,000 each for them. They begged and borrowed from
friends and family members, scrounged and somehow put together the
amounts. That doesn't sound like relief to me. It sounds like a
subsidised real estate deal.

Worse, these families don't even own these two-room sets. The properties
have not been transferred in their names and they are technically
illegal squatters. The head of the Islamic Relief Committee, which
supervised these constructions, told me that this was done "so that the
riot victims don't sell those homes... that sort of thing happens here".
And that money was taken from them "so that they know that everything
does not come free".

Then there's the place that provoked the National Commission of
Minorities to state, "If there is hell under the sun, it is here."
Citizen Nagar, a neighbourhood in Ahmedabad, is where Muslim riot
victims live next to the city's largest garbage dump, where sewage flows
through their lanes in the monsoons and they battle disease and squalor.

<b>For five years, Citizen Nagar is, for the NGOs, the symbol of what is
wrong with Gujarat's Muslims. They lost their livelihoods, they are far
from their places of work, schools or medical facilities. But who chose
that location? Who bought the land and resettled the families near the
reeking garbage dump? The same NGOs who are complaining today. Rather
than encourage and prepare them to return home or to rebuild their
lives, the NGOs, according to a prominent Muslim philanthropist, "threw
money at the families and created victims for life".

It was haphazard, poorly thought out and downright cruel. First the mad
rioters killed people and Modi's government looked the other way. And
since then, the media and many NGOs are trying to ensure that they

and this has become part of the global folklore: it has now become a 'fact' that "2000 muslims" were massacred and that "fetus-in-pregnant-woman's-belly" was cut out of her. ah, the wonders of "truth by repeated assertion"!

but given the usual system in india, this too will be ignored and teesta will continue to fabricate more nonsense. there will be no punishment to her for lying and defamation

Firing a salvo at the NGO, Rohtagi said, “It is clear from the report that the horrendous allegations made by the NGO were false. <b>Cyclostyled affidavits were supplied by a social activist and the allegations made in them were untrue,” he added, with an obvious reference to Setalvad.</b>

The NGO’s counsel Aparna Bhatt objected to such comments being made on the strength of the report, which had also added several persons as accused in the case. Refusing to be drawn into the slanging match between the opposing parties, the Bench headed by Justice Arijit Pasayat said, “In riot cases, more the delay, there is likelihood of falsity creeping in. So, there should be a designated court to fast track the trials.”

The court asked the State Government, petitioners and amicus curiae senior advocate Harish Salve to suggest recommendations on these lines. Additional Solicitor General Gopal Subramanium, appearing for the Centre, suggested selection of public prosecutors on consultation from the SIT. Salve informed the court that the matter would be taken up with the SIT. Based on a suggestion by another NGO petitioner counsel Indira Jaising to evolve a witness protection system, Salve assured that the same would also be discussed in the light of the sensitivity attached to the case. Sit report, which was submitted before a bench comprising Justices Arijit Pasayat, P Sathasivam and Aftab Alam, said there was no truth in some of the major allegations levelled by NGOs. According to the report, the untruths included:
A pregnant Muslim woman Kausar Banu was gangraped by a mob, who then with sharp weapons gouged out the foetus;
Dumping of dead bodies into a well by rioters at Narora Patiya; and n Police botching up investigation into the killing of British nationals who were on a visit to Gujarat.

SIT also said the charge that Mr Pandey was helping mob that attacked the Gulbarga Society was untrue. “The truth was that he was helping hospitalisation of riot victims and making arrangement of police bandobast,” senior counsel Mukul Rohatgi said.

<b>Mr Rohatgi also told the court that 22 witnesses, who had submitted identical affidavits before various courts relating to riot incidents, were questioned by SIT. “It was found that they were tutored. The affidavits were handed over to them by Ms Setalvad. They had not actually witnessed the riot,” the counsel said. </b>

The news fresh from the oven is how the mass of concocted turd that Teesta Setalvad threw against Modi came back and landed on her own face after seven years. The picture of Teesta that finally emerges but which we knew all along: an impostor with a hidden agenda. Recall that Teesta was the only person that went after Narendra Modi with singleminded determination almost every single day for at least 3 years. A measure of success of her brazen activism is the Supreme Court's premature pronouncement of Modi as the "modern day Nero." The SIT report clearly shows some of the dubious and outright illegal methods she followed in her quest for "justice" (sic):

* Tutoring witnesses

* Filing false affidavits

* Lying openly

* Manufacturing tales of incidents that didn't actually occur

* Threatening witnesses and aides who didn't "obey" her

In other words, she didn't have a case. But she got away with it for some time not because she was good at it but because she was hysterically vocal about it, and assumed that those who were with her were as ethically decrepit as she was. However, Teesta's spurious activism has done significant damage: it spawned off an entire cottage industry built on the edifice of falsehood. This cottage industry was awash with tons of funds because it was able to convince idiots abroad that the "fight for justice" was genuine. On the more dangerous side, some of these were well-intentioned idiots but others were active traitors. Gujarat was the perfect opportunity. <b>Also, her sisters-in-crime like Arundhati Roy spun kilometres of yarn based on the Ripped Foetus Theory postulated by Teesta.</b> Indeed, the theory holds a mirror to Teesta's macabre imagination: <i>I mean, she could've simply said: Kausar Banu's head was severed or some such thing. * Parliamentarians for Global Action 'Defender of Democracy' award, jointly with Helen Clark, the Prime Minister of New Zealand.
* The Nuernberg Human Rights Award 2003

And the unkindest cut of all: <i>The Nani A Palkhivala Award in 2006.</i> An award named after the defender of Indian democracy given to a swindler of public conscience. Says a lot about the mental health of the jury.

Justice Nanavati's report said, "The Commission considers it safe to record its finding that there is credible evidence against Jagdish Tytler to the effect that very probably he had a hand in organising attacks on Sikhs." This is not an indictment, Mr Manmohan Singh and his Government decided, so why bother about it? Four years later they remain unrepentant, their attitude remains unchanged.

Two thousand seven hundred and thirty-three men, women and children killed in Delhi, another 2,000 killed elsewhere, scores of women raped, property worth crores of rupees looted or sacked. Families devastated forever, survivors scarred for the rest of their lives.

Yesterday I was thinking about the role of today's Bollywood icon Amtiabh Bachhan in abetting th eSikh killings calling for 'khoon ka badla khoon!" on Doordarshan and the case being filed now in Australia but not in India!



The 1984 Sikh killings in Delhi are the INC version of the Gujarat riots. The INC are past masters at instigating riots and watch the minorities come to them for support.



Those dyas AB was a diehard INC minion. Its only latter he found Mulyam Singh was his mentor. Nowadays on KBC he is the very image of a pan India desh bhakt. Did he ever apologise for his clarion calls in 1984 killings?

What is the background of the Amicus Curae lawyer Raju Ramachandran, in the Gujarat STF report issue? He seems interesting.

The lawyer also expresses his skepticism about Bhatt’s testimony saying,”I am left with no doubt that he is actively ‘strategizing’, and is in touch with those who would benefit or gain mileage from his testimony.” However, these can’t be used to ignore his statement, he notes. :eek:



Noting that there was no documentary evidence of what happened at the meeting the Gujarat Chief Minister held at his residence, Ramchandran has said that the SIT seemed to have chosen to believe officials senior to Bhatt. :eek:



{Err what logic is this? The SIT did not find any evidence of the presence of Mr Bhatt at the meeting. Its not a case of choosing to blive senior officials!}





The SIT itself noted in its report that many of the officials present at the meeting had retired and taken up positions in the state government, others claimed to have forgotten the meeting and still others were serving officials who did not want to take on the political establishment.



Ramchandran said he found it difficult to accept the SIT’s decision against Bhatt since he believed the IPS official would have been called for the meeting due to his position in the police force at the time. <img src='http://www.india-forum.com/forums/public/style_emoticons/<#EMO_DIR#>/laugh.gif' class='bbc_emoticon' alt=':lol:' />

The amicus curiae said that since there was no clinching evidence that proved Bhatt’s allegations was false, further legal proceedings should have been initiated against the Gujarat Chief Minister and said his innocence could be proved before the court following the trial.

With a newly aggressive Congress in Gujarat and the disaffection among rural communities in the State, the ruling BJP has a real contest on its hands in the 2012 Assembly elections.



The political elite of Gujarat have already set the wheels in motion for the State Assembly elections scheduled in December 2012. Both the national parties, the ruling BJP and the Congress, have started grassroots mobilisation, and their leaders have intensified verbal duels at various levels. Both have completed the first round of constituency-wise reorientation after the new delimitation of seats. Out of a total of 182 constituencies, at least 60 constituencies have either been redrawn or turned into reserved or de-reserved categories as a result of the delimitation. Such alterations in nearly one-third of constituencies have posed new challenges for both parties.



Significantly, some senior Ministers holding important portfolios like Finance, Revenue and Urban Development in the State government, as well as the BJP State president, have been affected by the new delimitation of constituencies. All of them have had to relocate themselves and come to terms with new demographic equations. In the light of this, Chief Minister Narendra Modi undertook and recently completed a constituency-wise assessment to analyse the caste-class composition of voters. This is an indication that he intends to micro-manage the party's planning for the third Assembly election under his leadership. He has already declared his intention to win 151 of the 182 seats and create a milestone in Gujarat's political history.

However, current predictions are that it would be a tall order for him and the BJP to surpass their own earlier record of winning 127 seats in 2002, and 117 seats in the 2007 Assembly elections, even in the likelihood of his winning a third term.




While the delimitation is one challenge, three other factors can frustrate Mr. Modi's plans of achieving the record numbers he is dreaming about. The first is the rejuvenation of the Congress party in Gujarat. In the last one year, the Congress has become proactive in the State and through various ‘yatras' and campaigns it has established new links with the people. The party's new aggressiveness is visible at many levels — in the Assembly; in university campuses; in the local media. No doubt it is still far from putting in the shade Mr. Modi's manoeuvrings and theatricals but the present leadership has been certainly trying to join battle with the Chief Minister on every count. Just a few weeks ago, the Congress won the by-election in Mansa, a constituency contiguous with the capital Gandhinagar, by more than 8,000 votes. As Mansa was earlier represented by a senior BJP leader and the Speaker of the Gujarat Assembly, it was a rude shock for the ruling party.

The Congress leadership has also joined hands, though on a limited scale, with grassroots struggles carried out by farmers and tribals to protect their rights over local natural resources. At another level, recently, it represented the case of cotton farmers of Saurashtra and mainland Gujarat to the Central Government and succeeded in getting the ban on cotton export lifted. Although the Congress leadership hardly takes up issues related to landless labour or marginal farmers, its support base among big and middle farmers has become stronger in recent times. Realising the growing discontent among the upper sections of farmers, the State BJP president undertook a “Kisan Yatra” but was unable to get a positive response even in his own area in Saurashtra or from his own community of Patidars, the dominant caste in Gujarat society.



The second factor is widespread disaffection among poor rural communities such as pastoralists, fishworkers and labourers who depend heavily on common property resources. In the name of “development” and to project himself as “Vikas Purush,” Chief Minister Modi has handed vast tracts of coastal land and pasture land to big industrial houses. Similarly, water bodies in a number of districts in Saurashtra and Kutch, including the creeks that punctuate the coast, have been taken over by big industries, either legally or surreptitiously. It is common knowledge that pastoralists and fisherfolk have enjoyed traditional rights over such natural resources for their livelihood. They now feel deprived and distressed. Though no organised struggle has taken root, except the farmers' struggle against the Nirma cement plant in coastal Saurashtra, many villages of Kutch and Saurashtra have knocked the doors of the Gujarat High Court for justice. Their cases are pending before the court.

Perceiving the growing resentment among pastoralists, the Modi government recently announced a plan to develop pasture lands in the first phase of the coming monsoon. But leaders of the Rabaris and Bharwards — cowherds and shepherds — have called it a purely cosmetic plan. Even the Gujarati media <img src='http://www.india-forum.com/forums/public/style_emoticons/<#EMO_DIR#>/smile.gif' class='bbc_emoticon' alt='Smile' /> have termed it a gimmick by the Modi government.



Mr. Modi's personality, specifically the authoritarian and autocratic streak in him, is the third factor that can foil not only his plan to capture 151 seats in the 2012 election but may even reduce the BJP's strength in the Gujarat Assembly. His style has seen some sangh parivar outfits, mainly the VHP and the Bharatiya Kisan Sangh, distancing themselves from the present leadership. Two former BJP Chief Ministers, Keshubhai Patel and Suresh Mehta, have expressed their displeasure and disagreement with him on public platforms, either openly or metaphorically. Local BJP leaders such as Kanubhai Kalsaria have raised the banner of revolt against Mr. Modi's development agenda in the last two years, and led the successful farmers' movement against the Nirma cement plant. In spite of his open revolt, the BJP leadership has not been able to expel him from the party or initiate disciplinary action against him. Even as the RSS headquarters supports Mr. Modi and may project him for national leadership, local RSS leaders and workers have been resentful and may not throw themselves into Mr. Modi's re-election campaign.<img src='http://www.india-forum.com/forums/public/style_emoticons/<#EMO_DIR#>/smile.gif' class='bbc_emoticon' alt='Smile' />Smile

While all the three factors could play a negative role in the coming elections, Mr. Modi's development agenda makes him a hero in the eyes of the powerful and ever-expanding middle class of Gujarat, which is also magnetically attracted to his style that puts off others including his own partymen. Earlier, the middle class was made up of the upper and middle castes but with rapid urbanisation and industrialisation, the ever-growing middle class means a combination of the upper, middle, OBC and Dalit communities in Gujarat.



The middle class factor



To make his appeal more attractive to this broadening middle class, Mr. Modi who started with the Hindutva plank added ‘Golden Gujarat' aimed at pandering to Gujarati parochialism, and market-oriented “development” to his plans and propaganda. Such a mix of three messages has granted him phenomenal popularity among the middle class in the State; with its unconditional support, he equates himself with Gujarat and any criticism against his actions is perceived as criticism of Gujarat and Gujaratis. It is noteworthy that while the Hindu middle class does not constitute the majority of Gujarat's population, its social composition coupled with the State's human geography give its members a decisive say in the urban and rural areas of Gujarat.



There is no one in the Congress leadership who holds comparable attraction for the middle class, or enjoys its confidence in the same way. Also, compared to the BJP's deep penetration in local power structures — the panchayats, city municipal corporations, the extensive cooperative networks or educational institutions — the Congress has limited influence. Neither is the Congress articulate enough to change the terms of the debate set by Mr. Modi. The party has not been able to question the development model or propose alternatives or bring up issues of justice for the victims of the 2002 carnage. Nor does it have influence with the Gujarati diaspora which is campaigning relentlessly but unsuccessfully to get Mr. Modi a U.S. visa and validating his non-inclusive development model in the western world. Yet, with its recent burst of energy in the State, the Congress may improve its performance in the next Assembly elections. Still it does seem unlikely that it will be able to dislodge the BJP from power.



It is certain that after the 2012 Assembly elections, Mr. Modi will start focussing on his next challenge, the 2014 national elections. Whether the national middle class would extend wholehearted support to him and establish him as a national leader is an open question.

In the section dealing with Mr. Modi in its 541-page report, the SIT on the contrary claimed that the Chief Minister had repeatedly appealed to the people for peace and had also taken due care for the rehabilitation and medical facilities for the riot victims in the relief camps.



The report has dismissed the suspended IPS officer Sanjiv Bhatt as a “tainted witness”, whose claims of Mr. Modi having “instructed” the police officers to “allow the Hindus to vent their anger” could not be relied upon, and held retired Additional Director General of Police R.B. Shreekumar's charges of having been “pressurised” by some government officials to draft his affidavits before the G.T.Nanavati-Akshay-Mehta judicial inquiry commission in a particular way to protect the interests of Mr. Modi and the State government, as an “afterthought and motivated”, brought out by him only after he was superseded and denied promotion as the DGP.



The SIT disagreed that there was any delay in deploying the Army in the riot-affected areas and came to the conclusion that the Army and the paramilitary forces were deployed to control the riot situation as soon as the force was available and in full measure, depending on the personnel available.



The SIT also did not agree that the decision to bring the bodies of the victims of the Godhra train carnage to Ahmedabad, which was alleged to have inflamed the riots, was Mr. Modi's “personal decision” but claimed that the decision was taken “unanimously” by the Ministers, government officials and police officers present in Godhra on the evening of February 27, 2002, and was also consented by the then Panchamahals district collector Jayanti Ravi. The SIT was also of the opinion that the bodies were brought to Ahmedabad in the dead of night and disposed of quietly the next day without being paraded before the riotous mob as was alleged by the Chief Minister's critics.



The SIT maintained that contrary to Mr. Bhatt's claim of being present at the crucial meeting at the Chief Minister's residence on the night of February 27, 2002, in which he allegedly passed the objectionable “instructions,” the suspended IPS officer was not present at the meeting. Similarly the then Minister of State for Revenue, Haren Pandya (since deceased), who was claimed to have given a similar statement before a Citizens' Tribunal, was also not present in the meeting and any such testimony could not be relied upon. It stated that none of the police and bureaucratic officials, “who definitely were present at the meeting,” have denied Mr. Modi having passed any such instructions and except the then acting chief secretary Swarnakanta Varma, who said she could not recollect now if Mr. Bhatt was present in the meeting, all others had categorically denied his presence in the meeting.



“Mr. Bhatt is a tainted witness and therefore, can not be relied upon keeping in view his background in the police department as he was involved in criminal cases of serious nature and departmental inquiries are also in progress against him,” the report said. There also was nothing to show that even if the Chief Minister had made such oral observations as alleged by Mr. Bhatt at the meeting, the same had been passed on to the subordinate police officials and that the police on the streets acted accordingly. Even Mr. Bhatt had pleaded ignorance “about the fact as to whether the Chief Minister's alleged instructions were passed on the subordinates and also as to whether the same was complied with or not,” it said. The Supreme-Court-appointed amicus curiae, Raju Ramachandran, however, had given due weightage to Mr. Bhatt's claims in forming his opinion that Mr. Modi could be prosecuted for promoting enmity among various communities.



The SIT report said after closely scrutinising all the telephone call details that it had come to the conclusion that the allegations that Mr. Modi and senior police officers had ignored the “frantic calls for help” from the slain former Congress member of the Lok Sabha in the Gulberg Society massacre, Ahesan Jafri, and deliberately allowed the riotous mob time to massacre the 69 people along with Mr. Jafri. The SIT report said neither Mr. Modi nor the then Ahmedabad city police commissioner, P.C. Pande, or his deputy, M.K. Tandon, and other senior police officers, had received any call from Mr. Jafri for help. The report said it had closely checked the mobile call records of all the concerned police officers and the personal secretaries of the Chief Minister on February 28, 2002, but there was not a single call from Ahesan Jafri's landline number, nor at any time of the crucial day were any of these mobile phones “switched off”, as was alleged. Mr. Jafri did not hold any mobile number, nor there was any other landline or mobile number in the entire Gulberg Society, it pointed out.



The SIT also gave a clean chit to Mr. Modi in respect of his having “instructed” two of his then senior Cabinet Ministers, the late Ashok Bhatt and I.K. Jadeja, to interfere with the functioning of the police forces here and at the State police control rooms on the “Gujarat Bandh” day on February 28. Though the Ministers did visit the police control rooms on that day for short durations for various reasons, there was no evidence that they were acting under Mr. Modi's instructions, nor was there any evidence that at any time they interfered with the police operations, it said.



About the alleged delay in deploying army in the affected areas, the SIT found that the then Additional Chief Secretary (Home), Ashok Narayan, had alerted the Army headquarters on February 27 itself. There, however, was no Army personnel available in the Army headquarters here as they had been deployed in the sensitive border areas. After reviewing the situation on the riot day, Mr. Modi himself had made an oral request to the then Union Home Minister, L.K. Advani, for the Army in the afternoon itself, while an official request was also sent through the home secretary K. Nityanandam to the defence secretary. A high-level decision was taken by the Centre to withdraw some forces from the border areas and send them to Gujarat. Army personnel were airlifted from forward positions and they started arriving in the city from the midnight of February 28 and were promptly deployed in affected areas, depending on the developing situation and availability of the army personnel, from the next morning itself after arranging for its necessary logistic supports, it concluded.



So even the amicus curaie was a scumbag trying to make up charges when there were none!

When the SC appointed the SIT it was said now truth will be revealed. Its a good thing that the SC appointed the SIT for now we know the lies that the secular media printed everyday for the past ten years!
