Arrest Of Shankaracharya - 4
#21
Detention of Junior seer's kin under Goondas Act challengedQUOTEClaiming that there was no nexus or proximity between the incident and the January 21 last detention order, the petitioner alleged that the 'detaining authority has erred in branding the detenu as a goonda.' He contended that no material was disclosed to show why the detaining authority had concluded that Raghu was a goonda. Besides, there was not even a whisper about the extent of his brother's involvement in the murder case. he claimed.

Contending that the grounds for detention were vague and unclear and paralysed the detenu from effectively representing his case to the authority concerned, the petitioner alleged that Raghu had been arraigned in the case because he failed to toe the line of the investigating agency and become an approver.

QUOTE(Mudy @ Feb 15 2005, 12:19 AM) Mata Amritanandmayi steers clear of tainted Kanchi seer, says truth will prevail.:
QUOTE"If somebody does something wrong or unethical it is indeed bad. However, I don't know whether they have done something wrong or not, neither do I want to comment on it. Mudy, That report is by a DDM rep. Take it with appropriate amount of salt. Mata Amritanandamayi had in the past clearly expressed her views regarding the Shankaracharya's arrest. She had expressed her support for Kanchi and hoped that this ordeal for Shankaracharya would pass off as a bad dream. She is not a person who changes her statements. Since the case is highly political, she perhaps doesn't want to comment any further on it. The reporter seems to be interpreting beyond what she said.

QUOTEFollowers say she was a problem child and a school dropout, spending all her time praying to Lord Krishna and sleeping on the beach.

This quote shows how ill informed the know-all smug DDM could be.

Amma was not a 'school dropout'. She wanted to go to school, but her parents wouldn't let her. She was kept at home pretty much as a servant to do the household chores.

Amma was not a 'problem child' either. Her family could be called a 'problem family' on the other hand.

Seeing how this reporter has twisted around the facts, I wouldn't put too much faith in his interpretation of what Amma said about the Shankaracharya.

Ashok Kumar,
I highlighted DDM at it worst. How they can even call him tainted?
I also feel, DDM may have even twisted her words.

Satya,

Could this be due to drugs ? Is Pentothal known to cause fever and back pain ?

Off the bat, it struck me more likely from being kicked in the kidneys and developing an infected hematoma.

Infectious diseases are also possible, but in that case, why didn't they keep him, at least for quarantine purposes?

Pentathol can cause disinhibition, sedation, tearing, etc. (Remind you of a certain interrogation tape?) It can also cause cardiac complications - Cardiologists were called in to see Acharya a few days later according to reports for cardiac symptoms.

Mind you they didn't take a 70 year old diabetic to hospital with cardiac symptoms, but they took RS. He must have been really serious.

SJM slams TN police move against GurumurthyQUOTEThe RSS-backed Swadeshi Jagran Manch today condemned as "pressure tactic" and an act of "retribution" the "initiation of criminal prosecution" against its co-convener and columnist S Gurumurthy by the Tamil Nadu Police for allegedly "misleading" the probe in the Sankararaman murder case.

"The SJM regards this as a measure of retribution against him for nearly a dozen articles he had written in English and Tamil exposing the actions and omissions of the police in the investigation into the Shankaracharya case...this has exposed the designs of the state police against the Kanchi Mutt and also the Shankaracharyas", its All India Convener Muralidhar Rao said in a statement here.

The Manch accused Tamil Nadu Police of "harassing and hounding Gurumurthy in order to put pressure on him to stop exposing them further".

Rao threatened to take the issue to the people and "expose the designs of the Government".

QUOTE‘Detention of mutt manager violates directive’
Thursday, 17 February , 2005, 17:24
Rajapalayam: Detention of Kanchi Mutt manager Sundaresa Iyer and Raghu, brother of junior Sankaracharya Vijayendra Saraswathi, both accused in the Sankararaman murder case, under the Goondas Act appears to be a clear violation of a Tamil Nadu government’s recent directive on detentions under the stringent law.

The circular, issued in January to the district collectors and superintendents of police, asked them to ensure that while ordering detention of a person under the Act, there should be at least one "adverse" case or more cases against him/her other than the ground case.

The circular had been issued in the light of observations made by the Supreme Court which held in a case that a solitary instance of robbery, as mentioned in the grounds for detention under the Goondas Act in a criminal case, was not relevant for sustaining the order of detention for the purpose of preventing the persons from acting in a manner prejudicial to the maintenance of public order, an official told PTI on condition of anonymity.

Besides, the advisory board, empowered to review the detentions under the Act, had taken a stand that for the solitary offence under Section 302 of the IPC (murder), the normal law would take care and, therefore, there may not be any detention under the said Tamil Nadu Act 14 of 1982 against such individuals as "Goondas."

The government had revoked some detention orders also following the above advice of the board, the official said.

Kanchi Sankaracharya Jayendra Saraswati, who was staying at the 'Brindavan' here ever since his release on bail on January 11, today stepped outside to visit to a hospital which provides free treatment in the village.

The Seer had travelled to Kancheepuram twice from here to attend the proceedings of the Sankararaman murder case at a court there, but had never gone to any area in the village.

He was in the hospital, inaugurated yesterday, for over 10 minutes before returning to Brindavan, the samadhi of previous Sankaracharyas. The seer continued to observe 'Moun Vrath' (silence).

This is a significant ruling. Basically HC has flushed down all the BS that JJ + SIT came up with -> "mutt is not religious institution". Dilli is nearer then before.. <img src='style_emoticons/<#EMO_DIR#>/specool.gif' border='0' style='vertical-align:middle' alt='specool.gif' />
