The government has agreed to make public the audio recordings of proceedings of the Joint Drafting Committee constituted to frame the Lokpal Bill.



The Department of Personnel and Training (DoPT) had earlier refused to bring out the deliberations of the Committee in public domain though the civil society members had wanted the proceedings to be made available soon after the meetings.



The Joint Drafting Committee, comprising five members of Team Anna and an equal number of Cabinet Ministers, was formed to finalise the draft of the Lokpal Bill earlier this year. The committee, constituted on April 10, included Finance Minister Pranab Mukherjee, Home Minister P Chidambaram, the then Law Minister Veerappa Moily, Telecom and Human Resource Development Minister Kapil Sibal and Minority Affairs Minister Salman Khursheed.



The civil society members included Anna Hazare, Justice N Santosh Hedge, Shanti Bhushan, Prashant Bhushan and Arvind Kejriwal.



Responding to a query filed under the Right to Information filed by activist S.C.Agrawal, the DoPT has said that the audio proceeding of the meetings of the Joint Drafting Committee for drafting the Lokpal Bill have now become available. ``There are nine CDs and you may deposit copying fee of Rs. 450 so that copies of the CDs can be supplied to you,’’ Amarjit Singh, under secretary of DoPT has said in the response.



While welcoming the decision, Mr Agrawal said he would deposit the money under protest on Monday because information to a RTI query has to be provided free of cost if the response does not come within 30 days. He had filed the RTI application in June.



Earlier, responding to an RTI query, the DoPT had said that they require the nod of Law Ministry to make public audio recordings of the close-door meetings between the government and Team Anna.



"Joint Drafting Committee (JDC) was constituted by notification of the Ministry of Law and Justice wherein JDC was supposed to evolve its own procedure. It may be further noted that the matter relating to RTI queries on audio- recordings of JDC has been referred to Department of Legal Affairs in Ministry of Law and Justice for clarification," an RTI response from DoPT had said.[/size]

MUMBAI: Almost 10 months after a group of 14 eminent citizens (G14) created a flutter with an 'Open Letter To Our Leaders' expressing alarm over a "governance deficit in government, business and institutions", it has released another 'Open Letter' supporting the "need for the urgent passage of a well-crafted Lokpal Bill by Parliament", and calling for "urgent action on land, judicial, electoral and police reforms".



Acknowledging that a "strong nexus exists between certain corporates, politicians, bureaucrats and power brokers", which it described as "one of the greatest threats to the Indian economy", the G14 said both the "giver as well as the receiver of a bribe" should be punished.



The group, which includes some of the biggest and most respected names in India Inc, said, "We...believe that the Lokpal Bill is only one small but critical step in the national task of weeding out the plague of corruption in India. This draft Lokpal Bill is intended to address episodic corruption, but is unlikely to have any significant impact on day-to-day corruption, which is insidious and demeaning."



Biggies rally behind Lokpal



The group included Wipro's Azim Premji, HDFC's Deepak Parekh, ICICI's N Vaghul, industrialists Keshub Mahindra, Jamshyd Godrej and Anu Aga (also a member of the Sonia Gandhi-headed National Advisory Council), former Hindustan Lever chairman and now Member of Parliament Ashok Ganguly, former RBI governors M Narasimham and Bimal Jalan (now a Rajya Sabha member), Justices B N Srikrishna and Sam Variava, architect of key Sebi and RBI regulations Yezdi Malegam, member of the PM's Economic Advisory Council AVaidyanathan, and banker-turned-social worker Nachiket Mor.



Implicitly throwing its weight behind a strong Lokpal, the group said, "August 27, 2011, marked a high point by the historic debate leading to the 'Sense of the House' in Parliament on the Lokpal Bill. The event reinforced the inviolable primacy of the Indian Constitution. It was also an event of relief and reassurance to the vast and silent majority who constitute India's core civil society."



The group lamented, at length and with examples, the fact that the common man's life was "vitiated by corruption" at every turn.



It has called for speedier environmental clearances, "online auction of natural resources...to prevent discretionary and irregular practices", and appointment of more judges for an effective redress mechanism.



It said the "impasse" on clearances continued to delay investment proposals and hamper economic growth. "Owing to several such impediments, fresh investments are not forthcoming at the pace required for a rapidly growing economy such as ours. Policy uncertainties and delays in approvals are forcing many large corporate entities to seek out opportunities in other geographies."

NEW DELHI: Congress said on Monday that the Anna Hazare agitation was just a mask for communal forces. Retaliating to the anti-graft campaigner's call for the ruling party's defeat in the Hisar by-election, the party said it could not understand the reason for Hazare's stance to make it an issue in the poll when the parliamentary standing committee was going full steam to wind up the Lokpal legislation as per the understanding.



AICC spokesman Manish Tiwari said, "Is this really about corruption or is it again the traditional battle over the basic 'Idea of India' which is being played out in the garb of other issues... whether India should be a secular republic or a communal country." Tiwari said the view about Hazare's agitation being a proxy was given force by the group's unjustified aggression over Lokpal.



Monday marked a concerted Congress bid to dismiss the anti-graft agitations as driven by political considerations, clubbing BJP veteran LK Advani's yatra starting Tuesday in the same category. The timing of Hazare's Hisar call and Advani's yatra provided enough fodder to Congress to project them as planned from the same stable and with same objective.



Tiwari said, "The yatra has less to do with issues raised but is meant to see if 2014 can be fast forwarded in 2012. Unfortunately, it would not happen."

A day before the Jan Chetna Yatra begins, veteran Bharatiya Janata Party leader L.K. Advani made two points: he did not rule himself out of the race to be declared the prime ministerial candidate and his party did not agree with the Anna Hazare team on several issues, including the recent assertion by team member Arvind Kejriwal that Anna was “above Parliament.”



“The party [BJP] will decide when elections come,” he said when asked whether he had ruled himself out as a prime ministerial candidate.



It seems that on several issues, including the Jan Lokpal Bill, Mr. Advani and his party were not on the same wavelength as the Anna team. The BJP, he said, had differed with Anna and his men on several key issues related to the Bill. For one, he did not think anyone had the right to challenge the parliamentary system.



Addressing a press conference here on Monday, he said: “Parliament is the highest authority … I do not know in what context it was said Anna was above Parliament,” Mr. Advani.



“We [the BJP] had also differed with the Anna team on a bill that would send bureaucrats who delay work directly related to people. Our State governments have passed laws to give time-bound services to people and delays would attract fines. Later the Anna team agreed with us on this,” he said.



Mr. Advani said his ‘yatra' from the birthplace of Jayaprakash Narayan in Chhapra on October 11 to Delhi on November 20 would keep its focus on the twin issues of ‘clean politics' and `good governance” that he saw as keys to keeping India's democracy healthy. He pointed out that while Jayaprakash Narayan realised the importance of political parties and galvanised all the Opposition parties, the Anna team was shying away from engaging political parties.



On the demand for ‘right to recall' or ‘right to reject,' he said while there was need for electoral reforms to check criminalisation and the use of money power in politics, he was not sure whether in a big country like India the right to recall would work. “It is not so simple. For the true functioning of a democracy, we have to accept that a duly elected Parliament is above the general public as far as governance of the country is concerned. One can debate that the people may have the power to recall an elected member or members and in the process forces a mid teerm poll, if the situation so demands.

On the contrary, if members of the public are allowed to give directions to the Parliament with regard to functioning of the government , then there will be total chaos and collapse of the administrative machinery. In the present case, certain individuals have started a movement to force the government to take certain measures to contain corruption in public life. There is no denying of the fact that there is today wide spread corruption in almost every sphere of public life in India today.

Now how to bring about an improvement in the situation. If the people of India are instigated to rise against the system and force certain measures, it is unlikely to remove corruption .On the contrary , it may lead to total anarchy in the country .

To resolve the problem of corruption , a number of serious corrective measures are required to be taken. It needs to be seriously deliberated upon by parliament and necessary remedial measures have to be taken. This task cannot be taken over by the Civil Society alone.There is no harm in important members of the Civil Society interacting with the appropriate committee of parliament and exchanging views on how best the situation can be handled.

Unfortunately, none of the main players today is addressing the fundamental problem of corruption. The so called team of Anna Hazare is trying to gain popularity by various moves, while the political parties are trying to counter act such moves. In the process , no real progress is taking place with regard to the real problem i.e. corruption in public life. We have to put a powerful instrument in the hands of the Government to contain corruption. The blue print for such an instrument cannot be drawn up through street agitations and fasts.Anna Hazare will never succeed in his noble endeavour , if his team does not change its course and deal with the matter more seriously. They should immediately stop jumping from one media opportunity to another to gain popular support . It will take them no where in their fight against corruption.

NEW DELHI: Senior Supreme Court advocate and Team Anna member Prashant Bhushan was beaten in his chamber by youth allegedly for his Kashmir comments. [/size]



[size="3"] Supreme Court lawyer-activist Prashant Bhushan was roughed up at his chambers here by a youth in full view of TV cameras Wednesday. The youth barged into his chamber and started beating him up, before being overpowered by others present in the room, TV visuals showed. [/size]



[size="3"] The two attackers claimed that they were from Sri Ram Sene. The attackers told Times Now that they were provoked by Bhushan's comments on Kashmir. One of the attackers has been arrested by the Police. Bhushan filed an FIR against the attackers. [/size]

The three individuals who bashed him up in his chamber have done much greater harm. When the movement against corruption was receiving full media attention, they have diverted the direction of the TV cameras. Today as a follow up there was attack on Anna supporters outside the Courts.

The statement made by Shri Prasant Bhushan had hardly been taken note of by anyone including the media till the time he was attacked by the Bhagat Singh Sena. The attack has been condemned by all major political parties including the BJP. However, the arrest of the culprits and today’s disturbance gives the impression that certain organisation or individuals are trying to divert media attention from the anti corruption movement started by Shri Anna Hazare. Since all those arrested are or were associated with the BJP at some point of time, naturally the finger will get pointed towards the BJP.

Prior to the attack on Shri Prasant Bhusan , an impression was gaining strength in certain political quarters that the movement of Shri Anna Hazare and the activity of certain members of the Civil Society is going to pose a serious challenge to all the existing political parties and may become a threat by the time the next general election takes place. In this backdrop , it is but natural that a strong suspicion arises about the real motive of the disturbance that has been caused by the members of the Bhagat Singh Sena and its associates.

I am of the opinion that Prashant Bhushan was used as an instrument to vent frustration against Team Anna who is not ready to join forces with either UPA or BJP. Sadly politics has always been the stronghold of conniving individuals.

Many in India would regard M.K. Gandhi as anti-nationalist as he was so carried away by his belief in non-violence and humanity that he was prepared to go out of the way to appease the muslims even at the cost of partition. The fact remains there are and will be some die hard believers in that theory even in present era, people like Prashant Bushan who would support a similar ideology for the sake of peace. Calling him anti-nationalist or pro-peace would depend on how you view it. M.K. Gandhi is still called 'Mahatama' because he was beyond greed. He fought against apartheid in South Africa just as he did in India for swaraj. I am not comparing the two persons as Gandhi is virtually incomparable but somehow feel probably Prashant Bhushan is motivated and driven in that direction. Nationalism and humanity often do not go hand in hand.
