Only Supreme Court can stop this. The agitating students must know that since this doesnt directly affect a whole bunch of people, common folks just dont care whether they are getting screwed or not. So the fight has to move on to legal fronts.

Secondly, there is a clear need to ask for 'upper' caste quota. The disadvantage of this is that this will definitely split the 'hindu' vote bank (if there is indeed such a beast). The advantage is that once that is allocated the reduction in any other quota will be directly linked to anti-whatever policies. The other advantage is that this will definitely make the general population demography-concious.

More than 13 years after the implementation of the Mandal Commission report, the Government's quota policy has turned out to be an abysmal failure. The latest Government statistics leads to the startling conclusion that quota as an affirmative action may need serious consideration.

The figures show that other backward classes (OBCs) account for only 3.9 per cent of the Central Government services, notwithstanding 27 per cent quota for them since 1993.

The report assumes significance in the backdrop of repeated demands by various social groups that the Government should review the impact of quota as an affirmative action.

The figures with the Union Social Justice & Empowerment Ministry put the share of OBCs in Group 'A' services at 3.9 per cent. There are only 3,090 OBC officials in this category, an eye-opener for the proponents of the quota policy as an affirmative means to bring parity in society. The Department of Personnel and Training compiled the statistics.

"Even after 13 years of quota for the OBCs in Government jobs, their percentage is far below 27 per cent. Since the social, economic and academic status of OBCs are much better than that of the scheduled castes and tribes, their share in the jobs should have been much better," a senior Social Justice and Empowerment Ministry official said.

"The figures suggest that there are serious chinks in the Government's reservation policy. It is either not being effectively implemented or there is a shortage of suitable candidates among OBCs, who could make it to the competitive examinations. At this rate, the quota as an affirmative tool would lose its relevance," the official added.

In the Central Government's Group 'B' services, the OBCs account for only 2.3 per cent. There are only 3123 OBC officials in this category, while in Group 'D' category, there are 1,06,309 officials accounting for 5.2 per cent.

In the case of SCs, they account for only 12.2 per cent in Group 'A' services against the quota of 15 per cent. The STs' share stands at 4.1 per cent.

Though there is a two per cent improvement over 9.09 per cent in the case of SC and 2.53 in ST in 1991, Ministry officials feel that a lot needs to be done to enable them to carve a niche for themselves in the service sector on their own.

SC/ST students have reserved seats up to 22.5 per cent in all academic institutions, including Indian Institutes of Technology (IITs), Indian Institutes of Management (IIMs), and all other Central universities. The fact that hardly any percentage of SC/ST candidates apply for jobs under the general category is "a reflection on the effectiveness of all affirmative measures being taken at the grassroots level".

What gives the Ministry officials a sense of satisfaction is the fact that the percentage of SCs in Group 'B' category services stands at 14.5 against 11.82 in 1991. Among Group 'C' Central Government employees, SCs account for 16.9 per cent. There is a slight improvement in the figure compared to 15.65 per cent in 1991.

Even the percentage of STs in Group 'C' services is 6.7, a marked improvement over 4.98 per cent in 1991. Their share in Group 'D' services is only 6.7 per cent. STs account for only 4.1 and 4.6 per cent in Group 'A' and 'B' Government services

New Delhi: The judiciary and the legislature may be heading for a showdown. The fight maybe over the Constitution’s Ninth Schedule which prevents courts from challenging laws passed by the legislature.

The Chief Justice of India, Y K Sabharwal, has set up a nine-judge Constitution bench to study whether the political class can overrule or bypass the Supreme Court and make laws that violate the fundamental rights of citizens.

Currently, any law made by the legislature under the Ninth Schedule is beyond judicial review. The constitution bench will determine whether it’s possible to bring even these laws under judicial scrutiny.

Sabharwal’s decision has upset many politicians. “Cabinet can do what Cabinet is empowered by the Constitution of India and the executive powers. The Supreme Court has also the right to interpret the laws,” said Parliamentary Affairs Minister Priyaranjan Dasmunsi.

Only land reform laws were supposed to be included in the Ninth Schedule, but in the recent times many state governments have included several controversial legislations.

The Tamil Nadu Reservation Act, which pegs reservations for SC/STs and OBCs at 69 per cent, and the Conservation of Foreign Exchange and Prevention of Smuggling Activities (Amendment) Act are some examples.

“If a law violates any of the fundamental rights, then it has to go,” says senior advocate R K Jain.

Hurt by strident criticism from UPA ally Pattali Makkal Katchi (PMK), senior Congress leader and chairman of the Oversight Committee on Reservations, Veerappa Moily, has bluntly asked PMK founder S Ramadoss not to intimidate him or try to question his pro-reservation credentials.

<b>Ramadoss had criticised Moily for his recommendations on "other backward classes" reservation in Central educational institutions and had asked his supporters to hold demonstrations against him whenever Moily visited Tamil Nadu.</b>

<b>"I fail to understand why you should tell your cadres to stage demonstrations against me. It is appropriate that you put more pressure on the UPA Government and the UPA coordination committee, instead of intimidating me in the manner you have done through your statements,"</b> Moily said in a letter to Ramadoss.

Ramadoss is upset that the UPA Government had decided on implementing 27 per cent OBC quotas in phases instead of doing it in one go. He had also hinted that Moily's panel had recommended that the 'creamy layer' among the OBCs be kept out of the purview of reservations, and that it was Congress president Sonia Gandhi's intervention that led to the 'creamy layer' concept being dropped from the Bill ultimately introduced in Parliament.

Rejecting the charge that he had favoured denial of OBC benefits to the creamy layer among them, Moily said the committee had actually not made any recommendation on the issue. It was for the UPA Government and the UPA coordination committee to take a political decision on such issues. He pointed out that Ramadoss was a member of the UPA and that his son, Anbumani Ramadoss, was a member of the UPA Cabinet.

<b>Moily, a former Chief Minister of Karnataka, underscored his track record as a leader committed to the welfare of scheduled castes, scheduled tribes, backward classes and minorities. He had brought in BC reservation in local bodies in Karnataka and introduced a common entrance test for admission to professional courses that enabled thousands of Dalits and backward class students to become engineers and doctors without paying capitation fees.</b>

Moily said he had advised Congressmen in Tamil Nadu not to get upset by the statement of Ramadoss. As Congress Working Committee member in charge of Tamil Nadu, it was his duty to maintain unity and solidarity within the (DMK-led) Democratic Progressive Alliance and the UPA, of which the Congress and PMK were partners.

He released his letter to the media "so that the mistrust among our friendly parties is not rekindled," Moily said.

The proponents of 27% reservations for OBC argue that it would help them overcome centuries of discrimination. I wondered! If indeed, such was the animosity between the forwards and backwards how did the Indian Civilization survive for over 5,000 years. A Google search led me to ‘The Beautiful Tree: Indigenous Indian Education in the 18th century’ written by noted Gandhian Dharampal.

The book gives, at the beginning of British rule number of schools and caste composition of students. The author referred to British & Indian archives and reproduced reports of surveys undertaken by the British (between 1800-1830) in Madras Presidency amongst others. Relevant findings are:

Central ministers Arjun Singh and P Chidambaram flew down to Chennai last week to attend Madras University’s 150th anniversary, presided over by President Abdul Kalam. Tamil Nadu Chief Minister M Karunanidhi, who spoke in Tamil, singled out Singh for special praise for introducing 27 per cent reservation nationally. The CM declared that the HRD Minister had been as focused as his namesake from the Mahabharat when shooting an arrow. The crowd clapped enthusiastically to the references to Singh. But he himself could not make out what was being said about him until President Kalam, who was sitting two seats away, leaned across and translated. For some reason the two sitting on either side of Singh, Karunanidhi’s son M K Stalin and Chidambaram, did not choose to interpret the TN CM’s words.

As much as there is rationalization for reservations, there should be rationalization for this micro-division.

A punch in the face for quota votaries?

There is a marked increase in the population of other backward classes (OBCs) and scheduled castes (SCs) in the country.

As per the latest reports compiled by the National Sample Survey Organisation (NSSO) of Ministry of Statistics and Programme Implementation, OBCs account for over 40 per cent of the country's population, up 6.5 per cent from the last report of 1999-2000.

<b>The NSSO report for 2004-5 further dents the claim of the Mandal Commission that had pegged OBC population at 52 per cent and had formed the basis of the Centre's quota policy</b>.

As there is no caste based census report in the country, the NSSO figure puts various question marks on the prevalent quantum of 27 per cent quota for OBCs in Government jobs and academic institutions.

The NSSO report, that is scheduled to be released next week, puts the population of scheduled castes at around 19 per cent, while that of scheduled tribes at 8.6 per cent.

As SCs have been given reservation in proportion to their population, the NSSO figures may come in handy for the Union Social Justice and Empowered Ministry, which is pressing for an increase in SC quota.

"There is a growth of over six per cent in the population of other backward classes as per the 61st round survey for the year 2004-5. There is an increase of over 2 per cent in the SCs population. There is an increase of 1.6 per cent in the ST population," sources in the Ministry of Statistics and Programme Implementation said.

Though exact details of the factors leading to the increase would only be known after the final report comes out next week, sources claimed that the figure was close to the ground realities.

"A growth of 6 to 7 per cent in OBC population is not an unusual phenomenon. As per indications based on reports from different parts being clubbed together, there seems to be a substantial increase in the OBC population in rural areas," sources said.

In Report No. 472 under the statement titled, "Percentage distribution of persons by social groups in rural and urban areas of major States," for 1999-2000, the NSSO pegged OBC population at 33.5 per cent.

The figure was based on the survey of as many as 6,046 villages covering 4,116 blocks across the country. In all, 71,385 rural and 48,924 urban households were surveyed to ascertain the Indian's socio-economic status.

In rural areas, 3,74,856 people were surveyed to know their social and economic status, while in the urban areas, 2,25,160 people were surveyed in 15 States of Andhra Pradesh, Assam, Bihar, Gujarat, Haryana, Karnataka, Kerala, Madhya Pradesh, Maharashtra, Orissa, Punjab, Rajasthan, Tamil Nadu, Uttar Pradesh and West Bengal.

"The latest report is based on the survey conducted in around 9,000 villages in almost all 600 districts except Leh and Kargil districts. The survey was conducted at a much larger scale. As a result, the findings have to be almost close to the actual," official sources said.

The percentage of SC/ST/OBC population in NSSO report is based on the survey of the castes as identified by the Government of India.

Sources said that among all States covered by the Ministry for survey, Tamil Nadu has the largest OBC population, accounting for over 64 per cent of rural population and 70 per cent of the urban population.

In the September 2001 survey report, the NSSO put SC population at 17.38 per cent, a little higher than 16.23 per cent of the Census 2001 and ST populace at around 7 per cent against 8 per cent plus as per the Census 2001.

I think given the current environment, it makes sense to do the NSSO survey EVERY YEAR just like the budget.

Depending on the population percentages (and yes they all need to add upto 100%) the seats need to be divided.

Open category is passe. What is required is good strong boundaries. SCs go in the SC quota. Brahmins or whoever need to go get their own quota. etc..

There is no need to take 'moral high grounds' etc. Quota is a reality. There seems to be a consensus that caste based quota is required. As Veerappa Moily says the "anti-quota attitude is gone" and I agree. The only thing that doesnt make sense is the 'open' category. That needs to be shelved. There should be a brahmin category. There should be a kshatriya category. A vaishya category. A Shudra category. etc.. Each grouping can then make up their minds about creamy-layer and all that BS. Quota is important.

One of the arguments against this scheme could be that it would be cost-prohibitive to do surveys every year. I disagree. We do budgets every year. And we spend 16,700 crores to just implement OBC quota. So we have ample money and technology can decrease the costs tremendously. We have the election voter cards and that same database can be used to store this additional information.
And I am not being sarcastic or facetious. I am realistic. This is the new reality and I have changed my opinion. Quota is good. Let there be quotas for everything. I wish I had better articulation skills but we need to seriously think about this. This is the reality and there is no running away from this. All Varnas and Jaatis need to look after themselves, get their population counted properly and ensure that they get proportional seats or else they are toast.
They should start census based on caste and religion. And every aspect of live in India they should strickly implement caste based quota.
I agree with you, every caste should have their own creamy layer.
If India want to go for inequality then why restricted to some area. It should be everywhere.
Quota in Army should be must. Regiment should be based on caste. In the event of war, regiment should be assigned to battle field based on caste.

What about inter caste marriage? Govt should discourage inter caste marriage, it will create unneccessay confusion for caste equation.

No it should be upto the individual quota constituents to decide whether creamy layer is affecting them or not. If so they may want to have a separate quota for themselves. For example if SCs think that creamy layer is affecting them then we can have 2 separate quotas. Oppressed Scheduled Castes (OSC) and Creamy Scheduled Castes (CSC). Mahars can go in CSC while Kurmis can go in OSC or whatever. I dont know but it will be upto the current constituents of SC to decide if and when such a split is required.

All I want is that if brahmins are 4% of population, I want 4% set aside for brahmins. If 5 years from now brahmins become 2% quota has to change, brahmins will have 2%. If pop becomes 10% then brahmins get 10%. Simple as that.

Each jaati looks out for its own.

Yes. I agree.

Once again I say this in all sincerity. I am not being facetious or sarcastic. Quota is here to stay. There is no point in coming up with shallow moral arguments. Caste is a reality in India. There is general acceptance that resources of the society must be distributed according to jaati+varna=caste. We should stop giving stupid moral arguments - this is janta ki awaaz. Lets listen to it.
