KATHMANDU: The cooling ties between India and Nepal are likely to be further strained by the <i>reported claims</i> by suspended Indian army officer Lt Col Srikanth Prasad Purohit that Nepal's deposed king Gyanendra had promised to help his group by buying arms for them and providing them with military training in Nepal.

The alleged statement by Purohit that a senior official of the Nepal Army too was involved in the conspiracy to establish a Hindu nation by violence is also going to ruffle the feathers of the <b>army</b> that has in the past issued warnings that it should not be dragged into any political controversy.

The 4500-page chargesheet produced by the Mumbai Anti-Terrorist Squad (ATS), which was distributed among the Indian media last week, makes a laughing stock of itself to anyone who knows Nepal. However, with a virtually 18-hour daily outage practically cutting Nepal off from the rest of the world, including its southern neighbour India, the fallacies in the document have gone mostly unnoticed.

However, Nepal's Jana Aastha weekly on Wednesday carried a front-page report on the allegations about Nepal's former royal family, saying it raised fears about a deliberate smear campaign.

The ATS chargesheet reportedly includes the transcript of a conversation between Purohit and two of his accomplices that police claimed to have found in the laptop of one of them.

"Let me also tell you our meeting had been fixed with King Gyanendra on June 24, 2006 and then in 2007," Purohit allegedly says during the conversation. " ... the king had accepted the proposal ... 20 people from my side will train as officers there (in Nepal) every six months ... I'll get 40 persons every year ... I'll get 400 soldiers."

Purohit also <b>allegedly</b> says he asked the king to buy AK-47 rifles from Czechoslovakia since Nepal was a sovereign nation, promising to pay for the guns and ammunition.

"The king has accepted ... ," he allegedly says.

There was no way the king could have agreed to a meeting in June 2006 or 2007, let alone buy guns as at that time he had been removed as head of government and was battling for survival. After a pro-democracy movement, the king stepped down as chairman of the council of ministers in April 2006 and soon, the new seven-party government announced it would hold an election to decide the fate of Nepal's centuries-old monarchy.

In 2007, the Maoists, who had waged a 10-year war to end monarchy, had joined the government and it was impossible to nurture a secret conspiracy for a Hindu kingdom. But the most telling flaw in the chargesheet is Purohit's alleged boast that he was in contact with Queen Aishwarya, the "maharani of Gyanendra", who allegedly supported the idea of a Hindu nation.

Queen Aishwarya was killed in the midnight massacre in the royal palace of Kathmandu in 2001. Also, she was the queen of King Birendra, who too was gunned down during the carnage. Gyanendra's wife, the former queen Komal, has never been known to harbour any political ambition and never showed any inclination to wield power.<!--QuoteEnd--><!--QuoteEEnd-->In spite of admitting to ATS' impossible charges and allegations ("Purohit supposedly said"), the title is typical cryptomedia: accusing Purohit rather than the ridiculous charges of the ATS against him. This sort of cultural policing has fascist overtones and translates into vandalism and violence against women and minorities. It is also typical of both Hindutva and Islamist fundamentalism. The sangh parivar has long peddled the stereotype of the backward-looking and antediluvian Islamist fundamentalist exercising a stranglehold over an entire community. Yet it has no compunctions in allowing its offshoots, the Bajrang Dal and now the Sri Ram Sene, to implement a version of Hindu culture that is the spitting image of Islamist fundamentalism. What is there to distinguish these Hindutva outfits from the fundamentalist Dukhtaran-e-Millat in Kashmir, which has frequently threatened to disrupt such events as Valentine’s Day and has been issuing Taliban-style edicts to coerce Muslim women into wearing burqas?

The congress is trying very hard to propel its agenda of maligning Hindu organizations. NDTV and other liars are the foot soldiers of this propaganda war. I think a separate thread is necessary to expose each and every lie. Malegaon investigation is just one side of the campaign. This is an attack from all sides. I am not sure if anyone has been following NDTV during the couple of weeks. They have stooped so low that even laymen can point out their desperate measures easily. Let us look at the following points

1. On the first day when Mangalore pub attack was reported, an NDTV reporter asked Abhinav Bindra whether his happiness and celebrations in getting the Padma Bhushan was some how marred by the incident in Mangalore.
Poor chap, what can he say? He agreed with the reporter and said "I am sad, India is a democracy and people have the right to do what ever they want". But the reporter is not satisfied. He asks again and Bindra gives a similar reply. Now,why would he be not happy at a time when our nation has honored him with Padma Bhushan? Just because some thugs beat up boys and girls in a pub? This is gutter journalism. Putting words in to people's mouths!

2. Renuka Choudhary gives the name 'Hindu Talibanism ' for this incident and from there onwards NDTV changed its headlines to echo this sentiment. So Hindu terrorism campaign slowly turned to Hindu Talibanism campaign. Opinion polls and 'Big Fights' follow, in the end, the verdict is given - "Hindu Taliban has arrived".

3. Let us look at another strategy they adopted. What gets attention on Republic day? It is not our Republic day parade. Well, what is there to be proud of in a country where women are attacked like rabbits? So, NDTV gives more attention to......yes, you guessed it right- Mangalore pub attack!! In their hourly news update, Mangalore incident is shown first, along with comments from people asking 'Are we a secular democracy?' Republic day celebrations are shown in the end. It seems that, what my Guruji once mentioned is becoming a reality- Our nation is not a democracy, it is a nation of ' Demoralized Crazy' people.

4. After a week of campaigning to ban Ram Sena, NDTV realizes that it is losing the battle as many people including Ghelot came out against pub culture. So what do they do? They link Ram Sena to Malegaon blasts. There you go, Indian secular media has exposed the nexus of Hindu terrorists. They are in possession of ‘crucial evidence', a tape in which Pramod Muthalik 'praised' sadhvi Pragya. Good to see that the ATS did not waste any time in setting off to Mangalore to question the 'Hindu terrorist' Muthalik. Maybe they are desperate to find all the 'evidence'. Unfortunately for them, they had to let Muthalik go because the 'evidence ' was not strong enough. Nevertheless, NDTV and other secular channels managed to link Ram sena and Malegaon for two days. Mission accomplished!

The lawyer defending the accused, P P Hegde told rediff.com that his clients wanted to ensure the safety of the girl and also added that they angered to see their MLAs daughter going out with a boy.

The victim however maintained�that the boy was known to her and added that he did not try and misbehave with her. I just asked him where he was going she said. We were not sitting in the same seat either, she said. Detailing the one hour in captivity she said that they were warned and also added that the men threatened the boy several times.

<b>Chief Minister of Karnataka, B S Yeddyurappa has termed this incident as a conspiracy hatched by the Congress and the Janata Dal-Secular to tarnish the image of his government.</b> I have also asked the police to take strict action, he also added. He has also chaired an all party meet to discuss the growing incidents of violence.

Mangalore Superintendent of Police, Satish Kumar told media-persons that action is being taken and also added that five members are in custody. Kumar also said that the driver and conductor of the bus too were in custody.

The Pakistani questions wound their way to the Mumbai police on Friday, though it will be a while before India will be able to furnish credible answers. The response will be worked out by the home ministry and the security agencies.

While most of the questions from Pakistan relate to the Mumbai attacks, there is also an attempt to probe deeper into the Indian system. Among other things, Pakistan wants to know how India came to the conclusion that someone like Abu Hamza was involved in the attacks. Abu Hamza's name had not been immediately discernible in the aftermath of the attacks, and Indian investigators have gone to some trouble to trace him out as one of the planners of the Mumbai attacks.

Abu Hamza remains at large and though he figured in Pakistan's investigations as well, Pakistan's questions on the Indian investigation might not find willing takers here. India named Abu Hamza after interrogating Sabauddin Ahmad, another LeT operative, who was caught in early 2008. Ahmad, along with Fahim Ansari, had apparently been part of the recce team for Mumbai. MUMBAI: Indian Mujahideen’s (IM) top operative Sadiq Sheikh’s confession on his alleged role in the July 11, 2006 serial Mumbai train blasts has
come as a huge embarrassment to the Maharashtra anti-terrorism squad. Two years ago, the ATS had chargesheeted 13 people but Sadiq and other members of IM module were not named as conspirators.

On Friday, after a news channel aired the videotapes of Sadiq’s confession in which he says that he and his associates had purchased pressure cookers, placed bombs in them and planted them in trains, the ATS was at pains to rubbish it saying Sadiq was trying to mislead investigators.

‘‘Our teams are questioning him and we cannot reveal information at this juncture,’’ said acting ATS chief, additional director-general of police K P Raghuvanshi. It was Raghuvanshi who had headed the 7/11 investigation as ATS chief. He had then claimed that the blasts were carried out by Simi activists and Pakistanis.

Sadiq first admitted his role in 7/11 when he was in custody of the Mumbai crime branch. The crime branch, while investigating the cars stolen from Navi Mumbai which were used in the 2008 blasts in Ahmedabad and planting of bombs in Surat, arrested Sadiq and 20 others last September. DGP A N Roy had then said that Sadiq’s claims were part of an al-Qaida ploy to mislead investigators. TOI had reported these developments extensively in its edition of October 15, 2008.

In the confession which has come to light now, Sadiq, an electronic engineer, said he along with his accomplices engineered the train bombings (which killed 188) on the instructions of his mentors, Riyaz Bhatkal and Amir Raza, both of whom are wanted.

In his statement before the police, Sadiq said that they had manufactured the bombs at a flat in Sewri in central Mumbai which was taken on rent by Abu Rashid, a wanted accused. However, the ATS said the bombs were manufactured in a 100-sq ft room in Govandi and that some Pakistanis were also present there.

‘‘All five of us arranged local first class train passes beforehand. We also had the local train time table with us so that we could choose a train as per our convenience. We purchased bags and pressure cookers in Bombay,’’ Sadiq told the police, adding, ‘‘On the day of the blast — July 11, 2006 — all five of us assembled the bombs and filled seven cookers with explosives. We kept the bombs ready. We had planned the bombs to go off at 6:30 pm. So we had activated the timer at 2 pm. We planned to move one by one with the bags containing the bombs.’’

The crime branch in its chargesheet against the IM module had mentioned that Sadiq was allegedly involved in several blast cases across the country since 2005. "Sadhvi Pragya has given up food and is prepared to embrace death thanks to inhuman treatment being given to her by the Anti-Terrorism Squad personnel. <b>While she is subjected to untold miseries, underworld don Abu Salem and other Mumbai bomb blast accused lodged in Arthur road jail were living lavishly enjoying the Id feast of 'Shirkurma," </b>an editorial in the party mouthpiece Saamna said.

Hemant Karkare was posted in ATS section of Maharastra police as its
head, a posting that is very unusual for an international spy as the
state service is much inferior to R&AW. Added to this Sonia Gandhi
appointed a corrupt and criminalized policeman by name A N Roy, after
he was promoted over three senior policemen, as the DIRECTOR
GENERAL OF POLICE OF MAHARASTRA STATE. The appointment of Roy
was termed as illegal by the Administration panel CAT and asked the
state to demote him. Yet Roy continued in his position. A court has
also ordered the government to file cases against AN Roy as he had
ordered illegal detention of a citizen for months without any evidence,
but for the crime of seeking information about Roys links to Mafia
through RTI route. With these two criminalized IPS officers in position,
they started working to create the artificial HINDU TERROR to get votes
of the christians and muslims for the parliamentary elections of 2009.

What has not been highlighted is the BJP's victory in Malegaon (Maharashtra) <b>which has a huge Muslim population (said to be 50 per cent)</b>. There was much expectation that the Congress would wrest this seat from the BJP, courtesy the ATS's dubious case against Lt Col Prasad Purohit and Sadhvi Pragya Singh Thakur that they, along with nine other 'Hindu terrorists', plotted and executed the September 29, 2008 motorcycle bombing at Malegaon in which six Muslims were killed.

It is not surprising that this minor detail should have been ignored 'seculars'.

Kandhamal rape case: Nun identifies the third accused

BHUBANESWAR: The catholic nun, allegedly raped during the Kandhamal riots, on Tuesday identified a third person in an identification parade and a charge sheet is now likely to be filed against the three people.

Seventy persons were today produced at the second Test Identification Parade (TIP) held at Choudwar jail in Cuttack, official sources said.

Earlier during the first TIP on January 5, the nun had identified two persons, they said.

"With identification of three persons, police will now file charge sheet against them," a senior crime branch official said, indicating that its search for accused persons had ended as all the three persons allegedly involved in the incident had been identified by the victim.

The nun was forcibly taken to a room where she was allegedly raped during Orissa bandh in the aftermath of VHP leader Laxmanananda Saraswati's killing on August 23 last year.

While one person actually raped her, two others helped the rapist, the official said, adding the second TIP was held almost six months after the first TIP following the arrest of seven more persons during the period.

- It always keeps the cases of <i>prominent</i> innocent Hindus - who have been falsely charged - unresolved (well, it has no evidence against them, and they are prominent). Part of the Catholic Cataclysm technique executed on Hindu Bharatam.
- For the not so prominent innocent Hindus, catholicism can easily get the CBI (the Christian Bureau of Inquisition) to plead in the courts for a death sentence to silence innocence. There was that very obscure case of the very much obscured Dara Singh.

In a reprieve to sadhvi Pragya Singh Thakur, Lt Col S P Purohit and nine other accused in the 2008 Malegaon bomb blast case, a special court on Friday dropped provisions of the stringent Maharashtra Control of Organised Crime Act (MCOCA) invoked against them saying none are part of an organised crime syndicate.

Designated Judge Y D Shinde, presiding over the special MCOCA court here, however, rejected the bail plea of Purohit.

The court dropped the charges in this case while hearing the bail plea of Purohit who had challenged invoking this stringent act. Shinde observed that none of the accused are part of the organised crime syndicate.

He also observed that none of the accused had more than one charge sheet filed against him or her -- a prerequisite for invoking provisions of MCOCA.

As provisions of IPC would apply now, the case would be heard by a sessions court in Nashik.

The special court, however, stayed its order lifting MCOCA provisions for a period of four weeks to enable the state to file an appeal in Bombay High Court.

Additional DGP K P Raghuvanshi said the government would file an appeal in the high court after getting certified copy of the order.

Seven people were killed in a bomb blast on September 29, 2008 at Malegaon, a textile town near Nashik.

Purohit in his bail application had challenged the invocation of MCOCA in the case on grounds that the stringent law does not apply in the case as none of the accused have previous criminal antecedents.

"According to the prosecution, the accused belonged to a group Abhinav Bharat that was part of the organised crime syndicate. However, Abhinav Bharat is a registered group, which has objectives like promoting national harmony and so on and not to promote violence," Purohit's lawyer Shrikant Shivade said.

He further said that the prosecution had invoked MCOCA only to extract confessions from the accused. "<b>If the case is under IPC then the confessions would have to be recorded before a magistrate but in MCOCA cases the confessions can be recorded by a deputy commissioner of police,"</b> Shivade said.

He further said that the<span style='font-size:14pt;line-height:100%'> ATS does not have any other individual evidence in the case against the accused other than the confessions. "Police resort to such moves when they lack evidence," </span>he said.

Besides Thakur and Purohit, the other accused are Rakesh Dhawde, Ramesh Upadhyay, Shyamlal Sahu, Shivnarain Kalsangra, Dayanand Pandey, Sudhakar Chaturvedi, Jagdish Mhatre, Sameer Kulkarni and Ajay Rahirkar.

<b>MCOCA charges don’t stick to Pragya</b>

<b>Lt Col Purohit, nine others also free of stringent Act</b>

In a major jolt to the Maharashtra’s Anti-Terrorism Squad (ATS), a special trial court on Friday dropped the charges under the stringent Maharashtra Control of Organised Crime Act (MCOCA) invoked against all 11 accused in the September 28, 2008 Malegaon blasts case, including Army officer Lt Col Prasad Purohit, Sadhvi Pragya Singh Thakur and Dayanand Pandey alias Sudhakar Dhariwedi.
(Sudhakar is his real birth name, Sudhakar Dhar. But the name of "Dayanand Pandey" has nothing to do with Swami Amritananda Dev Tirtha.)

In a ruling that vindicated the stand taken by the defence lawyers that the ATS had wrongly applied MCOCA against the accused, designated Special MCOCA court Judge YB Shinde said none of the accused was part of an organised crime syndicate and no one had more than one chargesheet filed against him or her — which is a pre-requisite for invoking the MCOCA provisions against Sadhvi Pragya, Lt Col Purohit and other accused in the case.

As a consequence of the dropping of the MCOCA charges against the 11 accused, the Malegaon blasts case will now be heard at a regular sessions court at Nashik. Now that they will be tried under various sections of Indian Penal Code, Unlawful Activities (Prevention) Act and Explosive Substances Act, the accused can look forward to getting bail in the case - a thing that was not happening as long as they were saddled with the MCOCA charges.

Apart from Purohit, Sadhvi Pragya and Dayanand Pandey, the other accused against whom the MCOCA charges have been dropped are: Abhinav Bharat activist Sameer Kulkarni, Shivnarayan Kalsangra, Shyam Sahu, former army officer Ramesh Upadhyay, Ajay Rahirkar, Rakesh Dhawde, Sudhakar Chaturvedi and Jagdish Mhatre.

The Malegaon blasts, it may be recalled, had claimed six lives and left 101 others injured on the night of September 29, 2008.

Friday’s development has also embarrassed the Congress-led DF Government which used the Malegaon blasts case to pillory the BJP-led Opposition in the run-up to the recent Lok Sabha poll.

<b>Maharashtra Minister of State for Home Naseem Khan sought to play down the import of the special court ruling, by saying that the State Government would challenge the ruling in the Bombay High Court within next four weeks.</b>

The special court's ruling dropping MCOCA charges against Sadhvi Pragya, Purohit and other accused comes close on the heels of an order by a Parbhani fast track court, discharging Rakesh Dhawade, one of the 11 arrested in the Malegaon blasts case, from the 2003 Purna blast case in Parbhani district for want of adequate evidence.

Dubbing the special court’s ruling as a “slap on the face” of the ATS officials who investigated the Malegaon blasts case, Purohit’s lawyer Shrikant Shevde told The Pioneer: “It has now been proved beyond doubt that the ATS had misused the provisions of MCOCA to bracket them with terrorists and gangsters belonging to the organised crime syndicates. <b>From what the ATS officials have done in the Malegaon blasts case, it is high time that powers vested with him to invoke the provisions of MCOCA should be taken away from them.” </b>

As if to buttress its case, the ATS — when it filed a 4,528-page chargesheet before the MCOCA court on January 20, 2009 — had among other things <b>claimed</b> that Purohit's main aim was to establish “Hindu Rashtra” for which he was ready to take the help of Israel.

So much so that the then acting State ATS chief KP Raghuvanshi, who replaced senior IPS officer Hemant Karkare killed in the November 26, 2008 attacks on Mumbai, had gone to town by saying: “He (Purohit) believed that the Indian Constitution was not enough to tackle what was happening in the country and wanted to establish a Hindu Rashtra. He wanted to take help of Israel to further his cause.”
(Sounds like more planted 'evidence'.)

Shevade’s comments should be seen in the light of the fact that the MCOCA — enacted to coming down heavily on the organised syndicates — mandates that the legislation could be invoked against a group of accused only if at least one of them has a criminal background and has been chargesheeted twice in a criminal case within a period of 10 years.

The defence lawyers, including Shevde and Ganesh Sovani, had challenged the applicability of MCOCA in the Malegaon blasts case.

The ATS booked all 11 accused under MCOCA on November 20, 2008 on the ground that Dhawade had two chargesheets against him. Soon after his arrest in Malegaon blast case on November 2, 2008, the ATS had linked him to two explosions inside mosques in Parbhani and Jalna in 2003 and 2004 respectively. The ATS claimed that Dhawade had provided arms training to suspects involved in those two explosions.

The chargesheets were filed against Dhawade in the two explosions on November 13 and November 15, 2008.

Shevde, however, sought to explain Friday's ruling vis-à-vis Dhawade’s role in other blasts by saying: “The discharge of Dhawade in Parbhani blast case has no bearing on the applicability of MCOCA in this court. When Dhawade and other accused were arrested in November 2008, there was no chargesheet against any of them. <b>The ATS subsequently wrote to the Parbhani and Jalna police and asked them to book Dhawade in that case.</b> We argued that this action was mala fide and the court accepted our argument.”

The special court may have ruled on Friday that the ATS committed a mistake in applying MCOCA in the Malegaon blasts case, but there are still three cases — not exactly similar ones — where applicability of MCOCA has been challenged. They are: the Aurangabad arms haul case on May 2006, the Sept 8, 2006 Malegaon serial blasts case, and the July 11, 2006 Mumbai serial train blasts case. The Supreme Court has stayed the trials in these cases till its verdict on a bunch of petitions challenging the applicability of MCOCA to the accused in these three cases.<!--QuoteEnd--><!--QuoteEEnd-->Partly relieved. But in the case of Dara Singh and the others who were accused along with him over Staines, an innocent Hindu was in the end convicted anyway in the sham trial, and the CBI even tried to get him a death sentence for the greater glory of christianism.

I have noticed even Xtian nut jobs are starting to use the word "Hindu" terrorist. They want to demonize use like the Islamists. One White Xtian told me that "Did you know there are Hindu terrorists also?". I replied that by his definition I am probably one too, since the only qualification is that you be even remotely proud of being Hindu (Infact even calling yourself a Hindu is enough to be labeled an "extremist").

This is a good situation for us actually, since this kind of militant anti-Hindu attitude is helping in winning lot's of average Hindu's over to Hindu Nationalism.
