'Centre ignoring my panel recommendations'
Justice VS Malimath is a disappointed man. The eminent jurist who headed a committee on criminal justice reforms that recommended far reaching amendments to criminal laws dealing with terror among other crimes, fears the nation could lose its battle against terrorism if tough options were not exercised by the UPA Government.Â
The former Chief Justice of Karnataka and Kerala High Courts recently met Union Home Minister Shivraj Patil and conveyed his apprehensions, requesting him to act on the panel recommendations without further delay.
Speaking to The Pioneer on Wednesday, Justice Malimath said, <b>"I met the Home Minister to tell him it was not possible to deal with terrorists under existing provisions. Our recommendations for revamping the laws should be brought in force.''</b>
On the Home Minister's response to his appeal, he said, "Shivraj Patil was convinced but expressed helplessness saying the Government would have to take a political call since the views of the allies and the human rights activists had to be considered.''
Justice Malimath said the meeting took place at his initiative as he wanted to brief the Home Minister on the gravity of the developing situation and the urgency for firm and immediate action. "While I had publicly stated my willingness to meet political leaders and explain the need for quick affirmative action, none from the Government responded. So I took the first step,'' he revealed.
The Malimath committee comprising five other members besides Justice Malimath had suggested a series of measures to strengthen the system to provide "justice to victims'' and "protect the innocent.'' The comprehensive report commissioned by the NDA regime assumes importance in the backdrop of the increased terrorist attacks and a debate on ways to tackle the menace.
Strongly refuting the claim by some political leaders that present laws were adequate, he stated, <b>"Today's laws do not ensure conviction. Terrorism has become profitable since terrorists, knowing they cannot be punished put in repeat performances.'' </b>
Pointing out that, not only was there a spurt in terrorist attacks but that such attacks were "of an increasingly gruesome nature'', the former Chief Justice advocated a no-holds barred approach against such crimes.
Referring to criticism of his recommendations by human rights activists, Justice Malimath remarked, "Terrorists violate human rights and when the law is set in motion, activists begin demanding the rights of the accused,'' adding he was primarily concerned about victims while the activists had regard for the accused.
The former Chief Justice said the panel had considered the rights of the accused and suggested all rights under the law be put in a Schedule as part of the CrPC.
Justice Malimath's dismay underlines the dithering attitude of the Centre in the face of repeated terror attacks. Neither can it decide on tough legislations nor a revamp of existing criminal laws to combat the menace more effectively. It has been sitting on the panel recommendations for four-and-a-half years since assuming power.
In tandem with Justice Malimath's views, former Union Law Minister Arun Jaitley, during whose tenure the committee was established, favoured immediate implementation of the recommendations and added some of the suggestions had been incorporated in the statutes during the NDA rule. "The Union Home Ministry before whom the matter rests should act promptly and implement the suggestions,'' he told The Pioneer.
<b>The two most important recommendations of the panel having a direct bearing on terrorism-related cases are on `right to silence' and `burden of proof. ' Since Article 20 (3) of the Constitution provides a citizen the right to remain silent during questioning in a trial, the accused get away by simply maintaining silence when questioned since no adverse inference can be drawn. While recognising the right to silence, the panel suggested the court could draw an adverse inference from such silence, and recommended the substitution of section 313 of the CrPC with 313(B) where silence could attract the court's adverse conclusion.</b>
<b>The present concept of `burden of proof' is truly a burden for the investigating agencies and the prosecution in terror-related cases since the accused is considered innocent until proved guilty. The Malimath panel suggested the courts determine the burden of proof based on defence and prosecution statements.</b>
The contentious definition of `proof' which becomes vital in terror-related trials was also considered by the panel. While the Indian Evidence Act does not precisely define `proof,' the standard understanding of proof is one `beyond reasonable doubt.' The panel felt it to be extremely stringent probably because `beyond reasonable doubt' rarely happens and the accused invariably escapes. It suggested replacement of `beyond reasonable doubt' with `clear and convincing' proof that would assist investigations and conviction in terror cases.
<b>The panel suggested the law authorise audio and video statements, confessions and dying declarations, adding Section 25 of Indian Evidence Act be amended to make confessions recorded by the rank of superintendent of police and above as admissible in a court of law. This has been a contentious issue vociferously opposed by human rights activists since it is similar to provisions in the scrapped POTA and equally strongly demanded by those who believe terror can be best fought through tough provisions</b>.
Yet another bone of contention is the recommendation to amend Section 167 of the Code which gives 90 days to the investigating authorities for filing charge-sheet failing which the accused gets bail. Clearly bringing in its fold crimes of terror, the committee suggested the period be extended to 180 days for offences punishable with imprisonment above seven years. The extension would be a boon to agencies probing terror attacks since they find the 90 days an inadequate period to tie up loose ends in a crime that often has inter-State ramifications.

According to a source, the four arrested persons were identified as Nurul Amin (43) from Gajaria and three illegal Bangladeshi nationals Joinal (28) from Chittagong district in Bangladesh, Roshan Jamam from Sylhet and Abdul Malek (22) from Rangpur.

Prasad claimed that all four were local people and dispelled rumours that the suspected terrorists were from Gujarat and Maharashtra. âWe believe we have broken into a key local unit of the Indian Mujahideen,â he said.
In a related development in Bangalore, senior officials of Hindustan Aeronautics Limited on Friday confirmed that three of their employees were being questioned by Central agencies over their alleged links with the functionaries of the banned Students Islamic Movement of India.
Director-General and Inspector-General of Police R. Sri Kumar, who has been closely monitoring the developments and is coordinating with the Union Home Ministry, said: âWe are in close touch with the police of other States. We are following up on all possible leads in the shortest possible time.â
The suspects arrested in Ullal have been identified as Mohammed Ali (56), a real estate agent from Mukkachari in Ullal, and his son Jawed Ali (20), a student of Quranic Studies; Naushad (25) of Subhashnagar, who is engaged in construction work; and Ahmed Bawa (33), a petty businessman from Haleyangadi village near Mulki. As evidence, the police displayed what they claimed to be five âlive bombsâ, several mobile phone SIM cards from Maharashtra and Gujarat (used and unused), alleged Jihadi literature and compact discs, passports, mobile phones, a laptop, two computer hard drives and Rs.11.39 lakh in cash. The police said all the details of the case and the incriminating evidence could not be shared as it might affect the probe.
The Bangalore police, reportedly helping the IB team, remained tight-lipped. âWe have neither arrested nor detained any HAL employee,â said Police Commissioner Shankar M. Bidari.
The Director-General on Friday reviewed the investigation related to serial blasts in Bangalore.

Since 1979 people of Assam are fighting continuously against infiltration of Bangladeshi Muslims in to Assam. But, surprisingly infiltration is increasing day by day. For the last one year various student, political and social organizations through out North-east, organized severe campaigns to drive out Bangladeshi Muslims from their respective states.
Recently Student organizations in Mizoram, Arunachal Pradesh and Nagaland gave ultimatums to Bangladeshis to leave Bharat. In Assam also so many organizations started driving out Bangladeshis. Slowly these campaigns are gaining momentum. In this situation Muslims under the name of All Assam Minority Students Union gave a Bandh call in Assam in the month of August 2008 opposing the driving out campaign of Bangladeshi infiltrators. Under the disguise of bandh Jihadiâs unleashed violence. Eight Hindus were killed, Eight Hindu villages were torched in Udalguri District of Assam and hundreds of vehicles destroyed. This violence continued for about 15 days.
Again now on the next day of Id festival, on 03-10-2008 with out any provocation Muslims started attacking Hindus in the Udalguri district of Assam. Attacks targeted the Hindu Villages (Bodo, Rabha, Garo, Khasia, Adivasi Santhal Tribes and Assames, Banglaa nd Hindi Bhashis) which are amidst Muslim Villages. On 04-10-08 started attacks on Hindus in Darrang District also. According to the available information causalities in Udalguri and Darrang Districts of Assam are given below.

* It has been noticed that the party in power in Assam that is Congress, in Darrang district to keep the people out side, particularly Assam in dark about the actual happenings, to show that Muslims are the victims, and to appease Muslims and to protect Muslims, starting relief camps for Muslims. Majority of the relief camps in Darrang are this type.
* The Muslim fundamentalist and terrorist organizations in Assam mainly 1. All Assam Minority Students Union (AMSU), 2. SIMI, 3. All Assam Muslim Chatra Parishad and Muslim Students Association (MUSA) leaders are actively touring between Muslim villages in these Districts and they are instigating attacks on Hindus.
* Another thing that is happening is Muslims are occupying the villages vacated by Hindus due to attacks and set on fire. Mostly these Muslims are from Morigaon district came crossing Brahmaputra. This shows meticulous planning by Muslims. Still the attacks are continuing unabated.
* Jehadi elements and some political parties who claim to be working for the interests of the minorities of the state are inciting the communal violence in the trouble-torn areas. The Assam arm of the Indian Mujahideen and MUSA has helped in sneaking in 200 HUJI members in to Assam. And these members under the pretext of stealing of chickens started violence.
* To forment communal clashes. In the end of Ramzan, there were several secret meetings in the Muslim dominated areas of the three districts. This proves that the violence was pre-planned and it was meant to coincide with the Durga Puja festivities. Leaders like Assam United Democratic Front (AUDF - Seth Badruddin Ajmal's Muslim Political Party) MLA Rasul Haq Bahadur and AAMSU president Abdul Aziz demanded separatate autonomous areas for the Muslims in lower Assam and threatened to chase away all Assomia people from lower Assam. The recent violence is the fall-out of these threats. If the government arrested these two leaders under NSA earlier, then the present situation could have been averted. Huji members were involved in the Pakistan flag being hoisted here in the state. The soft peddling by the Government on the issue of Jehadi threat will further encourage activities such as communal violence, anti national activities, anti social activities, militancy and insurgency.
* Vishva Hindu Parishad and Bajrangdal karyakartas are serving the 4,000 victims by supplying food, Tea, Biscuits and Bread in Udalguri, Mainapara, Madhuiguri, and Borkola relief camps.
* As more than 20,000 Hindus are in relief camps. Though feeding in relief camps is only a few days work, running relief camps are very difficult. It involves huge financial involvement.
* After few days all these people return their villages. They have nothing in their village except land. Every thing was either burnt or looted by Muslims.

I agree that people need to indulge in it. (BTW, rest of this post is not directed at Bodhi anymore, am thinking aloud.) It is what leads to planning: first set the goals, then work out the means of getting there.
Hindus don't do this, they refuse to think of the bigger picture of the future - they just concentrate on the next bowl of rice, on the next wedding, on the school/college/university entrance exams - completely oblivious to the fact that meanwhile the jihadis are now several steps into *their* plan for converting Bharatam into Mughalistan. <- They're not sleepwalking like us. Hindus view all of the christoislamicommunist actions as random (in spite of the public declarations of christoislamicommunists detailing their ultimate goals) and refuse to see or acknowledge that there's a solid plan behind it. Hindus don't even want to see individual events coming (christoislamic birthrate and conversion demographics) and what's more, they have *NO* plans of their own other than to coast through life assuming that, even when other Hindus get blown up as happens regularly, they may possibly survive 'til maybe next year or thereabouts. Yeah, that's a *really* good plan - but please please please stop having babies then. (Will admit that extinction is a plan <i>of sorts</i>, but then don't do that half-heartedly as well.)
If extinction is not what they're aiming for, then Hindus need to be aggressive. Gandhians will recoil at the very thought in their militant Pacifism-Or-Death POV, but Hindus need to accustom themselves to the idea:
BE AGGRESSIVE.
We're not christians to preach that the meek inherit the earth. We know from observation that this is untrue. This is the real world, after all. Survival is achieved by fighting for your right to exist - and by neutralising memes that would destroy you.
Stop merely reacting, start acting. We know their goals. But why must we only counter? Why can't we set our own objectives, make our own plans? Our way of life matters to us, doesn't it? Or are we happy to just last another hundred years and don't care whether Bharatam turns into Islamic Repugnance of Mughalistan/India-for-chwist/Maoist failed state by 2100? If Hindus are serious about who we are/want to remain and about whether our ethos and civilisation deserve to last and evolve, unhindered and unterrorised, we need to do so much more than crossing our fingers and hoping our troubles will all just magically melt away. Because they won't. Not that way.
0. Is our way of life worth fighting for? What is it worth? (Assuming 0 is answered satisfactorily, then ->)
1. Need to have objectives. It doesn't matter how unreasonable they are. "Mughalistan" and "Nagaland for chwist" used to sound laughable at some point too, and look how much closer they are now to making these things a reality. (E.g. Christians always start planning for a village to become christian, then they raise money to plant a church there and to either buy up or hammer the locals into submission. Voila, reality. And Islamaniacs plant their scimitars and, after visiting their mosque, leave a trail of dead Hindu fishermen behind to then proclaim they've got a part of Bharatam's coastline. Done.)
2. Once we have objectives, we need to think of ways to get there: plan of action.
3. Set a decent time frame for each (else procrastination kicks in).
E.g. "Nepal returned to Hindu Dharma in 10 years. Memetic disease of christianism gone from Bharatam in 20 years. Memetic disease of Islamism gone from Bharatam in 50 years. Memetic disease of communism gone from Bharatam in 20 years. Hindu Bangladesh in 70 years, Pakistan becomes Hindu land in 80 years. Afghanistan Hindu land in 100 years. Economic and social improvement to lives of people in Dharmic India within 20 years. Regionalism/language-one-up-manship eradicated in 15 years. Uncompromised versions of local Bharatiya languages spoken by population in 15 years, nationwide literacy in Samskritam in 15-20 years. Flourishing in industry, research, arts - not long after."

Let me psyche it, it was: "Roll over and submit. Let the islamaniacs take over Assam, Kashmir and Bengal, we'll retreat to the next bordering state and await a re-run of the same events there. Let the christos have the NE and Kerala, we'll huddle in Karnataka. And then, from our reduced territory of the Even More Psecular Republic of Mini-India, we can chart a course to become ever more secular and accomodating of christoislamicommunism in the futile hope that next time they'll not repeat their previous christoislamic patterns".

Until Hindus think of their goal, have it fixed in their minds and start planning and acting towards it, it won't happen. No use telling me Hindus don't dare to think it - I won't believe it. <b>62,000 legal Bangla visitors missing</b>

NEW DELHI, Oct 22 â In a startling revelation, the Central Government has disclosed that over 62,000 Bangladeshis, who entered India with valid documents during the last three years, have vanished in the country. A highest number of 25,712 persons did the disappearing act last year, which also saw highest number of 5.24 lakh Bangladeshi entering the country legally.
The Government, however, was silent on the question by Motilal Vohra and Satyavrat Chaturvedi, who quoting media reports wanted to know whether over 1 lakh Bangladeshis have so disappeared. They had based their question on a remark by additional DG of Meghalaya Police.
According to Meghalaya Government, the additional DG had made such a reference in a seminar based on newspaper reports, Minister of State for Home Affairs, Sriprakash Jaiswal said.
The Minister said in 2005, 4.85 lakh Bangladeshis entered India legally, of which 12,338 did not return, the next year 4.84 lakh entered and 24,497 disappeared.
The problem of illegal migration from Bangladesh to India has been in existence since post independence days. India has a long and porous border with Bangladesh and people staying on either side of the border are generally from same ethnic background, similarity of language and culture, the Minister argued.
