<b>Violation of human rights, dignity & reputation of Sadhvi Pragya & others</b>

A delegation of 81 eminent citizens comprising retired army officers, retired police officers, lawyers, media persons and social workers today marched to the office of the National Human Rights Commission and presented a petition seeking enquiry into the violation of human rights of Sadhvi Pragya and others accused in the Malegaon blast case.

Led by former Punjab Director General of Police, Mr. K.P.S. Gill, the delegation met Justice G.P. Mathur, Member, NHRC and presented a memorandum.

Mr. Gill told the Commission that prima facie a gross violation of human rights has taken place as Sadhvi Pragya was illegally detained for nearly 13 days; physically assaulted and mentally tortured in police custody with no female police officers present; robbed of her dignity by officers who questioned her chastity; interrogated and transferred from one place to another without the presence of female police officers; and worst of all, denied access to her family and lawyers.

The delegation expressed astonishment that despite the affidavit of Sadhvi Pragya being widely covered in the media, and even published in its entirety in one newspaper, the Commission had taken no notice of the case. Justice Mathur assured that the Commission would study the memorandum and follow the due process in the matter.

Other members of the delegation included Mr Balbir Punj, MP Rajya Sabha; Mrs. Nancy Kaul; Brig R.B. Sharma; Mr. Praful Goradia, former MP; Prof. J.S. Rajput; Prof. Makkhan Lal; Mr. K.N. Dear Madam,

We the undersigned citizens of India are appalled by the gross abuse of Sadhvi Pragyan Singh Thakur’s human rights, dignity, civil liberties, and reputation, by the Maharashtra Anti-Terrorism Squad.

We are extremely disturbed about the cavalier fashion in which the ATS ignored the law of the land and various judgements of the Hon’ble Supreme Court while inquiring into allegations against Sadhwi Pragyan Singh Thakur and others who have been arrested and are, since 20 November 2008, being held under MCOCA after repeatedly seeking and securing their remand on charges for which no evidence has as yet been put forward.

Sadhwi Pragyan Singh Thakur submitted a sworn affidavit in the Nashik court on 17 November 2008. Prima facie the affidavit reveals serious violations of her rights and those of others named in her statement.

Some points that should be of concern to the National Commission for Women include:

1. She was illegally detained for 10 days and shifted from one place to another.
2. She was physically assaulted and mentally tortured in custody.
3. She was robbed of her dignity by the ATS which questioned her chastity.
4. No female police officers were present during her interrogation and transfer from one place to another.
5. She was denied the right to contact her family and her lawyer.

So immense was her trauma that she even contemplated committing suicide. She was subjected to narco-analysis and brain-mapping tests without her consent; these methods of interrogation are used to make accused persons incriminate themselves, and they were continued even though they repeatedly failed to achieve this objective.

A copy of her affidavit is attached to this petition. We have also attached a copy of The Pioneer, published from New Delhi, dated November 19, 2008, which has reproduced the text of the affidavit.

We believe the National Commission for Women should inquire into the issues raised in the affidavit, especially as Sadhwi Pragyan Singh Thakur and others have been detained under MCOCA. Not to do so would be to deny her right to liberty, dignity, and reputation to which she and other accused are entitled.

On the face of it, the report of the Wadhwa Commission on the murder of the Australian missionary Graham Staines and his two sons should have been very welcome to our secular friends. Justice Wadhwa has concluded that the main person who organised the attack was Rabindra Kumar Pal alias Dara Singh, and that his motive in doing so was "misplaced fundamentalism", namely his conviction that conversions by missionaries were threatening Hinduism. He also records evidence to the effect that Dara Singh had been involved in an activity which, in the eyes of secularists, is as deplorable as an activity can get: <b>protection of cows from slaughter.</b>

But no, the secularists are all in rage. "A stained report," "A whitewash," "A politically tutored report" -- they have been shouting. Justice Wadhwa has failed the litmus test: if only he had included a sentence -- a single sentence! -- imputing -- howsoever obliquely -- that Dara Singh was in some way affiliated to some organization that can be linked to the RSS or the BJP, what applause would have greeted the Report!

But the Judge has stuck to evidence. Hence the fury! For our friends, a Commission of Inquiry is credible only if it is useful!

In fact, the Report is instructive on many counts. Not to heed them is to condemn the country to further problems.

Several witnesses testified to Dara Singh's involvement in the crime -- in preparing for it, in executing it. Justice Wadhwa is in doubt that Dara Singh was the prime mover. To fly off in rage at Dara Singh, and feel that one has done one's duty is to miss the point.

There are several important pointers. Several witnesses testified that <b>Dara Singh had been engaged in rescuing cows that were being transported for slaughter. He had been trying to get the State to enforce the Prevention of Cruelty to Animals laws. This activity was taken, even by the police, to be "anti-Muslim" activity.</b> <b>Dara Singh was accordingly implicated in cases filed by persons engaged in transporting and selling cows for slaughter. That is as far as the consequences for Dara Singh under the law are concerned.</b> The effect on the people was the exact opposite. Witness-29, who testified that he had been asked by Dara Singh to accompany him to Manoharpur, told the Commission, "Dara Singh is a very popular figure in the village as he forcibly frees cows from the people who take them for selling. After freeing the cows, Dara Singh distributes the cows among the villagers...."

<b>Cows are revered by Hindus. The man trying to save them becomes an outlaw in the eyes of the police, and a hero in the eyes of the people. Two lessons in that.</b>

On the other hand, Staines and his associates are left free to go on converting Hindus to Christianity. There is no evidence that Staines himself resorted to fraud, force or allurement. Even so, tensions mount because of conversions. Staines' own despatches testify to this. But our institutions -- the Minorities Commission and the police being representative in this regard -- even in retrospect assert the fiction that there was no tension between Christians and non-Christians.
(While there's perhaps no evidence that Staines used fraud/force/allurement to convert, there *is* evidence that his presence in India was illegal, that he owned a gun (and witnesses saw him shoot into the crowd before he got torched), <i>and</i> there's testimony from a christian convert woman that Graham Staines tried to rape her. See top of this post for the links)

The second clue is provided by the evidence of a key witness, one whose testimony contributes most to nailing the involvement of Dara Singh. He is one Dipu Das. He was a close associate of Dara Singh. He revealed to the Commission that <b>"youth from Gayalmunda and Bhalughera had approached Dara Singh sometime in August 1998 to stop the Christians from converting Hindus to Christianity...."</b>

That is the key lesson: if the State is going to persist with double-standards in regard to the sentiments of Hindus and non-Hindus on the one hand, and with a deliberate shutting of eyes on the other, it is paving the way for such crimes.<!--QuoteEnd--><!--QuoteEEnd-->So we learn that Dara's major crimes were
1. to protect the cows from slaughter and that he was trying to get the State to enforce the Prevention of Cruelty to Animals laws
2. to come to the aid of the Hindus of Orissa who'd requested him to protect them and their communities from the christian terrorists.

But what about Dara's "nefarious" involvement in the sensational murder of Graham Staines? It was he who burnt Staines and his two kids, right? Isn't that what the CBI (prosecution) said? Isn't that what the media said? Didn't the courts sentence him after all? Justice was carried out, yeah? All's good in the world - the bad guys languishing in prison, the good guys living it up - we can all go to sleep easy.

Court Case against Dara Singh
<b>Summary of news articles below</b>
There were 13 accused in the Staines murder case. 10 of these 13 accused were released because the evidence against them was no evidence at all. The 11th (Dipu Das) was acquitted from Staines' murder as well, but the CBI pinned the murder of another christo, Arul Doss, on him.

In the Staines murder line up, only 2 remained: Dara Singh and one Mahendra Hembrum were sentenced in the end.

<i><b>What should interest every heathen however, is the following - excerpts from the actual news articles follow after:</b></i>
1. Courts acquitted 11 of the 13 because said the courts "the nature of evidence is absolutely weak and on the basis of such speculative evidence, it is not possible to hold any of the accused guilty for criminal conspiracy". About Dara Singh, they said the evidence against him was the same! "Evidence against the accused including Dara Singh" were "of identical nature". Consequently, that "No justification is available from the evidence in record to single out Dara Singh for convicting him".
2. CBI investigation was seriously dubious:
Courts said “We cannot accept the investigation to be an impartial one” about the way the prosecution (CBI) side conducted the investigation.
Courts noted that CBI had tortured at least one of the accused to get confessions.
Courts noted that the CBI had cheated in getting their eyewitness testimony: the courts essentially said the Test Identification parade was rigged by the Christian Bureau of Inquisition, CBI.
3. Dara Singh on 11 May 2005 was still accused in the murder of another christo (Arul Doss) and an islami.
On May 28th, the CBI et al had shifted the blame for these murders onto Dipu Das instead, since by that time they already had Dara where they wanted him and they no doubt wanted this Hindu 'Dipu' out of the way too.
4. The CBI was not pleased when the lack of real evidence against Dara meant the courts overturned his death sentence and gave him life imprisonment instead. Because a dead Dara can't talk and a live Dara had something else to say. CBI tried to get the Supreme Court to go back on HC and give Dara a death sentence, on the grounds that it was a special case "because the motive was communal".
5. Most interestingly for a heathen reader, Dara Singh himself says he is innocent: that he was never at the scene, that his presence at the murder site was only *presumed* because the people who'd gathered there shouted their slogans in his name.
Next to that, he was not allowed to even speak to his lawyer or his brother thanks to christoterrorism having prevailed on his jailors. In his incarceration, Dara was fettered, not given any water or access to toilet facilities. He asked for free communication with the media, water and toilet facilities and to be released from the *shackles* on his feet. Compare this to how the *proven* islamaniac terrorist Mohammed Afzal, who plotted the islamic terrorist attack on Parliament, gets his halaal islamic delicatessen sent to him in his comfortable jail quarters. And how the entire christomedia and crypto-christo brigade of India has been championing Afzal's cause of "Freedom From Justice", while they naturally ignored Dara Singh the heathen. Still, Afzal wants to die because he can't be shaheed, cooped up in prison as he is (he wanted to make islamaniac martyr, but christoterrorists' campaigning for Christoislamic Human Rights Only prevented it).

The Orissa High Court on Thursday set aside the death sentence of Rabindra Kumar Pal alias Dara Singh and commuted it to life imprisonment in the triple murder case of Australian missionary Graham Stuart Staines and his two minor sons.

Delivering the judgement in a packed court room, a division bench of the High Court comprising Chief Justice Sujit Barman Roy and Justice Laxmikanta Mohapatra acquitted 11 others while maintaining the life imprisonment of Mahendra Hembrum.

<b>“The prosecution (CBI) has not proved beyond reasonable doubt so far their identification is concerned. Their (appellants) conviction and sentences by the trial court cannot be sustained,” the bench observed in a 110-page judgement.</b>

Those who were acquitted by the court include Dayanidhi Patra, Umakanta Bhoi, Kartik Lohar, Rabi Soren, Mahadeb Mahanta, Thuram Ho, Renta Hembrum, Suresh Hansda, Surath Naik, Harischandra Mahanta and Rajat Kumar Das.

The trial court had awarded capital punishment to Dara Singh while handing out life imprisonment to 12 others on September 22, 2003. <span style='font-size:14pt;line-height:100%'>“Evidence against the accused including Dara Singh being of identical nature, they are all equally responsible for the triple murder. <b>No justification is available from the evidence in record to single out Dara Singh for convicting him</b> under Section 302 of IPC,” the court observed. “There is <b>absolutely no evidence on record that due to individual act of Dara alone</b>, the three deceased persons or any of them died. No particular fatal injuries to any of the deceased has been attributed to Dara Singh.</span>

<b>Therefore, Dara Singh cannot be held individually liable for the triple murder, but he can be liable vicariously along with others by invoking Section 149 of IPC,” the bench observed.</b>

<b>With regard to the charge of conspiracy, the court said, “We are sorry to say that the nature of evidence is absolutely weak and on the basis of such speculative evidence, it is not possible to hold any of the accused guilty for criminal conspiracy under Section 120 (B) of IPC. Therefore, the conviction and sentences of the appellants under section 120 (B) cannot be sustained and must be quashed.”</b>

Indicating various shortcomings in the investigation with regard to the identification of the miscreants and procuring the confessional statements, the court observed, “We cannot accept the investigation to be an impartial one.”

<b>In a virtual stricture to the central investigating agency of the country, the court observed, “There are circumstances to show that the confessional statements of Umakanta Bhoi must have been secured by coercion, duress and threat.”

The court also took exception to the manner in which the test identification (TI) parade was conducted by the CBI. Graham Stuart Staines, an Australan missionary who ran a leprosy home at Baripada in Mayurbhanj district, and his two minor sons Philip (11) and Timothy (8) were asleep in their station wagon at Manoharpur village in Keonjhar district on the night of January 22, 1999, when a crowd surrounded them and set the vehicle ablaze killing all three.

A sessions court had sentenced Dara Singh to death and 11 ohers to life imprisonment but the order was set aside by Orrisa High Court in May this year which converted the death sentence of Dara into a lifer and acquitted 11 others.

The Supreme Court on Wednesday admitted the cross-appeals filed by Ravinder Pal Singh, alias Dara Singh, against his conviction and life sentence and the CBI seeking capital punishment for him in the murder of Australian missionary Graham Staines and his two minor sons.

The appeals against the judgment of the Orissa high court were admitted by a bench comprising Justice Ashok Bhan and Justice Altamas Kabir, which took exception to CBI arguments which were not mentioned in the Special Leave Petition (SLP) filed by it.

When the CBI counsel advanced some reasons for setting aside the high court verdict acquitting 11 accused in the case, the bench said he was referring to the reasons which are not part of the SLP. “Are you reading extra papers which are not in the SLP?” the Bench asked the counsel and said it has only to see the reasons given for acquittal by the high court and it is for the agency to show how it was against the law. The high court on May 19 had set aside Dara’s death sentence for the murder of Staines and his two minor sons — Philip (10) and Timothy (6) — but had upheld life imprisonment on him for being part of an unlawful assembly that burnt them alive.

Along with Dara, another person, Mahendra Hembram, was convicted in the case. However, the high court had acquitted 11 others, who were awarded life terms by the trial court in the case that had sparked worldwide outrage in 1999. The high court had held that there was absolutely no evidence on record that due to the individual act of Dara Singh, the three persons or any of them died and had quashed the capital punishment for him.

<b>Pointing out loopholes in the evidence, the high court had said it was “risky” and “dangerous” to convict so many accused <span style='font-size:12pt;line-height:100%'>on the basis of speculative evidence of a witness who did not disclose the matter to anyone except a CBI officer five months after the incident.</span></b>

The trial court had convicted 13 accused, including Dara Singh, under Section 302 (murder) read with 149 (every member of an unlawful assembly guilty of crime) of the Indian Penal Code and had awarded life imprisonment to them. The court had awarded death sentence to Dara by finding him guilty under a separate charge under Section 302.

<b>Dara</b>, whose death penalty was commuted into life imprisonment by the high court, <b>contended that his conviction was merely upheld on the basis of presumption of his presence at the site of incident as the mob was shouting slogans in his name.</b> CBI has sought the re-imposition of death sentence for Dara terming the case as rarest of rare.<!--QuoteEnd--><!--QuoteEEnd-->

Asked for better conditions: proper food, access to bathroom and granting of water (he had neither), removal of the shackles on his feet - and asked for access to the Media. Why would Dara want access to the media, of all things? Because he wants to set the record about himself straight, of course. That's because he imagined the media did not have any religious affiliation - he imagined they would not be as biased as his jailors, prosecutors and convictors were in sentencing and mistreating him.

- constant spinning of other charges against the accused when they find there's no evidence for the primary accusations
- christomedia's deafening silence in presenting the Hindu accused's sides, but its loud premature (predetermined) condemnation of their alleged crimes. E.g. no first-hand statements from Purohit to the public are presented, media only reported 2nd hand info from ATS on the alleged confessions of Purohit. Just like Dara Singh's own confession of innocence was almost entirely ignored.
- ATS trying to kill Purohit, just as CBI wanted the courts to kill Dara Singh

Besides all the above similarities, there is another one, with a different case of christoterrorism versus the Hindoo. Look at the maltreatment in prison of Dara Singh, defender of cows and Hindus and claimant to innocence in the murder of Staines. The vegetarian Kanchi Shankaracharya was expressly given only meat products by the christian 'police' (who also tortured him in custody) when he was incarcerated by christianism <i>for yet another murder falsely foisted onto a Hindu</i>. Note how there was no evidence against Kanchi Shankaracharya either. Though he is free now, the christolying govt will not retract their false charges against him and this is precisely what christoism intends should go into christo archive of rewritten history. They framed the Kanchi Acharya for character assassination purposes. But the christo govt is able to perpetrate more onto Dara Singh - a more obscure Hindu, not having the religious recognition of the Kanchi Swami. Dara is given life imprisonment (and was initially going to be given a death sentence, and would have been had CBI succeeded in their push for one). The other difference between the two situations is that christos foisted a murder of a *white* *christian* onto Dara Singh. Whereas they were only able to dump allegations of the murder of a 'native' onto Kanchi Shankaracharya.


<b>The <i>Christian</i> Inquisition of Hindus.</b>
- The case against Dara et al was entirely christian. Christoterrorists needed a fall guy and who better to get rid of than an anti-conversion Hindoo who protected the cows - cows like the ones Staines fed to his christian converts (such as the convert woman Staines tried to assault).

Unless it was someone else pretending to be the Bajrang Dal, surely?
(Also note that whatever mob it was, it was also most curiously shouting Dara Singh's name even though he was not present. And it was only this that led to the investigators presuming that Dara was even there at the time.)

The Vishwa Hindu Parishad described the ATS' claims of blast accused Shyam Apte and Dayanand Pandey wanting to target RSS functionaries Mohan Bhagwat and Indraesh as "baseless".

"The UPA is now scared of the kind of support the RSS and Sangh has over the majority voters and so they are keen on spreading rumours," said Togadia.

It made specific accusations about her being verbally abused, her chastity being questioned, access being denied to lawyers and, contrary to directions by the Supreme Court, no female police personnel being present while she was interrogated or moved from one location to another. The public response to these revelations has been strong. More important, it has been spontaneous. For instance, the small group of 81 citizens who marched to the National Human Rights Commission in Delhi on Friday afternoon comprised, aside from one or two political activists, retired civil servants and white collar professionals who usually stay away from public protests. It does show that, somewhere, the affront to a woman and to as venerated an institution as the Army has hurt middle India. The Prime Minister’s attempt at damage control, his call to Mr Advani and the decision to send the National Security Adviser and the Intelligence Bureau chief for a joint briefing would suggest that the Congress has sensed that the popular mood is not sympathetic and positively suspicious of the actions of the Maharashtra Government.

It is nobody’s case that politics or ideological prejudice should come in the way of terrorism investigations. However, it is interesting that the Congress did not take this moralistic position when some of its own MPs sought to denounce the recent Batla House gun battle in Delhi, implying it was a fake encounter and practically charging the Delhi Police with cold-blooded murder. The Samajwadi Party, a key ally of the Congress, is actually talking of funding the legal defence of the Indian Mujahideen terror suspects. It is worth noting that there is a large body of evidence against the IM members. There is no matching case against the supposed ‘Hindu terrorists’. Other than a new name every day — the latest is a 70-year-old, semi-incapacitated IT professional who lives in a Pune bungalow, and who has been informed, through a newspaper plant, that he is the mastermind of ‘Hindu terrorism’ — the ATS has furnished next to nothing. In this situation to ask what exactly it is doing, suggest it lay off salacious off-the-record briefings and demand it respect the dignity of both a woman remand prisoner and of the Indian Army is hardly unreasonable. As for the guilt or innocence of the suspects, let the courts decide. Whether the ATS and its political masters are in congress or otherwise, truth shall prevail.

ATS threatened to eliminate me in encounter: Lt-Col Purohit

Investigations into the laptop of arrested Lt Col Shrikant Purohit, has shown that the Army officer apparently visited anti-Muslim websites frequently but revealed nothing incriminating.

The laptop, handed over by the Army after a week of Purohit's arrest, was examined at a forensic laboratory during which, the probe agencies, claimed that he was often visiting anti-Muslim and jehadi websites, sources attached with the investigations said.

But, the investigators did not get details about the composition about the saffron outfit -- Abhinav Bharat -- whose cadres are alleged to be behind the blast in Malegaon on September 29 which they were looking for. 2. Arrest of yet another Hindu, "Chaturvedi" - total up to 11 now. But Chaturvedi's lawyer won't let the ATS have him because, according to the lawyer, the ATS will only torture him and try to get a false confession.

On a day when a Nashik court transferred the Malegaon blast case to the Mumbai-based special Maharashtra Control for Organised Crime Act (MCOCA) court, the Anti-Terrorist Squad (ATS) formally arrested Abhinav Bharat's national coordinator Sudhakar <b>Chaturvedi</b>, whom a city court remanded to ATS custody till December 3. Chaturvedi is the eleventh accused in Malegaon blast case against whom the ATS has invoked MCOCA.

<b>In a significant development, Lt Col Purohit - in a written submission made to a Pune court on Friday - alleged that the ATS interrogators had beaten him up and tried to coerce him into making a confession, while he was in their custody.</b> He, however, told the court he had no grievances against the Pune police, in whose custody he was for two days in an alleged cheating and forgery case.

<b>"As they forced my client to make a confession while in custody, the ATS interrogators even told him that he was free to retract his confession subsequently in court. However, my client steadfastly refused to sign the confessional statement," Lt Col Purohit's counsel Shrikant Shivde told The Pioneer from Pune in the evening.</b>

Earlier in the afternoon, Magistrate GG Italekar remanded Purohit to 14-day judicial custody in the alleged cheating and forgery case filed against him by a Pune resident Milind Date.

Making a case for Chaturvedi’s ATS custody, Special Public Prosecutor Rohini Salian informed a city special court that key blast accused Purohit and Chaturvedi were in constant touch in connection with arranging blast conspiracy meetings and that his custodial interrogation would shed more light on what transpired in these meetings.

<b>Alleging that his client had been "falsely implicated" and that there was no evidence against him, Chaturvedi's lawyer Naveen Chomal opposed his client's custody on the apprehension that the ATS would torture him while in custody to extract a confessional statement.</b>

In two related developments, one of the key Malegaon blast accused Dayanand Pandey was subjected to narco analysis test at the Forensic Science Laboratory in Bangalore and a team of police officials from Hyderabad met the state ATS officials in Mumbai in connection with investigations into the serial bomb blasts in the Andhra Pradesh capital in August 2007. Hyderabad's is the fourth police team to have interacted with the Maharashtra ATS officials. Earlier, police teams from Haryana, Gujarat and Rajasthan police had met the ATS officials in Mumbai.

Also, Dayanand Pandey underwent a narco analysis test at the Forensic
Science Laboratory (FSL) in Mumbai, FSL sources said. Pandey was subjected to the narco analysis test for about four hours, the sources told PTI. FSL is yet to decide whether to subject Pandey to other tests like polygraph and brain mapping, they said.

In Sonepat, throwing its weight behind the Malegaon blast accused, including sadhvi Pragya Singh Thakur, a group of advocates have set up a 17-member lawyers committee for providing legal assistance to them. Stating that the Hindu Unification Movement Legal and Welfare Association (HMLA) will provide legal assistance to the Sadhvi and other accused, Bhupeshwar Dayal Gaur, a founder member of the association, said here today the committee comprises 12 lawyers from the town alone. He said the Maharashtra ATS conducting a probe into the September 29 blast, has already collected information about the association and he, too, was interrogated in Delhi recently.

The BJP on Friday asserted it did not want to interfere with investigations into the Malegaon blast but said Maharashtra ATS should not "harass" saints and army personnel.
